Ordinance No. 26708-02 ' 024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRANSPORTATION IMPACT FEE CAPITAL FUND IN THE AMOUNT OF $2,000,000.00, FROM AVAILABLE FUNDS WITHIN THE REVENUE — SA C-TRANSP IMP FEES PROJECT (CITY PROJECT NO. UN9913) AND THE AMOUNT OF $2,000,000.00 FROM AVAILABLE FUNDS WITHIN THE REVENUE - SA E-TRANSP IMP FEES PROJECT (CITY PROJECT NO. UN9915), FOR THE PURPOSE OF FUNDING THE WAGLEY ROBERTSON ROAD PROJECT (CITY PROJECT NO. 104154); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the amount of $2,000,000.00, from available funds within the Revenue — SA C-Transp Imp Fees project (City Project No. UN9913) and the amount of $2,000,000.00 from available funds within the Revenue - SA E-Transp Imp Fees project (City Project No. UN9915), for the purpose of funding Wagley Robertson Road project (City Project No. 104154). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Cap Fund in the amount of $2,000,000.00 from available funds within the Revenue - SA C-Transp Imp Fees project (City Project No. UN9913) and the amount of $2,000,000.00 from available funds within the Revenue - SA E-Transp Imp Fees project (City Project No. UN9915) for the purpose of funding the Wagley Robertson Road project (City Project No. 104154); 2. Adopt the attached appropriation ordinance adjusting estimated appropriations in the 2014 Bond Program Fund in the amount of $2,000,000.00 by increasing estimated appropriations in the 34014 Appropriation Only project (City Project No. U34014) and decreasing estimated appropriations in the Wagley Robertson Road project (City Project No. 104154) by the same amount; and 3. Amend the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate eligible Transportation Impact Fee funds to supplement existing funding for the Wagley Robertson Road project which was included in the 2022 Bond Program. Due to current market conditions, supply chain issues, and higher inflation rates than usual, additional funds are needed to cover estimated budget shortfalls. Staff proposes using the $4,000,000.00 of eligible Transportation Impact Fee funding to augment the design -build activities, including design, Right -of -Way (ROW) acquisition and construction, for the Wagley Robertson Road Design -Build project. The project is considered a high priority capacity improvement project to the infrastructure of the City of Fort Worth as a result of growth. 2014 Bond Program funding existing in the project will be reduced by $2,000,000.00 in order to fund other city projects. The net increase to the project budget will be $2,000,000.00. The actions in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. nt This project is located in COUNCIL DISTRICTS 7 and 10. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the Revenue - SA C - Transp Imp Fees and Revenue - SA E - Transp Imp Fees projects within the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the Transportation Impact Fee Cap Fund for the Wagley Robertson project.
