AMENDMENT No . 2
TO CITY SECRETARY CONTRACT No. 57712
WHEREAS, the City of Fort Worth (CITY) and Plummer Associates,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 57712,
(the CONTRACT) which was authorized by M&C 22- 0412 on the 14th day of
June, 2022 in the amount of $1,761,590.00; and
WHEREAS, the CONTRACT was subsequently revised by Amendment No. 1 in
the amount of $99,851.00 administratively authorized on February 7, 2024;
and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Mary's Creek Water Reclamation Facility Lift Station Site and Force
Main Alignment; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $2,159,580.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $4,021,021.00.
3.
All other provisions of the Contract, which are not expressly

This Contract Amendment No. 2 is provided for additional service related to Mary's Creek Lift Station

The scope set forth herein defines the work to be performed by the ENGINEER in completing
the project. Both the CITY and ENGINEER have attempted to clearly define the work to be
performed and address the needs of the Project.
The purpose of this scope for contract amendment #2 is to provide an update to the original
alignment evaluation and preliminary design (60%) contract and to take portions of the project to
complete detailed design. The original contract included up to 7.5 miles of sanitary sewer
alignment and preliminary design. The result of the alignment evaluation is a total project length
of 8.4 miles (44,350 LF). This additional length affects the amount of effort required for the
alignment evaluation, 30, 60% design, topographic survey, and archaeological investigation.
Therefore, this contract amendment updates the preliminary design contract as well as takes
portions of the project from the original contract from 60% design to 100%. This contract
amendment also includes advertisement- bid phase services but does not include construction
administration phase services.

• proactively address issues with the CITY's Project Manager and others as necessary
to make progress on the work.
1.1. Managing the Team
• Lead, manage and direct design team activities
• Perform quality control processes in performance of the work
• Communicate internally among team members

1.2. Communications and Reporting
1.2.1 Conduct review meetings with the CITY (Water Department). The original
preliminary design schedule assumed that the 30% and 60% design phases
would be reviewed without sectional divisions. The delay to temporary right of
entry demanded that some sections proceed in advance of other sections, thus
dividing the project into three sections, therefore additional review meetings are
necessary.
The three sections are:
Section 1 is from the Confluence lift station to the MCWRF.
Section 2 is from Walnut Creek lift station to Confluence lift station.
Section 3 is from Upper Clear Fork Lift Station to Walnut Creek lift station. Up to
six (6) additional review meetings are planned as follows:
a) 30% Force Main Design Plans review meetings (2).
b) 60% Force Main Plan and Profile review meetings (2).
c) 90% Force Main Design review meetings (2).
1.2.2 Coordinate with CITY Development Services to review possible development and
land use along the force main route.
1.2.3 Prepare and submit monthly invoices in the format requested by the CITY.
1.2.4 Prepare and submit monthly progress reports in the format provided by the Water
Department. (up to 32 months)
1.2.5 Prepare and submit and continue project schedule that includes milestones for
future work including permitting, finalizing design, and construction of the force
main and submit project schedule updates with a schedule narrative each month,
as required in Attachment D to this Standard Agreement and according to the
CITY's Schedule Guidance Document.
1.2.6 Complete Monthly M/WBE Report Form and Final Summary Payment Report
Form at the end of the project.
1.2.7 Personnel and Vehicle Identification: When conducting site visits to the project
location, the ENGINEER or any of its sub -consultants shall carry readily visible
information identifying the name of the company and the company
representative.

Data Collection
In addition to data obtained from the CITY, ENGINEER will research proposed
improvements in conjunction with any other planned future improvements that may
influence the project. The ENGINEER will also identify and seek to obtain data for
existing conditions that may impact the project, including but not limited to; utilities,
agencies (TxDOT and railroads), City Master Plans, and property ownership as available
from the Tax Assessor's office.

