INTERLOCAL AGREEMENT FOR THE RECONSTRUCTION OF WESTPORT
PARKWAY, KELLER HASLET ROAD, RAY WHITE EXTENSION, AVONDALE
HASLET ROAD, TIMBERLAND BOULEVARD, CAYLOR ROAD NORTH,
CAYLOR ROAD WEST AND OLD DENTON ROAD.
BACKGROUND
This Agreement is between Tarrant County, Texas ("COUNTY") acting by and through
its duly authorized County Commissioners Court, and the City of Fort Worth, Texas ("CITY")
acting through its duly authorized Assistant City Manager.
WHEREAS, the Interlocal Cooperation Act, (Texas Government Code Section 791.001
et seq.) provides legal authority for this Agreement; and
WHEREAS, During the performance of the governmental functions and the payment for
the performance of those governmental functions the parties will make the performance and
payment from current revenues legally available to that party; and
WHEREAS, the Commissioners Court of the COUNTY and the City Council of the
CITY each make the following findings:
a. This Agreement serves the common interest of both parties;
b. This Agreement will benefit the public;
C. The division of costs fairly compensates both parties to this Agreement; and
d. The CITY and COUNTY have authorized their representative to sign this
Agreement.
NOW, THEREFORE, the COUNTY and CITY agree as follows: OFFICIAL RECORD
TERMS AND CONDITIONS CITY SECRETARY
1. PROJECT DESCRIPTION AND SCOPE OF WORK FT. WORTH, TX
1.1 The project is identified as the reconstruction and resurfacing of:
• Westport Parkway: Westport Parkway from pavement change at I-35 East to
Old Denton Road HMAC 1.5 inch level up course and a HMAC 2 inch surface
overlay (approximately 2,664 linear feet).
• Keller Haslet Road: Keller Haslet Road from Old Denton Road to Alta Vista
Road HMAC 1.5 inch level up course and a HMAC 2 inch surface overlay
(approximately 4,853 linear).

• Ray White Extension: New construction of an asphalt road with concrete curb
and gutter from North Beach Street to the Ray White Road dead end at
Crawford Farms (approximately 775 linear feet
• Avondale Haslet Rd: Reconstruction from Willow Creek Drive to 700 feet
east of Sendera Ranch Boulevard (approximately 7,676 linear feet). Turn lanes
at the intersection of Willow Springs (south and north) and Avondale Haslet
Road will be included in the project as shown on the plans.
• Timberland Boulevard: Timberland Boulevard from Caylor Road North to
the west dead end HMAC 2 inch overlay (approximately 1,650 linear feet),
construction of a new section of roadway to tie the existing asphalt section to
and existing concrete section (approximately 100 linear feet).
• Caylor Road North: Reconstruction from Timberland Boulevard to south of
the north Sunset Circle (approximately 1,807 linear feet).
• Caylor Road West: Reconstruction from Caylor Road North to Katy Road
(approximately 4,400 linear feet).
• Old Denton Road: Reconstruction from North Tarrant Parkway to 8828 Old
Denton Road (approximately 1,739 linear feet).
1.2 The CITY hereby agrees that the CITY will pay for any engineering and/or
laboratory testing necessary for this project, and that the COUNTY will not be
responsible for any payment for such services. The CITY must notify the COUNTY
within thirty days of completion of these projects of any complaint the CITY has
with the projects.
1.3 The projects will be completed as time and resources allow. Westport Parkway and
Keller Haslet Road is planned for completion by Spring 2012. Ray White Extension
is planned for Fall 2012, Avondale Haslet Road in 2013, Timberland Boulevard and
Caylor Road North and West in 2014, and Old Denton Road in 2015.
2. COUNTY RESPONSIBILITY
2.1 The COUNTY will furnish the labor and equipment necessary to reconstruct
Westport Parkway, Keller Haslet Road, Ray White Extension, Avondale Haslet
Road, Timberland Boulevard, Caylor Road North, Caylor Road West, and Old
Denton Road as described above.
• Westport Parkway/Keller Haslet Road: Repair any necessary base failures
with full depth asphalt, place a 1.5 inch HMAC binder level up course, followed
with a 2 inch HMAC surface. Backfill the shoulders and clean up the jobsite.
Estimated CITY participation: $233,610.00.
Ray White Extension: Construct a new street by extending Ray White Road
from North Beach Street west to the existing concrete Ray White Road dead end
at Crawford Farms. This will include storm water improvement, curb and gutter,
lime stabilization, place four inches of HMAC binder asphalt and tow inches of
HMAC surface asphalt. Estimated CITY participation: $138,560.00.
• Avondale Haslet Road: Reclaim and remove excess material, stabilize the road
base with a stabilization agent of the CITY's choice re -grad the roadbed, place a
2 inch HMAC binder asphalt and a 2 inch HMAC surface asphalt. Turn lanes
will be added to the project as shown on the plans provide by CITY. Estimated
CITY participation: $245,670.00
Timberland Boulevard: Construct 100 linear feet of a new street with cement
stabilization of the road base, place a 2 inch HMAC binder course and a 2 inch
HMAC surface on the new section. Repair any necessary base failures with full
depth asphalt, place a 2 inch HMAC surface over the entire road section, backfill
the shoulders, and clean up the jobsite. Estimated CITY participation:
$46,525.00.
