HomeMy WebLinkAboutIR 7036 14ORMAL REPORT TO CITY COUNCIL MEMBERS No. 7036 'V T(RbG ca T To the Mayor and Members of the City Council July 16, 1985 op", X Subject: SCREENING BULK CONTAINERS AT APARTMENT COMPLEXES At the request of City Council , the City Services Department researched the conditions associated with bulk containers used as refuse bins in apartment complexes throughout the City of Fort Worth. The Departments of Law and Development were consulted in this evaluation and provided essential information. The City obtains its authority to specify screening requirements for refuse containers such as these from the Comprehensive Zoning Ordinance. Section 16A(D) (3) (e) of Ordinance No. 8663 states, in part: 'Dumpsters shall be visually screened except from the access side and shall not be placed within the required open space. Access shall not face upon adjacent properties' The Ordinance is effective and covers all private and commercial garbage dumpsters located at apartment complexes constructed as of November 1, 1982. Containers situated at other types of development are not subject to the provisions of this Ordinance and the Ordinance is not retroactive beyond the November 1, 1982 inception date. A review of permits issued by the Development Department and a wi-ndshield survey by Environmental Control Inspectors reveal the following: 0101 permits issued since 11/01182 for apartment construction 091 construction projects completed 010 construction projects incomplete 022 complexes with containers fully screened 09 complexes with containers partially screened 060 complexes with containers not screened The Enviromental Control Division is responsible for enforcement of this Ordinance and is prepared to begin notifying appropriate apartment owners of the Ordinance. Due to the nature of the construction involved and the potential cost associated with this type project, it is recommended by staff that a reasonable extension of time be allowed the owners to complete their screening. Staff recommends a minimum of six months; however, in instances where more creative methods of screening such as plants are used, it is anticipated that additional time may be granted on a case by case basis.