ASSUMPTIONS
• Drawings will be 11 "X17".
• PDF files created from design CAD drawings will be uploaded to the designated project
folder in EBUILDER.
TASK 2.1. FORCE MAIN ALIGNMENT EVALUATION
2.1.1 The following scope in this force main alignment evaluation is only for the additional
portion (5,550 LF) not included in the original contract. During the alignment
evaluation, the ENGINEER shall contact and coordinate with public and private
agencies including but not limited to:
1. 39 private and public property owners.
These entities shall also be contacted to obtain plans for existing and/or proposed
facilities for use during design. With respect to coordination with permitting authorities,
ENGINEER shall communicate with permitting authorities such that their regulatory
requirements are appropriately reflected in the designs. ENGINEER's work will be in
compliance with regulatory authorities' requirements.
2.1.2 The scope of the additional portion of the alignment evaluation will be similar to the
scope in the original contract. This is for additional 5,500LF of force main routing.
2.1.3 Additional alignment evaluation after alignment evaluation report accepted on multiple
properties over approximately 2.5 miles.
TASK 2.2. 30% DESIGN PLANS
The following scope in this 30% design plans is only for the additional portion not included in the
original contract. The 30% Design Plans phase will be initiated after the approval of the
alignment evaluation by the CITY.
ENGINEER will develop the conceptual design plans of the Force Main (30%) as follows.
2.2.1 Development of 30% Design Drawings shall include the following:
• The scope of work for the 30% design plans is similar for the 30% design in the original
contract.
2.2.1.a ENGINEER shall make the necessary changes to the plans to split one set
of plans into three sets. One for each section of the force main connecting
one potential site of Lift Station to the next potential lift station site.
2.2.1 b ENGINEER shall design 5,500 LF of force main which were added to the
project as a result of the alignment evaluation process.
2.2.1 c ENGINEER shall Redesign plan views of the force main shown in the one
set to remove the future gravity sanitary sewer main and adjust the
easement sizes and re -annotating the plan views.

• ENGINEER will review an odor/air exhaust memo prepared by others.
• ENGINEER will evaluate and perform conceptual engineering efforts for a passive,
vapor -phase odor control system to treat odorous exhaust air (H2S only) from the air
release valves (ARVs) which will be located along the force main alignment. Inlet
hydrogen sulfide (112S) assumptions will be documented, and an odor reduction value
will be determined.
• Based on the sizing of the ARVs and the expected air flow through the ARVs, the odor
control fittings will be sized and specified. Along the force main route, there may be
several sizes of odor control units required. The ENGINEER will specify a maximum of
three (3) sizes of odor control units to be used for the different applications (whether as
stand-alone units or in conjunction with another of the three.
• ENGINEER will develop an Odor Control Preliminary Design Technical Memorandum
(TM) which will include: air flow rate estimates, inlet H2S concentration estimates, odor
control units sizing for the three (3) sizes, and expected treatment levels. The results of
the TM will define the scope of the detailed design phase of the force main ARV odor
control system. The TM will include a Class IV cost opinion for the procurement and
installation proposed odor control systems.
• A draft TM will be submitted to the CITY for review and comment. CITY comments will
be incorporated and re -submitted (if needed). The TM will be finalized after the
completion of two (2) CITY review sessions.
TASK 2.3 REVIEW ADDITIONAL LIFT STATION SITES
The original contract required that the lift station sites be evaluated. This scope includes
the evaluation of additional lift station sites.
Conceptual Engineering Odor Scope Deliverables (submitted electronically in PDF format):
1. Odor Control conceptual Design TM — Draft 1
2. Odor Control conceptual Design TM — Draft 2 and comment responses list.
3. Odor Control conceptual Design TM — Final TM and final comment responses list.
ASSUMPTIONS
• Up to 211 force main sheets are planned.
• Assumptions are similar to the assumptions in the original contract.
• Odor Control TM will make assumptions about the size and flow anticipated from the Clear
Fork Lift Station and will need to be updated, in the future, based on the timeline for the
design of the Clear Fork Lift Station.
• Vapor -phase odor treatment for the ARVs will be utilize Wager dry media system.
• ARVs will be located within and outside of the floodplain.
• ARVs will be designed in three (3) sizes; small, medium, and large, based upon expected
air flows and estimated H2S concentrations.
• Design of any lift station odor control systems is by others.
• Odor control systems will be sized based on inlet H2S assumptions only and will not use
other odor compounds as design inputs.
• Odor control devices will be designed to reduce odors, not eliminate them.
• Two (2) different technologies will be evaluated for odorous air treatment; carbon
scrubbers and engineered media adsorption.
• Odor control treatment units will be passive, no electrical or instrumentation will be

