HomeMy WebLinkAboutOrdinance 26815-04-2024Ordinance No. 26815-04-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2022 BOND PROGRAM FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMERICAN RESCUE PLAN ACT PEDESTRIAN SAFETY IMPROVEMENTS PROJECT (CITY PROJECT NO. 104299) IN THE AMOUNT OF $1,000,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE VISION ZERO (ROAD SAFETY) PROGRAMMABLE PROJECT (CITY PROJECT NO. PB0022) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the 2022 Bond Program Fund, by increasing estimated receipts and appropriations in the American Rescue Plan Act Pedestrian Safety Improvements project (City Project No.104299) in the amount of $1,000,000.00 and decreasing estimated receipts and appropriations in the Vision Zero (Road Safety) programmable project (City Project No. P130022) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing appropriations in the American Rescue Plan Act Pedestrian Safety Improvements Project (City Project No. 104299) in the amount of $1,000,000.00 and by decreasing appropriations in the Vision Zero (Road Safety) programmable project (City Project No. PB0022) by the same amount; and 2. Amend the Fiscal Years 2024-2028 Capital Improvement Program. -DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate additional City funding for the American Rescue Plan Act Pedestrian Safety Improvements Project (City Project No. 104299). This project is part of the American Rescue Plan Act (ARPA) Subtitle M State and Local Fiscal Recovery Funds (SLFRF), of which $16,000,000,00 was allocated for use on City of Fort Worth Transportation and Public Works Projects classified as Majority Minority Area Infrastructure Improvements Projects -- Streetlights and Pedestrian Safety. The initial funding for this project was authorized on September 27, 2022 in the amount of $4,000,000.00 (M&C 22-0789). Additional funding in the amount of $1,900,000.00 was authorized on August 8, 2023 (M&C 23-0368). The scope of this project includes design and construction of intersection and pedestrian improvements along Long Avenue, from Azle Avenue to Angle Avenue, as originally recommended in the City of Fort Worth High Injury Network Corridor Evaluation Report prepared by Kimley-Hom in March of 2022. Those improvements include new traffic and pedestrian signals, accessible curb ramps, median modifications, left turn lanes and some new pavement markings. The additional funding requested in this M&C will allow for design and construction of additional improvements identified during the design process as desirable including two additional traffic signal poles at Azle Avenue, additional restriping of the entire corridor with new pavement markings, additional sidewalk on school property at Dolores Huerta Elementary, a longer turn lane at the McKinley Street intersection, and closure of the median opening at 33rd Street. The additional funding is also requested to pay for inflationary construction cost increases that have occurred over the last two years since the original budgetary estimate was created for the project. Funding for this project was not included in the Fiscal Years 2024-2028 Capital Improvement Program (CIP) because the additional scope and funding needs were not identified at the time of CIP development. The actions in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. This project is located in COUNCIL DISTRICT 2. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CE13TIFICATION: The Director of Finance certifies that funds are currently available in the Vision Zero (Road Safety) project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the 2022 Bond Program Fund for the ARPA Pedestrian Safety Improvements project to support the approval of the above recommendations. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility of verifying the availability of funds.
