CSC No. 49555-A4 AMENDMENT No . 4 TO CITY SECRETARY CONTRACT No. 49555 WHEREAS, the City of Fort Worth (CITY) and HDR Engineering, Inc., (ENGINEER) made and entered into City Secretary Contract No. 49555, (the CONTRACT) which was authorized by M&C C-28288 on the 20th day of June, 2017 in the amount of $400,000; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $ 843,000.00 which was authorized by M&C # C-28764 on June 26, 2018, Amendment Number 2 in the amount of $ 1,746,516.00 which was authorized by M&C # 21-0206 on March 23, 2021, Amendment Number 3 in the amount of $ 61,952.00 which was authorized administratively on August 15, 2023, and WHEREAS, the CONTRACT involves engineering services for the following project: Avondale -Haslet Road, CPN 101014; and WHEREAS, it has become necessary to execute Amendment No. 4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $382,936.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. City of Fort Worth, Texas Attachment A Release Date: 07.22.2021 Avondale Haslet Road — Amendment 4 Page 13 of 38 City Project 4101014 FORT WORTH • Sheets changed from 100 scale to 40 scale at 60% PS&E submittal phase Background: Before and during the 30% preliminary plans phase, it was established by both CITY and ENGINEER that the scale of the sheets shall be set at 100 scale for most engineering plan sheets. The 100 scale was selected for most sheets as 100 scale is TxDOT's preferred scale. TxDOT was involved with the early Schematic, PS&E, and Environmental processes for the project. However, after the 30% plans were submitted, CITY directed ENGINEER to rescale the design plan sheets from 100 scale to 40 scale for implementation into the 60% plans. The rescaling of the sheets was not included in the contract as a task to be performed by the ENGINEER. Moreover, a rescaling of sheets is not a common engineering practice and is not something that a client would request at such a late phase of project development as 60% PS&E Plans. Therefore, the task of changing the design scales from 100 scale to 40 scale shall be added to the contract with this amendment. The following plan sheets have been rescaled from 100 scale to 40 scale for the 60% submittal: • Traffic Control Plan — 61 sheets • Removal Sheets — 22 sheets • Roadway Sheets — 34 sheets • Drainage sheets — 31 sheets • Extended all major cross streets and approaches at 90% Background: Previous traffic analysis and lane configurations were commented on and approved by CITY in 2019 prior to the 30% submittal. After the 60% plans submittal, CITY has requested ENGINEER to perform traffic analysis and memo to analyze and coordinate on the traffic lane movements and operations at the approaches to and at the major cross street intersections on the project. Based on CITY comments and multiple discussions, the traffic lane configurations along Avondale Haslet Road and along the major cross streets have been extensively modified from the previously approved configurations. Therefore, ENGINEER shall be compensated for the requested changes made to the design. CITY had directed ENGINEER to use recessed inlets for the 30% design, and ENGINEER had proposed the location of the drainage trunk lines to be under the sidewalks. Per CITY direction before 60% plans, ENGINEER has modified the plans to move the trunk lines under the pavement and switch the curb inlets to Standard type. Because the standard inlets have less capacity than recessed inlets, more inlets are required, therefore requiring revision to all inlet drainage areas. These substantial drainage changes were not included in the original contract. By modifying the inlet type and relocating all the trunk lines, the entire drainage system within the project had to be completely redesigned. ENGINEER has spent extraordinary amount of effort given that the drainage system is an extremely complicated system and amounts for a significant portion of the project cost. • Additional Pre-90% submittal — NOT INCLUDED • Walls to be Redesigned Based on New CFW Standards Background: Several of the retaining walls on the project are designed based on CFW standard 32 13 20 D546, and particularly using the Sidewalk adjacent to curb with retaining wall section view. Since the submittal of the 60% plans in August of 2021, the CFW standard has been revised with revision date of 12-06-2021. The standard drawing revision will require all affected retaining walls to be moved, realigned, and regraded. ENGINEER will revise all affected retaining walls per new 32 13 20 D546 standard. • Proposed Sewer Line Connections ENGINEER will develop the 100% PS&E design of two 8-inch pvc lateral connections and include 5-foot diameter precast concrete manholes by accommodating and incorporating the proposed future sewer line connections as requested by the CITY as follows. The two lateral connections shall be for the following locations: Willow Springs Lateral Connection and South of Ragged Spur Ct Lateral Connection. Proposed sewer laterals will be designed to the latest version of Chapter 217 of the TCEQ guidelines for sanitary sewer design. Manholes will be designed per the City's standard details. Pipe details and specifications will be per the City standards. Minimum separation distances between water and sanitary sewer infrastructure will be per TCEQ requirements. Site restoration, sidewalk repair, and/or road replacements will all be included with the overall project and not detailed per this task. United States Army Corps of Engineers (USACE) announced June 27, 2023 that Environmental Protection Agency (EPA) and USACE are developing a rule, expected to be issued on September 1, 2023, to amend the final "Revised Definition of `Waters of the United States;" rule, published in the Federal Register on January 18, 2023, consistent with the U.S. Supreme Court's May 25, 2023 decision in the case of Sackett v. EPA. A site visit within the current ROW will be utilized during this revaluation for visual confirmation of the potential jurisdictional features. DISCUSSION: The 2018 Bond Program allocated funds for the design of intersection improvements at Senders Ranch Boulevard and Willow Springs Road, as well as the addition of a center turn lane and pavement rehabilitation of Avondale Haslet Road, from Willow Creek to the City Limits at John Day Road. An Engineering Services Agreement with HDR Engineering, Inc. (Consultant), City Secretary No. 49555, was authorized in 2017 for the design of the project. On September 1, 2020, Mayor & Council Communication (M&C) 20-0621 authorized rescoping the Avondale Haslet project. The revised scope includes the replacement of the two-lane asphalt road with a four -lane divided concrete arterial with storm drain, illumination, traffic signal improvements and 10- foot shared use paths. There have been three previous amendments to the original contract, please refer to the table below for details. This is amendment number four which provides compensation to the Consultant for additional turn lanes at the Willow Springs North and Willow Springs South intersections, additional environmental documentation, additional investigation to confirm existing utility crossings, temporary traffic signal design, and various plan revisions required following land acquisition negotiations with property owners.