DELIVERABLES
1. Up to five (5) sets of 11"X17" plans will be delivered for the 30% Design Plan Set (Up
to 211 Design Sheets), in three (3) separate construction projects.
2. Engineer's Opinion of Probable Construction Cost (30%) in accordance with AACE.
3. Draft and Final Odor Control conceptual design TM.
TASK 3. PRELIMINARY DESIGN (60% PLAN AND PROFILE).
3.1 The following scope in this 60% design plans is only for the additional portion (5,500 LF)
not included in the original contract. The 60% design plans phase will be initiated after
the approval of the 30% submittal. The 60% plan and profile drawings scope is similar
to the original contract scope. The scope for 60% Design drawings will be similar to the
original Contract scope.
3.1.1a The ENGINEER shall advance the design from 30% phase to 60% phase,
including the profile of the ground line, the existing and proposed easement
widths, the profile of the one proposed force main.
3.1.1 b The ENGINEER shall design of additional 5,500 LF of force main.
3.2a Geotechnical Investigations
ENGINEER shall provide soil investigations, including field and laboratory tests, borings,
related engineering analysis and recommendations for determining soil conditions for
additional 140 vertical linear feet. The number of soil bores does not change.
3.2b Slope Stability Study
ENGINEER will provide slope stability recommendations at four locations along the
pipeline route. Recommendations for soil nails, rock anchors for tie backs and slope
stability analysis.
3.3 Design Gabion Structures
ENGINEER shall provide detailed design for gabion retaining structures to protect
existing sanitary sewer main from further erosion for up to two (2) locations. Gabion
retaining structures at other sites will be considered Additional Service. Gabion retaining
wall structures are independent of gabion mattresses provided at creek crossings for
erosion protection.
3.4 Gabion or Rip Rap Erosion Structure
ENGINEER shall provide detailed design of gabions mattresses or rip rap erosion
control at slope (Max slope 21-1:1V or flatter), no gabion baskets/cubes, areas of concern
for up to 12 locations.

ENGINEER shall provide stormwater modeling at the confluence lift station site adjacent
to Camp Bowie..
3.6 Design for Odor Control at ARVs
The detailed design phase for the odor control systems for the ARVs will follow the
project schedule of the overall force main design and deliverables. This scope
documents does not include the odor control design for any wastewater lift stations.
The ENGINEER will coordinate with the lift station odor control design teams if the
design at lift station is anticipated to impact the design of the odor control system for the
ARVs (i.e. Chemical Feed system or Aeration or Ozonation). ENGINEER will incorporate
results from the Odor Control TM in the 60% design. The design will include details for
the specified odor control units for the three (3) size varieties. The odor control OPCC
will be updated to include 60% design.
3.7 Site Visits and Field Meetings
The ENGINEER shall conduct up to eight (8) site visits and field meetings to coordinate
with developers, developer's engineers for the monitoring and evaluation of any field
changes that could affect the design.
ASSUMPTIONS
• The assumptions for 60% design are similar to the original contract.
• Gravity sewer main flow diversion manholes are not included.
• Additional geotechnical borings of 140 vertical feet of additional depth and additional
testing for the collected samples.
• Odor Control will be designed above ground.
• The design of ARV will be for surge dampening and slam -preventing valve.
DELIVERABLES
1. Three 60% Design drawings.
2. Slope stability analysis and recommendations for four locations along the force main
route.
3. Soil analysis for additional samples collected from 140 VLF.
4. Odor Control Designs.
5. ARV sizing, locations, and configuration.
6. Stormwater technical memo.
TASK 4. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100
PERCENT).
Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as follows:
4.1 SWPPP Design
For projects that disturb an area greater than one (1) acre, the Contractor will be
responsible for preparing and submitting the Storm Water Pollution Prevention Plan

