HomeMy WebLinkAboutContract 59366-A1CSC: 59366-A1 AMENDMENT NO. 1 TO FORT WORTH CITY SECRETARY CONTRACT NO. 59366 This First Amendment to Fort Worth City Secretary Contract No. 59366 (the "Agreement") is made between the City of Fort Worth ("City" or "Buyer"), a home -rule municipal corporation of the State of Texas, and United Way of Tarrant County ("Vendor"). Buyer and Vendor may be referred to individually as a "Party" and collectively as the "Parties." WHEREAS, on May 9, 2023, the Parties entered into City Secretary Contract 59366 for a Grant Navigation services ("Agreement"); and WHEREAS, it is the collective desire of both City and Vendor to amend the Agreement to increase compensation from $49,920.00 to $174,920.00 annually; and WHEREAS, the City and Vendor wish to amend the Agreement to add a Community Liaison/Strategist outlined within Exhibit C (Scope of Services) and Exhibit D (Payment Services). NOW, THEREFORE, the Parties, acting herein by and through their duly authorized representatives, enter into the following amendment: I. Section 3.1 of the Agreement is hereby amended by replacing it with the following: 3.1 City shall pay Vendor in accordance with the fee schedules in Exhibits B and D and in accordance with the provisions of this Agreement. Total payments made under this Agreement by City shall be in an amount not to exceed one hundred seventy-four thousand, nine hundred twenty dollars and zero cents ($174,920.00). II. Exhibits C and D, which are attached hereto and incorporated herein by reference, are made a part of this Agreement for all purposes. Vendor agrees to provide City with the services and goods included in Exhibits A and C pursuant to the terms and conditions of this Agreement, including all exhibits thereto. If any provisions of the attached Exhibits or associated terms conflict with the terms herein, are prohibited by applicable law, or conflict with any applicable rule, regulation, or ordinance of City, the terms in this Agreement shall control. All terms and conditions of the Agreement that are not expressly amended pursuant to this First Amendment shall remain in full force and effect. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX First Amendment to Fort Worth City Secretary Contract No. 59366 Page 3 of 5 CSC: EXHIBIT C SCOPE OF SERVICES Community -Based Programs Community Liaison/Strategist Description: The Crime Control and Prevention District imposes a'/2 cent sales tax in the City of Fort Worth designated for crime control, crime prevention, and public safety. As part of the City's efforts to implement crime prevention efforts, the Board has approved the use of funds toward competitive grants to 501(c)3 organizations that provide services that have a measurable impact on crime and safety. These grants are offered in two different programs (Program Grants and Development Grants) designed to work with agencies that vary in mission, size, and experience. To facilitate better access with these agencies, Fort Worth Police Department requires a qualified firm to provide the service of a Community Liaison. The goal of the Community Liaison is to increase the number of agencies funded that address crime/safety priorities (violent crime and police/community relations) and target groups/programs (foster care, previously adjudicated youth/adults, and/or victim services). This includes but is not limited to: • Meeting with and educating community stakeholders about the Crime Control and Prevention District • Mapping of community crime/safety-related resources (i.e. agencies, funding sources, community contacts, etc.) • Serving as Co -Chair of Partners with a Shared Mission Expert Panel ("Leveraging Resources") • Reviewing and advising on community partnerships and sustainability • Coordinating Police messaging campaigns for Crime Control and Prevention District grants under the direction of FWPD • Surveying community stakeholders on crime/safety problems and the community's capability and capacity to respond • Advising FWPD staff on the coordination of resources to meet Department goals First Amendment to Fort Worth City Secretary Contract No. 59366 Page 4 of 5 CSC: EXHIBIT D PAYMENT SCHEDULE • Community Liaison may be invoiced at $33.13 (dependinz on the number of hours per week azreed upon) Der hour for services rendered uD to a total of $68.900.00 for annual salary and $56,100 (or $4.675 per month) for benefits and administrative costs. • Invoices should include the Citv's Purchase Order number, the Communitv Liaison name, item descriDtion (salary. benefits, administrative costs), hours billed, hourly rate, and extended rate. • The vendor shall send invoices no more than monthlv during the term of the contract. • The amounts due under each invoice shall be Davable within thirty (30) days after the Citv's receipt of the invoice. DISCUSSION: The Crime Control and Prevention District (CCPD) is funding, provided by a'/2 cent sales tax, designated for crime control, crime prevention, and public safety. As part of the City's efforts to implement crime prevention efforts, the CCPD Board of Directors approved the use of funds toward competitive grants to 501(c)3 organizations that provide services with a measurable impact on crime and safety. These grants are offered in two different programs, Program Grants and Development Grants, that are designed to work with agencies that vary in mission, size, and experience. To facilitate better access by these agencies, the Police Department (Police) requires a qualified firm to provide the services of a Community Liaison. The goal of the Community Liaison is to increase the number of agencies funded that address crime/safety priorities, such as violent crime and police/community relations. The Community Liaison will also target groups/programs including foster care, previously adjudicated youth/adults, and/or victim services. United Way of Tarrant County was selected as they have unique knowledge and experience working in the non-profit development space and are currently working with the Police Department to engage non -profits in the violent crime needs of the community. Under City Secretary Contract (CSC) 59366, United Way of Tarrant County is already serving as a Grant Navigator, assisting 501(c)3 agencies to better connect their programming to the mission of CCPD as they seek to secure grant funding. Funding is budgeted in the Consultant & Other Prof Services account within the State Asset Forfeiture Fund for the Police Department. DVIN-BE: The Police Department was approved for a Chapter 252 Exemption by the City Attorney's Office. Therefore, the business equity goal requirement is not applicable. ADMINISTRATIVE CHANGE ORDER: An administrative change order or increase may be made by the City Manager up to the amount allowed by relevant law and the Fort Worth City Code and does not require specific City Council approval as long as sufficient funds have been appropriated. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies funds are available in the current operating budget, as previously appropriated, in the State Asset Forfeiture Fund, to support the approval of the above recommendation and execution of the contract amendment. Prior to an expenditure being incurred, the Police Department has the responsibility to validate the availability of funds.
