AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE DRAINAGE REVENUE BONDS SERIES 2023 FUND,
BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
THOMAS PLACE AT CALMONT STORM DRAIN REHABILITATION PROJECT
(CITY PROJECT NO. 103057) IN THE AMOUNT OF S350,000A0 AND
DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
STORMDRAIN PIPE REHABILITATION PROGRAMMABLE PROJECT (CITY
PROJECT NO. P00114) BY THE SAME AMOUNT; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Drainage
Revenue Bonds Series 2023 Fund, by increasing estimated receipts and appropriations in the Thomas Place
at Calmont Storm Drain Rehabilitation project (City Project No. 103057) in the amount of $350,000.00 and
decreasing estimated receipts and appropriations in the Stormdrain Pipe Rehabilitation programmable project
(City Project No. P00114) by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Drain Rehabilitation Project, Adopt Appropriation Ordinances in the Cumulative Amount of $950,000.00 and Amend the Fiscal Years 2024-2028

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a contract with Woody Contractors, Inc., in the amount of $2,179,010.00 for Thomas Place at Calmont Storm Drain
Rehabilitation project (City Project No. 103057);
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund by
increasing estimated receipts and appropriations in the Thomas Place at Calmont Storm Drain Rehabilitation project (City Project No.
103057) in the amount of $600,000.00 and decreasing estimated receipts and appropriations in the Drainage Improvements programmable
project (City Project No. P00043) by the same amount;
3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Drainage Revenue Bonds Series 2023
Fund by increasing estimated receipts and appropriations in Thomas Place at Calmont Storm Drain Rehabilitation project (City Project No.
103057) in the amount of $350,000.00 and decreasing estimated receipts and appropriations in Stormdrain Pipe Rehabilitation
Programmable project (City Project No. P00114) by the same amount; and
4. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
D SC�L_ USSION:
Approval of this Mayor and Council Communication (M&C) will authorize execution of a construction contract with Woody Contractors, Inc. in the
amount of $2,179,010.00 for the rehabilitation of a storm drain pipe between Thomas Place and Tremont Avenue from Pershing Avenue to
Calmont Avenue. The project is a part of the Stormwater Program's Storm Drain Rehabilitation Program which assesses the condition of existing
drainage pipe systems to identify and prioritize pipes for rehabilitation before potential collapse and/or sinkholes form.
This project will install new pipe in City right-of-way along Pershing Avenue from Tremont Avenue to Thomas Place and along Thomas Place from
Pershing Avenue to Calmont Avenue and abandon the existing pipe, which has significant cracking and defects and is currently located outside of
City right-of-way or easements and is close to several homes. Once the new storm drain pipe is active, the old storm drain pipe will be filled with
grout and abandoned.
The project was advertised for bid in the Fort Worth Star -Telegram on October 19, 2023 and October 26, 2023. On November 16, 2023 the
following bids were received:

* Contractor's bid has been deemed non -responsive.
Construction is expected to start in May 2024 and be completed by November2024.
Funding for design and construction for the Thomas Place at Calmont Storm Drain Rehabilitation project in the amount of $2,093,000.00 was
provided by the 2020 Stormwater Revenue Bond fund. Additional funding in the amount of $600,000.00 from the Stormwater Capital Projects
fund and $350,000.00 from the Drainage Revenue Bonds Series 2023 fund is needed to fully fund the project through construction. This action in
this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023.

In addition to the contract amount, $258,000.00 is required for project management, material testing and inspection, and $109,000.00 is provided
for project contingencies.
Funding is budgeted in the Drainage Improvement Projects & Stormdrain Pipe Rehab programmable projects within the Stormwater Capital
Projects & Drainage Rev Bonds Series 2023 Funds for the purpose of funding the Thomas Place at Calmont SDR project.
DVIN OFFICE — Woody Construction, Inc. is in compliance with the City's Business Equity Ordinance by committing to 15% MWBE participation
on this project. The City's MWBE goal on this project is 10%.
This project is located in COUNCIL DISTRICT 7.
FISCAL INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Drainage Improvement Projects programmable project within
the Stormwater Capital Projects Fund and in the Stormdrain Pipe Rehab programmable project within the Drainage Rev Bonds Series 2023 Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the
Stormwater Capital Projects, Drainage Revenue Bond Series 2023 and Stormwater Rev Bonds 2020 Funds for the Thomas Place at Calmont
SDR project to support the above recommendations and execution of the contract. Priorto any expenditure being incurred, the Transportation &
Public Works Department has the responsibility of verifying the availability of funds.