(SWPPP) with appropriate regulatory agencies. The Engineer will prepare the iSWM
Construction Plan according to the current CITY iSWM Criteria Manual for Site
Development and Construction which will be incorporated into the SWPPP by the
contractor.
4.2 Draft Final plans (90%) and specifications
Draft Final plans (90%) and specifications shall be submitted to CITY per the approved
Project Schedule.
4.2.a ENGINEER shall provide final design plans and specifications for Section 1 of
the force main project.
4.2.b ENGINEER shall provide final design plans and specifications for Section 2 of
the force main project.
4.2.c Final design for Section 3 of the force main project is not included in this
amendment.
4.2.d ENGINEER shall provide final design plans for additional 5,500 LF of force main.
4.3 100% Plans and Specifications
Following a 90% construction plan review meeting with the CITY (for Each of the two
design sets), the ENGINEER shall submit Construction Documents (100%) to the CITY
per the approved Project Schedule. Each plan sheet shall be stamped, dated, and
signed by the ENGINEER registered in the State of Texas.
4.3.a ENGINEER shall update the plans for section 1 and section 2 to reflect easement
agreement conditions with property owners.
4.3.b ENGINEER shall provide final construction documents for Section 1 of the force
main project.
4.3.c ENGINEER shall provide final construction documents for Section 2 of the force
main project.
4.3.d Final construction documents for Section 3 of the force main project is not
included in this amendment.
4.4.a Construction Estimates
The ENGINEER shall submit a final design estimate of probable construction cost with
both the 90% and 100% design packages. This estimate shall use ONLY standard CITY
bid items.

The ENGINEER shall conduct an in-house constructability review meeting for section 1
and section 2.
4.5 Gabion Design
Gabion design structures to protect existing sanitary sewer main from further creek
erosion at two locations.
4.6 Odor Mitigation Design
The detailed design phase for the odor control systems for the ARVs will follow the
project schedule of the overall force main design and deliverables. This scope
documents does not include the odor control design for any wastewater lift stations. The
ENGINEER will coordinate, communicate, and consult with the lift station odor control
design teams if the design at lift station is anticipated to impact the design of the odor
control system for the ARVs (i.e. Chemical Feed system or Aeration or Ozonation).
ENGINEER will incorporate results from the 60% review meeting comments in the 90%
design. The design will include details for the specified odor control units for the three (3)
size varieties. The odor control OPCC will be updated to include 90% design.
ENGINEER will finalize Odor Control design 100%.
4.7 Z Boaz Park Parking Lot Design
The ENGINEER shall design Z Boaz park parking lot to be reconstructed at the same
location at the existing parking lot. The parking lot is planned to be used for construction
staging and access.
4.8 Low Water Crossings for Access at Drainage Ditches
The ENGINEER shall design up to four (4) low water crossings at drainage ditches to
allow City access to the force main on the City's easement. Each crossing includes
concrete access ramps, protected by gabion mattresses or baskets. The width of the
concrete access shall not exceed 16-ft wide.
4.9 Site Visits and Field Meetings
The ENGINEER shall conduct up to eight (8) site visits and field meetings to coordinate
with developers, developer's engineers for the monitoring and evaluation of any field
changes that could affect the design.
4.10 Air Relief Valve and Valve Vault Sizing
The City Standard product list allows 3 or 4 manufacturers or air relief valves, each
having different dimensions and different air relief capacities for the same size. This
project will require unique air relief valve vault design apart from the City standard vault
because it is in the floodplain. Air Relief Valve and Valve Vault sizing to be performed for
Sections 1 and 2 only.

