Schultz, Inc. dba Circle C Construction Co, for emergency services to repair the sanitary sewer main south of Rosedale Street. The change order will provide additional funding for increased work scope as described in the attached supplement memorandum ated April 28, 2024. It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full (both time and money) for all costs arising out of, or incidental to, the above Change Order. On January 28, 2024 Water Field Operations became aware of a sanitary sewer overflow that Wass discharging 200 gpm into Lake Arlington. Upon further investigation a break was discovered on the City's 54-inch sewer main (M-503) south of Rosedale Street which caused up -stream sewer backup, resulting in overflow at the discharge point in the vicinity of the 3000 block of Quail Street. The segment of the pipe crossing Rosedale Street was also discovered to be deteriorated and blocked with debris further exacerbating the situation. Water Department Field Operation crews are not equipped to handle an emergency of this nature. Under the February 01, 2024 Emergency Authorization (copy attached), the Water Department engaged William J Schultz, Inc. d/b/a Circle C Construction Company ("Circle C") to conduct the necessary work to replace the sewer main. The emergency work was estimated to be $2,000,000,00, The original plan provided for the existing sewer tunnel to be rehabilitated and put back into service. However, it was determined that the tunnel is to severely deteriorated to be rehabilitated and must be abandoned and removed from service. It is therefore necessary to install a new tunnel across Rosedale Street which necessitates a tunnel liner plate, additional 54-inch sewer pipe, 6-ft diameter manholes and additional by-pass pumping. This memorandum provides additional construction costs in the amount of $2,982,215.21 for the additional work to be performed on the emergency. A confirming M&C will be circulated to ratify the contract after the work has been performed. With the supplement the revised contract amount is $4,982,215.21. This memo is submitted to inform the CMO that, pursuant to the emergency authority found in City Code Chapter 2, Article I, Section 2-9 of the City's Code of Ordinances, the Water Department will be engaging William J Schultz, Inc. d/b/a Circle C Construction Company to conduct necessary by-pass pumping to allow for the replacement of the broken pipe segment (s). This contract will be in an amount up to $2,000,000 and work will be billed against it on a task order basis. Waiting to bid and award a contract to perform this work is not the best interest of the health and safety of the City of Fort Worth. In addition to the citations, above, Section 252.022 of the Local Government Code exempts from normal bidding requirements expenditures that are necessary to preserve or protect public health or safety of the municipality's residents and procurements necessary because of unforeseen damage to public machinery, equipment, or property. A confirming M&C will be circulated to ratify the contract after the work has been performed.
