AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A
FIFTY -FOOT WIDE RIGHT OF WAY KNOWN AS NE 32ND STREET,
SITUATED IN THE CREST ADDITION, AN ADDITION TO THE CITY
OF FORT WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE
PLAT THEREOF, RECORDED IN VOLUME 388-58, PAGE 342, OF THE
PLAT RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 0.162 ACRES OF LAND AND 0.150 ACRES OF LAND,
RESPECTIVELY, FOR A COMBINED TOTAL OF APPROXIMATELY
.312 ACRES OF LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That a portion of NE 32nd Street, a fifty -foot wide public right of way, situated in the
Crest Addition, an addition to the City of Fort Worth, Tarrant County, Texas, according to the
plat thereof, recorded in Volume 388-58, Page 342 of the Plat Records of Tarrant County, Texas,
and containing approximately .162 acres of land and .150 acres of land, respectively, for a
combined total of approximately .312 acres of land, and as more specifically described in
Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easements to the land in the above -described vacated street right of way are
hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

The following Bearings. Distances. and/or Areas derived from GNSS observations performed by
Texas Surveying, Inc. and reflect N.A.D.1983, Texas State Plane Coordinate System, North Central
Zone 4202 (GRID).
BEGINNING at a found 112" iron pipe being the southwest corner of Lot 8, Block 2, Dixie Wagon
Manufacturing Company Addition, according to the plat as recorded in Volume 63, Page 27, Plat
Records, Tarrant County, Texas, in the north line of said NE 32nd Street, for the northwest and
beginning corner of this tract.
THENCE N 89'37'10" E 146.11 feet, to a point being the southeast corner of said Lot 8, Block 2, for the
northeast corner of said NE 32nd Street and this tract.
THENCE S 00022'53" E 27.86 feet, to a point in the northwest line of the L.A. & T. Railroad Company
right-of-way, for a corner of NE 32nd Street and this tract.
THENCE southwesterly with said L.A. & T. Railroad Company right-of-way and along the arc of a
curve to the left, having a radius of 1469.00 feet, an arc length of 30.50 feet, and whose chord bears
S 43'04'09" W 30.50 feet, to a point, being the northeast corner of said Lot 1, Block I, Crest Addition,
for the southeast corner of said NE 32nd Street and this tract.
THENCE S 89°37'08" W 125.13 feet, with the north line of said Lot 1, Block 1, and the south line of said
NE 32nd Street, to a point for the southwest corner of this tract.
THENCE N 00°23'14' W 50.00 feet, to the POINT OF BEGINNING.

(CD 2) Adopt Ordinance Vacating a Portion of NE 32nd Street to be Replatted with the Adjoining Property to Avoid Encroachment of Existing
Commercial Development Adjacent to and Within the Right -of -Way to be Vacated
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of NE 32nd Street to be replatted with the adjoining property to avoid encroachment of existing
commercial development adjacent to and within the right-of-way to be vacated; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Texas Surveying, on behalf of Omar Diaz, has requested vacation of this portion of NE 32nd Street to be replatted with the adjoining property to
remove the encroachment of portions of the applicant's existing commercial business within the public right-of-way. The City Plan Commission
recommended approval of this request at its meeting on March 8, 2023. An acceptable final plat (FS-23-302) has been received in accordance
with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat dedication. The City does not own any fee interest in
the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and
Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street.
This project is located in COUNCIL DISTRICT 2.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that approval of these recommendations will have no material effect on City fiends.
