AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER & SEWER CAPITAL PROJECT 2018 FUND,
BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
COMMUNITY FACILITIES AGREEMENT BUCKET PROGRAMMABLE
PROJECT (CITY PROJECT NO.P00001) IN THE AMOUNT OF $78,769.00 AND
DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
UNSPECIFIED PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME
AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Water &
Sewer Capital Project 2018 Fund, by increasing estimated receipts and appropriations in the Community
Facilities Agreement Bucket programmable project (City Project No.P00001) in the amount of $78,769.00
and decreasing estimated receipts and appropriations in the Unspecified Project (City Project No. UNSPEC)
by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of a Design Procurement Agreement with Ashton Dallas Residential LLC with City participation in the amount up to
$78,769.00 for engineering design for the oversizing of the Cattleman's Crossing lift station and force sanitary sewer main located in north_
Fort Worth; and
2, Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Capital Project 2018
Fund, by increasing estimated receipts and appropriations in the Community Facilities Agreement Bucket programmable project (City
Project No.P00001) in the amount of $78,769.00 and decreasing estimated receipts and appropriations in the Unspecified Project (City
Project No. UNSPEC) by the same amount, for the purpose of funding the Design Procurement Agreement— CFA Cattleman's Cross Lift
Station & Force Main project (City Project No.105377) and to effect a portion of Water's contribution to the Fiscal Years 2024-2028 Capital
Improvements Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is for the City to participate with Ashton Dallas Residential LLC (Developer) in the
engineering design cost for the oversizing of the existing lift station and the current 6-inch force sewer main to be oversized to a 10-inch force
sewer main. The projectwill serve Cattleman's Crossing Phase 1 development located east of United States (U.S.) Business 287 and south of
Avondale Haslet Road. The Developer is needing to expand the capacity to the existing lift station and force sewer main to provide additional
capacity. The City is participating in the project to oversize the expanded lift station and force sewer main to provide additional capacity for future
growth within the basin. The cost for the project is estimated to be allocated at 59.8% for the Developer and 40.2% for the City.
The estimated fee for the City's portion of the engineering design, topographic survey, easement document preparation, construction documents,
and public bidding is $78,768.68.

Ashton Dallas Residential LLC has selected Shield Engineering Group, PLLC., as the engineering consultant to perform the design of the project.
Staff concurs that the fees charged by Shield Engineering Group, PLLC., are fair and reasonable for the work to be performed. The engineering
design will be reviewed through the City's Infrastructure plan review process.
It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY) instead of within the annual budget ordinance,
as projects commence, additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will appropriate funds
in support of the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvements Program, as follows:

BUSINESS EQUITY— A goal is not required under Business Equity Ordinance 25165-10-2021 when City spending participation on Community
Facilities Agreements are less than $1,000,000.00 dollars.
Upon completion of the design, the construction of the project will be publicly bid. Staff will present an M&C to the City Council seeking approval for
the City to enter into a Community Facility Agreement with City participation for the construction of the project.
This project is located in COUNCIL DISTRICT 10.
FISCAL IN RMATION 1 CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified - All Funds project within the W&S Capital Proj 2018 Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S
Capital Proj 2018 Fund for the CFA-Cattleman's Crossing LS&FM project to support the approval of the above recommendations and execution of
the agreement. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