4.11 Meetings for Coordination with Lift Station Designers
The ENGINEER will coordinate with the lift station design team for the Walnut Creek lift
station and the Confluence Lift Station. Final force main sizing and wall thickness class
will be by the lift station design engineer. Coordination includes up to 18 virtual
meetings.
4.12 Design Coordination with Lift Station Design Team
Design coordination includes trading off of CAD files for survey alignments.
4.13 WIFIA Specification Modifications
WIFIA has special conditions that will have to be examined and added to the City's
standard special conditions. There are special requirements for bid forms and bid
procedures and procurement requirements.
4.14 Structural Engineering
There are many miscellaneous structures that require a structural engineering design
services (concrete pavement, gabion tieback beams, etc.).
4.15 Design and Specify Alternate Pipe Materials
The original contract included scope to design the project around fiberglass polymer
mortar pipe. The City desires to bid an alternate pipe material of high -density
polyethylene. This will require special bid proposals and additional specification and
design for flange and joint compatibility and special details for connections. No technical
memo for pipe material alternatives evaluation to be provided.
4.16 Redesign of Force Main at Confluence Lift Station
This design effort includes rerouting the force mains to cross into the Johnson Sisters
property to the confluence lift station, and the design of the force mains out of the
confluence lift station site back to the original alignment. This design includes two (2)
creek crossings by open cut (no aerial crossing required), coordination with private
landowners, and four (4) additional soil borings - 1 on each side of each creek crossing.
This item includes approximately 1,500 linear feet of topographic survey, archaeological
investigation of the approximate 13-acre site, subconsultant coordination, and additional
lift station engineer coordination. This design effort does not include any rerouting of the
gravity main from South Mary's Creek to the lift station site.
ASSUMPTIONS
• Two (2) sets of 11" x 17" size drawings and two (2) sets of 22" x 34" size drawings and

5.1.1 The ENGINEER shall upload all plans and contract documents onto EBUILDER for
access to potential bidders for each of the two construction projects.
5.1.2 Contract documents shall be uploaded in a .xIs file for each of the two construction
projects.
5.1.3 Unit Price Proposal documents are to be created utilizing CFW Bidtools only and
combined in a specified spreadsheet workbook, Bid Proposal Worksheet Template,
and will be populated and configured so that all pages are complete and the
Summary Worksheet(s) in the workbook detail and automatically summarize the
totals from the inserted Unit Price Proposal document worksheets.
5.1.4 Plan Sets are to be uploaded to EBUILDER in two formats, .pdf and .dwf files. The
.pdf will consist of one file of the entire plan set. The AM will consist of individual
files, one for each plan sheet, and will be numbered and named in a manner similar
to that of the plan set index.
5.1.5 The ENGINEER shall sell contract documents and maintain a plan holders list on
EBUILDER from documents sold and from Contractor's uploaded Plan Holder
Registrations in EBUILDER for each of the two construction projects.
5.1.6 The ENGINEER will develop and implement procedures for receiving and answering
bidders' questions and requests for additional information. The procedures shall
include a log of all significant bidders questions and requests and the response
thereto. The log shall be housed and maintained in the project's EBUILDER folder
titled Request for Information. The ENGINEER will provide technical interpretation of
the contract bid documents and will prepare proposed responses to all bidders
questions and requests, in the form of addenda. The ENGINEER shall upload all

