AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, SUBJECT
TO RECEIPT OF THE GRANT, IN THE AMOUNT UP TO $88,000.00, FOR THE
PURPOSE OF FUNDING THE TEXAS DEPARTMENT OF TRANSPORTATION
FISCAL YEAR 2025 COMMERCIAL MOTOR VEHICLE GRANT; PROVIDING
FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
Operating Federal Fund, subject to the receipt of the grant, in the amount up to $88,000.00, for the purpose of
funding Texas Department of Transportation Fiscal Year 2025 Commercial Motor Vehicle grant.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

(ALL) Ratify Application for, and Authorize Acceptance of, if Awarded, the Texas Department of Transportation Commercial Motor Vehicle Grant to
Occur Fiscal Year 2025 in an Amount Up to $88,000.00, Authorize Execution of Related Grant Agreement, and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify application for, and authorize acceptance of, if awarded, the Fiscal Year 2025 Commercial Motor Vehicle Grant from the Texas
Department of Transportation in an amount up to $88,000.00;
2. Authorize the execution of a grant agreement with Texas Department of Transportation for the Fiscal Year 2025 grant; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund in an
amount up to $88,000.00 subject to receipt of the grant, for the purpose of funding the Texas Department of Transportation Fiscal Year
2025 Commercial Motor Vehicle grant.
DISCUSSION:
The Texas Department of Transportation (TXDOT) Commercial Motor Vehicle (CMV) grants are aimed at reducing the number of commercial
motor vehicle crashes, injuries, and fatalities. The TXDOT CMV grant will pay for the overtime hours of the police officers participating in the
program. TXDOT CMV grant activities include enforcement of speed, seatbelts, impaired driving, and intersection traffic control laws.
The total proposed direct program amount for Fiscal Year 2025 is $110,000.00, which includes $22,000.00 in match funds. The required minimum
amount of match funds is 20%. Funds will be budgeted for overtime and associated fringe benefits for an estimated 1,000 enforcement hours with
an additional estimate of 45 hours for administering the grant. The grant will also fund overtime for public information and education events.
Matching funds will be provided through the Fiscal Year 2025 Crime Control Prevention District budgeting process. Should match funds not be
identified, the grant award will not be accepted.
Indirect costs are allowed and will be accepted at 10% de minimis.
This Mayor & Council Communication (M&C) ratifies the submission of the grant that was due on January 4th, 2024. Ratification is necessary due
to the internal review and approval process for new grants prior to getting M&C approval and meeting the grant application deadline. The City
Managers Office was consulted prior to the application to determine the appropriateness of proceeding with a ratified grant application.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: State
of Texas
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds
will be available in the current operating budget, as appropriated, in the Grants Operating Federal Fund. The Police Department (and Financial
Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Police
Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
