HomeMy WebLinkAboutContract 58204-A1Date Received: 4/11/2024 Record Number: PN23-00183 Time Received: 4:49 p.m. City Secretary No.: 58204-A1 FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 58204, EASEMENT ENCROACHMENT LICENSE AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 58204, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or Development Services Department Director, and Ironwood Crossing Public Facility Corporation, a Texas public facility corporation ("Licensee"), acting herein by and through its duly authorized Secretary/Treasurer. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No.58204 on October 10''', 2022 (the "Agreement"), to authorize the use of the City's easement for the purpose of constructing, installing and maintaining a series of twenty-three (23) roof eaves, as part of the residential development on the property; and WHEREAS, the parties wish to amend the Agreement to include a monument sign and way finding signs; and WHEREAS, the City owns a water and sewer main easement and has an interest in a public utility easement (the "Public Property"); and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise "Exhibit C" in the Agreement to depict the included encroachment area. NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: Revised 12/2022 OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX 1. "Exhibit C" in the Agreement is hereby amended to include the attached revised description of the encroachment area, labeled as "Additional Encroachments, Exhibit A." 2. The effective date of this Amendment shall be the date of its execution by the City. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
