HomeMy WebLinkAboutIR 6982 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 6982 +,,p TFRFO October 30, 1984 DoE 40RT10 To the Mayor and Members of the City Council u � s YTEXA`0f Subject: REPORT ON HISTORICAL PROPERTY DESIGNATIONS a» On October 9, 1984, representatives of the Junior League and the Women's Club came before the City Council requesting that the City designate properties owned by these organizations as historical landmarks and grant them a tax exemption under Section 11.24 of the State Property Tax Code which provides that a structure designated as a Recorded Historical Landmark by the Texas Historical Commission and by the governing body of the taxing unit can be granted exemption from all or part of the assessed ad valorem tax. The Council directed City staff to investigate the implications of granting such a designation to these organizations. Background During its 1984 appraisal process which placed all properties on the rolls at 100 percent of their market value, the Tarrant Appraisal District determined that the properties owned by the Junior League and the Women's Club should not be exempted from taxation under Section 11.18 of the Property Tax Code as they had previously because these organizations are not exclusively organized to perform charitable functions. Because of the ruling, the Junior League and the Women's Club requested that the City Council designate specific properties they own as historical landmarks and grant them a tax exemption. The properties owned by the Junior League and the Women's Club are Recorded Historical Landmarks. Fiscal Impact There are eighty-six properties in Fort Worth designated as Recorded Historic Landmarks by the Texas Historical Commission. Of these eighty-six historical properties, forty-eight are single-family residen- tial, and the remaining thirty-eight are used for commercial, govern- mental or charitable/non-profit purposes. Ten currently are exempt from ad valorem taxation under provisions of the State Property Tax Code. The total taxable value of the remaining seventy-six non-exempt pro- perties is in excess of $47,315,783.05. The tax revenue generated from these properties amounts to $320,091 (see attachments). The City Council has not granted a tax exemption based on a historical designa- tion to any property in Fort Worth. Historic Preservation Council Survey The Historic Preservation Council currently is conducting a survey to identify buildings, objects and places ..in the community of historic significance. After these components have been identified, it will be recommended that the structures that qualify for the Recorded Historical Landmark designation be designated as such. Phases I, II and III have already identified an estimated 500 structures which are of historical value. By spring of 1985, Phase IV of the survey will be complete. As a result of this survey, it is anticipated that a great number of these properties will be designated by the Texas Historical Commission as Recorded Historical Landmarks. Conclusion In view of the amount of revenue loss - both current and potential - by granting exemptions to current taxable Recorded Historic Landmark properties and the possible designations that may occur as a result of the on-going survey, granting requests for local historic designations for exemption purposes at this time would conflict with budgetary goals. A broader issue to be considered is whether the City should become involved in determining the merit of exemptions on individual pieces of property or whether it is more appropriate to rely on the categories of exemptions provided under State law.
