Z-85-210 The City Council at their scheduled zoning hearing On October 15, 1985, con- tiOUed Case Number Z-89-216 (exhibit map attached) for further information. The Department Of Development determined that the building on the site is a non-conforming building. It existed prior to the '/A" Single-family zoning being placed upon the property. Subsequently, various actions have taken place and are listed as follows: l . April I9» 1977, d building permit was issued to remodel the exterior and interior. No additions were made. 2. January 9, 1980, a tank permit was -issued for replacement of two 10,000 gallon gasoline tanks for an existing Service station. 3. On April 8, 1981, the Zoning Board of Adjustment heard Case Number B/A-8I-073 for a walk-in cooler addition and enclosure. The cooler's dimensions are 12^ % 24/ and the enclosure's dimensions are 18/ x 30/ ° � On U�10b�r 7 ]9�} a permit was issued for the construction approved. * ° by the Zoning Board of Adjustment. 5. On September 27* I983, and after two notices to complete construc- tion, a renewal permit was issued. 6. On June 5, 1984m after notice, a second renewal permit was issued. 7. On April 29, 1985, a third renewal permit was issued. 8. After this permit, the building inspector found a structural system being installed that exceeded those dimensions approved by the Zoning Board of Adjustment and notice was given .to stop construction. 9. Subsequently, an application was made t0 the Zoning Commission to change the zoning from »Ax One-Family to wE« Commercial . On Septem- ber lI, 1985, the Zoning Commission on a 6~3 vote denied the request for zoning and so recommended to the City Council . The property is located at the juncture of Boat Club Road and contains non- conforming retail uses. Construction on the rear of the property has been halted pending the hearing before the City Council . The construction is steel post and steel bur Joist construction without enclosing walls or roof on more than one-half of the structure. The outer dimensions Of the con- struction Of 66' x b" x SD/ . The roof installed over a part of the structure is 57" x 22' and exceeds the 30/ x 13' approved bv the Zoning Board of Adjus- tment. - - tment. Z-85-216 Should the City Council not approve this rezoning request, notice will be given to the owner of the property to remove that portion of the structure necessary to comply with the Zoning Board of Adjustment ruling.
