HomeMy WebLinkAboutOrdinance Central City Local Government Corporation (CCLGC) 26756-03-2023Ordinance No. 26756-03-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL CAPITAL PROJECTS FUND, IN THE AMOUNT OF S150,000.00, FROM AVAILABLE PAYGO RESIDUAL AND INTEREST EARNINGS, FOR THE PURPOSE OF FUNDING THE LAS VEGAS TRAIL PROJECT (CITY PROJECT NO. 103085); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Capital Projects Fund in the amount of $150,000.00, from available PayGo residual and interest earnings, for the purpose of funding the Las Vegas Trail project (City Project No. 103085). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Capital Projects Fund in the amount of $150,000.00, from available PayGo residual and interest earnings, for the purpose of funding the Las Vegas Trail project (City Project No_ 103085); 2. Amend the Transportation and Public Works' Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: In 2019, the North Central Texas Council of Governments, Texas Department of Transportation and the cities of Fort Worth and White Settlement met to discuss potential improvements to redesign North Las Vegas Trail from Loop 820 West to Quebec Drive, to include sidewalks, intersection and traffic signal improvements. In addition, stormwater crossing improvements to address water overtopping at North Las Vegas Trail between Heron Drive and Shoreview Drive were identified. The Texas Department of Transportation (TXDOT) is managing design and construction of this project. TxDOT has requested the cities of Fort Worth and White Settlement assist with the right-of-way (ROW) acquisition needed for the project. This ROW work was not included in the original scope of the project. This Mayor & Council Communication (M&C) will provide additional funding for the City of Fort Worth to complete the ROW acquisition process, including appraisals, offers, and condemnation (if necessary). The action in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. Funding is available for appropriation from available funds within the General Capital Projects Fund for the purpose of funding the Las Vegas Trail project. The Las Vegas Trail project is located in COUNCIL DISTRICT 7. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds within the General Capital Projects Fund and upon adoption of the attached appropriation ordinance, funds will be available in the Genera[ Capital Projects Fund for the Las Vegas Trail project. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility of verifying the availability of funds.
