Subject: EAST ROSEDALE STREET FROM IH-35W TO US 287

On June 22, 1999 (M&C G-12580), the City Council authorized the City Manager to enter into the
necessary agreements with the Texas Department of Transportation (TxDOT) to begin right of way
acquisition for the future construction of East Rosedale Street from IH-35W to US287. At the Pre-
Council hearing on June 22nd, the City Council asked staff to follow up on three items and report back
to the Mayor and City Council:
1) Is the size of the East Rosedale Street section the same as the West Rosedale Street section?
The typical section for East Rosedale Street (IH-35W to US287) is the same section that is being
designed for West Rosedale Street (Forest Park Boulevard to IH-35W). The typical section is a 6-
lane divided boulevard within a 120-foot right of way. The median is approximately 28-feet wide
with continuous sidewalks (4-foot wide) located on both sides of Rosedale Street. The 4-foot wide
sidewalk is set back approximately 5 feet from the curb.
2) What is the State's relocation policy?
The State of Texas has an exacting set of regulations concerning the acquisition of right of way.
The attached information booklet is provided to property owners and it provides information
regarding the acquisition policy. The State historically does not vary from the policy in
negotiations, opting to proceed utilizing eminent domain when necessary. The City staff does not
typically involve themselves with negotiation between TxDOT and property owners due primarily
to the hard and fast rules the State utilizes which leave little room for negotiation.
3) Can we set up an informational meeting to advise property owners that the right of way
acquisition is coming?
TxDOT has agreed to conduct an informational meeting in the next one or two months to be held at
the Southside Multipurpose Center on East Rosedale Street to inform residents of the State's plan to
proceed with right of way acquisition for the project. TxDOT will have maps at the informational
meeting illustrating the proposed right of way line on East Rosedale Street.
We will advise you of the meeting time and date as soon as TxDOT has made the necessary
arrangements.