Caylor Road North: Reclaim and remove excess material, stabilize the road
base with a stabilization agent of the CITY' choice, re -grade the roadbed, place a
2 inch HMAC binder asphalt and a 2 inch HMAC surface asphalt, backfill the
shoulders, and cleanup the jobsite: Estimated CITY participation: $82,100.00
• Caylor Road West: Reclaim and remove excess material, stabilize the road base
with a stabilization agent of the CITY' choice, re -grade the roadbed, place a 2
inch HMAC binder asphalt and a 2 inch HMAC surface asphalt, backfill the
shoulders, and clean up the jobsite: Estimated CITY participation: $200,835.00.
• Old Denton Road: Reclaim and remove excess material, stabilize the road base
with a stabilization agent of the CITY' choice, re -grade the roadbed, place a 2
inch HMAC binder asphalt and a 2 inch HMAC surface asphalt, backfill the
shoulders, and clean up the jobsite: Estimated CITY participation: $152,310.00
2.2 The COUNTY will coordinate the utility line locates before construction begins
by utilizing Dig Tess or a similar service.
2.3 The COUNTY will monitor and coordinate the maintenance of the Storm Water
Pollution Prevention Plan.
2.4 The projects will be completed as time and resources allow. Westport
Parkway/Keller Haslet Road is planned for completion by Spring 2012. Ray
White Extension is planned for Fall 2012, Avondale Haslet Road in 2013,
Timberland Boulevard/Caylor Road in 2014, and Old Denton Road in 2015.
3. CITY RESPONSIBILITIES
3.1 The CITY agrees to pay the total cost of the materials for Westport Parkway,
Keller Haslet Road, Ray White Extension, Avondale Haslet Road, Timberland
Boulevard, Caylor road North, Caylor Road West, and Old Denton Road
reconstruction at an estimated cost not to exceed $1,134,610.00
3.2 The CITY will furnish necessary traffic controls during the construction phase of
the projects at an estimated cost not to exceed $25,000.00.
3.3 If a Storm Water Pollution Prevention Plan is required, the CITY will pay for all
cost (including subcontractor materials, labor and equipment) associated with the
implementation of the Plan at an estimated cost not to exceed $10,000.00.
3.4 If required the CITY will furnish all right of way plans, engineering drawings,
and specifications
3.5 The CITY will coordinate, negotiate and pay for applicable utility relocation
costs.
4. PROCEDURES DURING PROJECT
If the CITY has a complaint regarding the construction of the project, the CITY must
inform the County in writing within 30 days of project completion. The County is
responsible for the maintenance of the project within the first 30 days after completion of
the project. Upon expiration of 30 days after the project completion, the CITY becomes
responsible for the maintenance of the project.
5. NO WAIVER OF IMMUNITY
This Agreement does not waive COUNTY rights under a legal theory of sovereign
immunity. This Agreement does not waive CITY rights under a legal theory of sovereign
immunity.
6. OPTIONAL SERVICES
6.1 The COUNTY will furnish flag persons, if necessary.
7. TIME PERIOD FOR COMPLETION
CITY will give the COUNTY notice to proceed at the appropriate time. However,
COUNTY is under no duty to commence construction at any particular time.
8. NO THIRD PARTY
The parties do not enter into this Agreement to protect any specific third party. The
intent of this Agreement excludes the idea of a suit by anyone claiming third party
beneficiary rights. The parties to this Agreement do not consent to the waiver of
sovereign immunity under Texas law to the extent any party may have immunity under
Texas law.
9. JOINT VENTURE & AGENCY
The relationship between the parties to the Agreement does not create a partnership or
joint venture between the parties. This Agreement does not appoint any party as agent
for the other party.
10. TERMINATION OF AGREEMENT
This Agreement shall automatically terminate upon completion of the project or one (1)
year from the date of this agreement, whichever is first. This Agreement may be renewed
prior to its expiration upon the mutual consent of the parties.
This Agreement is effective upon the date written by the last party to sign.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of an Interlocal Agreement with Tarrant
County for reconstruction of Westport Parkway, Keller Haslet Road, Ray White Extension, Avondale
Haslet Road, Timberland Boulevard, Caylor Road North, Caylor Road West and Old Denton Road with
City of Fort Worth participation in the amount of $1,134,610.00 which includes furnishing all necessary
materials, traffic control and other incidentals.
DISCUSSION:
In Fiscal Year 2011-2012 Contract Major Maintenance Program, various types of street maintenance
techniques are grouped into specific contract types, including interlocal Agreements with other
governmental entities.
At the request of Staff, Tarrant County has agreed to enter into an Interlocal Agreement for the
reconstruction of Westport Parkway from east of the bridge at IH-35 to Old Denton Road, Keller Haslet
Road from Old Denton Road to Alta Vista, Ray White Extension from North Beach Street to the Ray White
Road dead end at Crawford Farms, Avondale Haslet Road from Willow Creek Drive to 700 feet east of
Sendera Ranch Boulevard, Timberland Boulevard from Caylor Road North to the west dead end, Caylor
Road North from Timberland Boulevard to south of the north Sunset Circle, Caylor Road West from Caylor
Road North to Katy Road and Old Denton Road from North Tarrant Parkway to 8828 Old Denton Road.
These projects will be funded from the Contract Street Maintenance Fund.
The reconstruction of the roads will occur over three years starting in 2012 and ending in 2015. The cost
for Fiscal Year 2012 of $380,920.00 was included in the current year adopted budget. The cost for Fiscal
Year 2013 through Fiscal Year 2015 will be included in each respective year's proposed budget.
Under the Agreement, Tarrant County will provide all necessary labor and equipment to perform this work
and the City of Fort Worth (City) agrees to pay for the cost of materials, traffic controls and other
incidentals. Additionally, the City agrees to closing of the road to through traffic for the duration of the
project or as deemed necessary by Tarrant County.
This project is located in COUNCIL DISTRICT 2.
