Ordinance No. ~1p ~~~.'~ ®4 ~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS ANC} APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $12,395,515, SUBJECT TO RECEIPT OF THE CONSOLIDATED PLAN GRANT FROM THE U.B. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR THE PURPOSE OF FUNDING THE CITY'S CON50LIDATED PLAN; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $12,395,515, subject to receipt of the Consalida#ed Plan grant from the U.S. Department of Housing and Urban Development, for the purpose of funding the City`s Consolidated Plan. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and eftect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. APPROVE TO FORM AND LEGALITY: Assistant Cit Attorney ADOPTED AND EFFECTIVE: ~~~a5 pity ®f Ft~rt VI/®rtf~, T"e~ras Mayor and Council Communication SUBJECT: Approve Execution of the 2005-20'10 Consolidated Plan Grant Application (CDBG, ESG, HOME, ADDI and HOPWA GRANTS) for Submission to the U.S. Department of Noosing and Urban Development; Authorize the Use of Funds from the CDBG and HOME Interest Earned and Revolving Loan Funds; and Adopt the Attached Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Approve the City's Consolidated Plan Grant Application for submission to the U.S. Department of Housing and Urban Development; 2. Authorize the use of $676,000 in estimated program income from the CDBG & HOME interest earned and Revolving Loan Funds; and 3. Adopt the attached apprapriatinn ordinance increasing the estimated receipts and appropriations in the Grants Fund in the amount of $12,395,515 ($7,515,650 for Community Development Block Grant Program funds, $676,000 in estimated program income, $288,942 in Emergency Shelter Grant Program funds, $2,982,337 in HOME Investment Partnerships Program funds, $127,586 in American Dream Down Payment Initiative Program funds and $805,000 in Housing Opportunities for Persons with AIDS funds), subject to receipt of the grant; and 4. Apply indirect cost rates, as applicable, for the grant fund in accordance with the City's Administrative Regulation. ©15CUSSI®N: In 1994, the U.S. Department of Housing and Urban Development (HUD) put forth a new policy regarding housing and community development activities carried out by local jurisdictions, which requires jurisdictions to submit a Consolidated Plan (CP). The CP is a document which combines the application and planning processes far the four major HUD funding sources: Community Development Black Grant (CDBG), Emergency Shelter Grant (ESG), HOME Investment Partnerships Prngram (HOME), American Dream Down Payment Initiative (ADDI) and Housing Opportunities for Persons with AIDS (HOPWA). The CP includes a Citizen Participation Plan, Five-Year Strategic Plan and an Action Plan detailing the first year's projected use of funds. Working cooperatively with non-profit organizations, school districts and the private sector, City staff was able to produce a Consolidated Plan which was both broad in scope and comprehensive with respect to the inciusinn of activities and funding sources outside the four grants listed above. The funding figures below reflect the City's allocations and are based on HUD's FY 2005 formula allocations for the Community Planning and Development Programs. At least fifty-one percent {51 %) of these funds will benefit !ow and moderate-income citizens in the City of Fort Worth.