the two construction projects.
5.1.7 Attend the prebid conference in support of the CITY for each of the two construction
projects.
5.1.8 Assist the CITY in determining the qualifications and acceptability of prospective
contractors, subcontractors, and suppliers for each of the two construction projects.
5.1.9 When substitution prior to award of contracts is allowed in the contract documents,
the ENGINEER will advise the CITY as to the acceptability of alternate materials and
equipment proposed by bidders.
5.1.10 Attend the bid opening in support of the CITY for each of the two construction
projects.
5.1.11 Tabulate and review all bids received for each of the two construction projects, assist
the CITY in evaluating bids, and recommend award of the contracts. A copy of the
Bid Tabulation and the CFW Data Spreadsheet created utilizing CFW Bidtools only
are to be uploaded into the project's Bid Results folder on EBUILDER for each of the
two construction projects.
5.1.12 Incorporate all addenda into the contract documents and issue conformed sets for
each of the two construction projects.
5.2 Final Design Drawings
Final Design Drawings shall be submitted in both Adobe Acrobat PDF format (version
6.0 or higher) format and DWF format. There shall be one (1) PDF file and one (1) DWF
file for the TPW plan set and a separate PDF and DWF file for the Water plan set. Each
PDF and DWF file shall be created from the original CAD drawing files and shall contain
all associated sheets of the particular plan set. Singular PDF and DWF files for each
sheet of a plan set will not be accepted. PDF and DWF files shall conform to naming
conventions as follows:
I. TPW file name example — "W-1956_org47.pdf' where "W-1956" is the assigned file
number obtained from the CITY, "_org" designating the file is of an original plan set, "47"
shall be the total number of sheets in this file.
Example: W-0053_org3.pdf and K-0320_org5.pdf
11. Water and Sewer file name example — "X-35667_org36.pdf" where "X-35667" is the

TASK 8. SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES.
The scope is similar to the scope in the original contract. The following scope in this design
survey section is for the additional portion not included in the original contract. ENGINEER will
provide survey support as follows.
8.1 Design Survey
8.1.a. Topographic survey will be collected for up to 5,500 LF of additional force main and
re -alignments.
8.1.b. Topographic survey due to alignment change at Section 2 Station 169+00 for
approximately 300 LF.
8.2 Perform Subsurface Utility Excavation (SUE)
8.2.a SUE will be performed in accordance with the American Society of Civil
Engineers (ASCE) publication Cl/ASCE 38-02. Level B Subsurface utility locates
for locating utilities at ten locations along the Force main route (from which have
utilities that need to be identified to confirm the location of the utilities.
8.2.b Perform existing sanitary sewer tone to confirm the location of the ex. sanitary
sewer main in relation to the existing easement. This task is up to 6,000 LF of
tone at up to four locations along the route (At the Owner's Direction)
8.3 Temporary Right of Access Coordination
Coordination, administration, and documentation with individual landowners for
specialized temporary right of entry (TROE) forms including legal review and negotiation
for multiple individual customized insurance and indemnification requirements.
Coordinating TROE forms signatures for subconsultants, including insurance,
indemnification, and jointers. Meetings and communications for education, and
answering pipe design questions from multiple property owners prior to gathering TROE
signatures, including alignment and realignment, impacts, negotiation, appraisal,
compensation etc... answering multiple questions about the background, history, the
need for the project. Explain the reason for 3 pipelines, one proposed force main, one
future force main, and one future gravity line, explaining the reason for the easement
width, and the rights property owners have for an easement, and the relationship
between these pipelines and the MCWRF project. Coordination for additional TROE time
extensions. Coordination with CITY Property Management, and Legal Department for
TROE. Call each property owner in advance of receiving the TROE letter to provide
advanced notice.

