AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND, SUBJECT TO
RECEIPT OF THE FUNDS, IN THE AMOUNT UP TO $650,000.00, FOR THE
PURPOSE OF PAYMENTS TO THE POLICE DEPARTMENT FROM THE STATE
OF TEXAS LAW ENFORCEMENT OFFICER STANDARDS AND EDUCATION
ACCOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
Operating Other Fund, subject to the receipt of funds, in the amount up to $650,000.00, for the purpose of
payments to the Police Department from the State of Texas Law Enforcement Officer Standards and
Education Account.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

(ALL) Adopt Appropriation Ordinance Increasing Estimated Receipts and Appropriations in the Grants Operating Other Fund in the Amount Up
to $650,000.00 for Payments to the Police Department from the State of Texas Law Enforcement Officer Standards and Education Account
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Operating Other Fund in the amount up to $650,000.00, subject to the receipt of funds, for payments to the Police Department from the
State of Texas Law Enforcement Officer Standards and Education account.
ALSCUSSION:
The Law Enforcement Officer Standards and Education Fund (LEOSE) is an account in the State Treasury funded through court costs collected in
criminal.cases. The Comptroller of Public Accounts is directed, under the Texas Occupations Code, Section 1701.157, to make allocations from
the LEOSE account to qualified law enforcement agencies. Under the Texas Occupations Code, 20% of the appropriated amount is distributed to
all participating agencies in equal shares, and 80% is distributed based on the number of qualifying officers at each entity. Participating agencies
must use the funds to provide continuing education for law enforcement officers and supporting personnel in the agency.
This Mayor & Council Communication (M&C) will increase the Grants Operating Other Fund by $650,000.00 in allocations and an anticipated
$650,000.00 in offsetting revenues for expenses and revenues related to LEOSE payments. The estimated increase in allocations in LEOSE
projects is $650,000.00 (approximately $130,000.00 per year for 5 years) for the Police Department. The Police Department's previous years'
respective allocations have averaged approximately $130,000.00 annually. The respective Department will be responsible for the oversight and
management of the funds received. The payments are received in advance of any related expenditures. If the funds are not fully spent during the
allotment years, remaining funds will roli-over into future allotments.
The LEOSE allocation serves ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will
be available in the current operating budget, as appropriated, in the Grants Operating Other Fund. The Police Department (and Financial
Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Police
Department has the responsibility to validate the availability of funds. This is an advance grant.
