Home My WebLink AboutContract 60021-A1CSCO No. 60021-Al TRANSPORTATION IMPACT FEE CREDIT AGREEMENT AMENDMENT AMENDMENT NO.1 TO CITY SECRETARY CONTRACT NO.60021 WHEREAS, the City of Fort Worth ("City") and a Texas home rule municipal corporation, and Bloomfield Homes, LP, a Texas corporation authorizes to do business in Texas ("Owner") made and entered into a Transportation Impact Fee Credit Agreement, City Secretary Contract No. 60021 (the "Agreement"); and WHEREAS, the Owner has dedicated 62,120 square feet of right-of-way for Cleburne Crowley Road with FP-21-091, recorded as Instrument D222238061, 09/29/2022; and WHEREAS, the Owner has received approval for construction plan IPRC20-0162 And executed Community Facilities Agreement CFA21-0040, and obtained final acceptance by the City of Cleburne Crowley Road, City Project Number 103141, on May 18, 2021; and WHEREAS, it has become necessary to execute this Amendment No. 1 to said Agreement to incorporate additional credits by amending Exhibit 'B" with the Exhibit 'B-1", and to replace Exhibit "C" with the Exhibit "C-1", Exhibit 'D" with the Exhibit 'D-1", Exhibit "E" with Exhibit 'E-1" Exhibit "F" with the Exhibit "7-1'; NOW, THEREFORE, for and in consideration of the mutual agreements, covenants, and conditions contained herein, and other good and valuable consideration, the City and the Owner hereby covenant and agree as follows: 1. Recitals. The recitals contained in this Agreement are true and correct as of the Effective Date and form the basis upon which the Parties negotiated and entered into this Agreement. 2. Exhibits "B", "C", "D", "E", and "F" to the Agreement shall be replaced with Exhibits 64B-166, 64C-1", D-1", "E-1", and F-1" respectively, attached hereto and incorporated herein by this reference. 3.
