EMMETT DRADDY AND JUDY DRADDY * CANCELLATION OF
;r�XA`'. Subject: LAKE WORTH LEASE (M&C L-8385)
Emmett V. Draddy and Judy C. Draddy purchased the improvements located on
Lot 19, Block 19, Lake Worth Lease Survey, as well as the leasehold interest,
on February 5, 1974.
The Real Property Division file on this property is quite lengthy and re-
flects a number of continuing complaints from the Draddy's neighbors. The
file correspondence on the situation goes back to 1974, and the file's final
entry ends with pictures taken on February 26, 1985, along with Elmer
Butler's comments.
Examples of complaints and violations of various City ordinances involving
the Draddy property are numerous. While the violations vary widely in
severity, the file does reflect non-payment of lease payments, taxes and
garbage fees, all of which constitute breaches of the provisions of the lease
between the Draddys and the City of Fort Worth.
On March 28, 1979, notice was given of cancellation of the lease for arrear--
•age of tax, lease and garbage accounts. Again on April 30, 1979, the Draddy's
were notified that action would be taken to cancel their lease because of the
arrearages which still existed. Further, in November 1983 notice was given
that the lease would be cancelled if arrearages continued in lease and tax
accounts. Another letter from the Real property Division in December 1984
notified the Draddys of imminent cancellation of their lease if a large
number of apparently inoperative cars were not removed from the premises and
if a boat dock was not repaired or removed. In August 1984 a letter to
Mr. Draddy from Mr. Raymond Vera of Environmental Control also informed the
Draddys of a number of violations on the property, including junked vehicles
and discarded parts of vehicles. A letter in February 1985 from Elmer Butler,
Real Property Division, notified Draddy that cancellation of his lease was
being placed on the City Council agenda. All of this documentation is in the
attached package.
Mr. Butler called Mr. Draddy on the morning of February 26, at approximately
8:30 a.m., and notified him that the cancellation of his lease was on the
Council agenda for that day.
For your information, you will also find attached the current lease agreement
which reflects the conditions under which the 'City may cancel a Lake Worth
Lease without reimbursing a lessee for improvements.
