AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A
16 FOOT WIDE ALLEY, LOCATED IN BLOCK 10, POLYTECHNIC
HEIGHTS ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARR.ANT COUNTY, TEXAS ACCORDING TO THE PLAT RECORDED
IN VOLUME 63, PAGE 109 OF THE DEED RECORDS OF TARRANT
COUNTY, TEXAS, CONTAINING APPROXIMATELY 1,600 SQUARE
FEET OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of a sixteen foot wide alley, Iocated in Block 10, Polytechnic Heights
Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat
thereof recorded in Volume 63, Page 109 of the Plat Records of Tarrant County, Texas, and
containing approximately 1,600 square feet or .0367 acres of Iand, respectively, and as more
specifically described in Exhibits A and B attached hereto and incorporated herein by reference
be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above -described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION S.
That this ordinance shall take effect upon adoption.

Fort Worth, Tarrant County, Texas; said tract being part of a 16-foot wide alley dedicated by the plat of Polytechnic
Heights Addition, an addition to the City of Fort Worth according to the plat recorded in Volume 63, Page 109 of the
Plat Records of Tarrant County, Texas; said tract being more particularly described as follows:
COMMENCING at the intersection of the east right-of-way line of Binkley Street (a 50-foot wide right-of-way) and the
south line of said 16-foot wide alley in Block 10 of said Polytechnic Heights Addition;
THENCE North 89052'42" East, departing the said east line of Binkley Street and along the south line of said 16-foot
wide alley, a distance of 50.00 feet to the POINT OF BEGINNING;
THENCE North 00°24'35" West, departing the said south line of the 16-foot wide alley, a distance of 16.00 feet to a
point for corner in the north line of the 16-foot wide alley;
THENCE North 89°52'42" East, along the said north line of the 16-foot wide alley, a distance of 100.00 feet to a point

SUBJECT
(CD 8) Adopt Ordinance Vacating a Portion of an Alley between Wesleyan Street and Bin kley Street to be Replatted with the Adjoining Property
for a Fieldhouse to Serve the Texas Wesleyan University Campus
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of an alley between Wesleyan Street and Binkley Street to be replatted with the adjoining
property for a fieldhouse to serve the Texas Wesleyan University campus; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
}Gmley-Hom, on behalf of Texas Wesleyan University, has requested vacation of this portion of an alley in Block 10, Polytechnic Heights to be
replatted with the adjoining property for a fieldhouse to serve the Texas Wesleyan University Campus. The City Plan Commission recommended
approval of this request at its meefing on November 3, 2023. An acceptable final plat (FS-23-267) has been received in accordance with the
Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat dedication. The City does not own any fee interest in
the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and
Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alley.
This project is located in COUNCIL DISTRICT 8.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business eritlty.
FISCAL INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