strategy and process, conduct necessary fieldwork and prepare permitting documents to be
submitted by CITY staff. Multiple federal, state and local agency permits/concurrence are
expected. The ENGINEER shall accompany the CITY to three (3) pre -application meetings
with permitting agencies. Anticipated deliverables in support of permit applications are as
follows:
10.1 Aquatic Resources Delineation Report
The ENGINEER shall prepare an Aquatic Resources Delineation Report for the PROJECT:
a. Conduct field investigations required to delineate jurisdictional wetlands and/or Waters of
the U.S. (WOTUS) within a 100 ft. corridor of the preferred alignment for the proposed
PROJECT. ENGINEER will provide delineation data that includes wetland determination
data forms, GPS data including but not limited to data points and wetland and WOTUS
boundaries in the form of a SHP file, and field notes.
b. Prepare an Aquatic Resources Delineation (ARDR) report documenting the findings from
the delineation of the PROJECT site.

c. Prepare an executive summary of the ARDR which includes potential impacts resulting
from proposed project components to jurisdictional areas and applicable Section 404
(Clean Water Act) permitting options.
d. Attend coordination meetings associated with the planning, data acquisition, or design of
the project. Develop meeting notes and share with the CITY and attendees.
10.2 Threatened and Endangered Species Report
The ENGINEER shall prepare a Threatened and Endangered Species Letter Report for the
PROJECT:
a. Conduct a survey of the one (1) preferred alignment for the proposed PROJECT for
potential threatened, endangered, candidate, or proposed candidate species and/or
critical habitat for species listed for Tarrant County.
b. Prepare a Threatened and Endangered Species Letter Report (T&E) documenting the
findings of the survey for threatened or endangered species and/or designated critical
habitat for the project site.
10.3 Tree Preservation Plan and Permits
The ENGINEER shall prepare Tree Permit Applications for the PROJECT:
a. Utilize a local urban forester or certified arborist to investigate the project boundaries to
confirm the tree species and tree survey results within the proposed alignment corridor.
b. Develop and submit a Tree Conservation and Protection Plan for approval with each
entity. The Tree Conservation and Protection Plan will include plan drawings and details
to be included in the contract drawings, if deemed necessary upon completion of the
entity review.
c. Prepare and submit a tree removal permit application package for each section of the
project requiring a permit. ENGINEER shall attend two meetings with CITY to review
drawings and address comments. It is assumed that the only the CITY has tree permit
requirements for utility projects and the City of Benbrook will not require a tree permit.
d. Tree permitting for the approximate 13-acre confluence lift station site will be performed
by others.
10.4 USACE Section 404/401 Authorization
The ENGINEER shall prepare the USACE Section 404 Permit application for the PROJECT:
a. Request and conduct up to two pre -application meetings onsite with staff from the CITY
and staff from select regulatory agencies that are responsible for key permits. The
objective of the pre -application meetings will be to explain the PROJECT to the agency
staff, allow agency staff to become acquainted with the site conditions, and identify any
design -related issues that may impact permitting schedules. Initial expectations include
meeting with the CITY and USACE.
b. Prepare the Section 404 Nationwide Permit 58 (NWP 58) pre -construction notification
(PCN) and necessary supporting documents for submittal to the USACE Fort Worth

District. USACE Fort Worth District permitting templates provided by the USACE Fort
Worth District will be utilized as much as possible in the permit application preparation.
The permit packet shall be provided to the CITY for review prior to submittal to the
USACE. ENGINEER assumes that impacts to WOTUS within the project area would be
authorized under NWP 58 and that an individual permit will not be required.
10.5 Floodplain Development Permit Application
The ENGINEER shall prepare a Floodplain Development Permit application for the PROJECT:
a. Prepare a floodplain development permit application for the CITY assuming no impacts
due to pipeline construction. One for Section 1 and the other is for Section 2.
Coordinate with floodplain administrators, meet and respond to comments on the permit
applications until the permits are issued.
b. Prepare a floodplain development permit application for the City of Benbrook, assuming
no impacts. Portions of Section 2 are in the City of Benbrook limits. Coordinate with
floodplain administrators, meet and respond to comments on the permit applications
until the permits are issued.
c. Conduct a floodplain modeling for up to 20 above ground Odor Control units, 4 low
water crossings, 2 gabion retaining wall structures, 6 creek crossings, and their impacts
on the flood plain. This task does not include permitting for impacts.
d. Flood plain permitting for Confluence lift station and Walnut Creek Lift station will be
performed by others.
10.6 Cultural Resource Services (Archeological)
The following services are required because the original preliminary design contract
assumed one mobilization. Contract amendment number 1 allowed for two additional
mobilizations. The schedule for the project has demanded work to be performed at a
pace prior to obtaining all rights of entries for all properties and prior to finalized
alignments for all properties. This scope allows for two additional mobilizations. This
scope includes work for three lift station sites and the force main route.
10.7 Other Permitting:
The ENGINEER will prepare permit applications (up to 24) and submit the following
applications to the appropriate agencies or departments for review and approval. These
utilities will be engaged via the city's utility review process. The permit applications will
be provided to the city if the utility requires a permit or encroachment agreement for city
signature. Fees related to permit application are submission not included.

• Three (3) additional mobilization field visits for archaeological evaluation is planned.
• Permit preparation will begin after approval of portion of the Preliminary Design (60%).
• One (1) mobilization for Aquatic Resources Delineation Report (ARDR) and Threatened
and Endangered (T&E) field survey is planned.
• Three (3) tree removal permits, per construction project, are planned for the preferred
project alignment with the CITY and the City of Benbrook. Project 1 has one permit from
CITY, Project 2 has one permit from CITY and Another from City of Benbrook.
• One (1) USACE NWP 58 PCN package is planned. An individual 404 Permit is not
anticipated for the PROJECT, and it is not provided under this contract.
• It is assumed that impacts to WOTUS will be less than the threshold that would trigger
requirement of mitigation.
• Qualitative or quantitative evaluation (e.g. TXRAM 2.0) of WOTUS in support of impact
mitigation is not included in this submittal.
• All flood plain permits assume no change in contours, no fill in flood plain and no
modeling, except where otherwise stated.
• Up to two (2) pre -application meetings with the USACE are assumed.
• One (1) pre -application meeting with the CITY for tree permitting is planned.

10.8 National Environmental Policy Act (NEPA) Documentation in Support of WIFIA Funding
The ENGINEER shall prepare NEPA Documentation in support of WIFIA funding for the
PROJECT:
a. ENGINEER will assist the OWNER in drafting the Environmental Information
Document (EID) as required for Federal Environmental Review by the Environmental
Protection Agency (EPA) in support of WIFIA funding. ENGINEER will perform
necessary environmental review for the approved scope of work as needed to comply
with NEPA.
b. Prepare an EID following the structure requested by the EPA and addressing the
required components which will include a complete description of all components of
the applicant's proposal and any connected actions, including its specific location on
detailed site plans as well as location maps equivalent to a U.S. Geological Survey
(USGS) quadrangle map; and information from authoritative sources acceptable to
the EPA confirming the presence or absence of sensitive environmental resources in
the area that could be affected by the applicant's proposal.
c. It is assumed that either an Environmental Assessment (EA) or the Programmatic
Environmental Assessment (PEA) will suffice for this PROJECT. If a higher level
NEPA document is required, it will be an ADDITIONAL SERVICE.
10.9 Engineering Feasibility Report in Support of WIFIA Funding
WIFIA may require up to 15 engineering documents to be attached to the application, two
of which are mandatory. The project map, project schedule, EOPCC have already been
prepared, but it is unclear what additional engineering reports remain to be prepared, and
which ones will need to be revised to submit to WIFIA. Reports such as the Lift Station
site selection memos, as well as the alignment evaluation report have yet to be prepared.
Some suggested documents may be prepared by the city or prepared at later date ... i.e.
post construction or submitted when applicable. This scope is an allowance to provide
services when it is further identified specifically what is needed.
10.10 WIFIA Funding compliance with Plans and Specifications
This item covers changes to the plans and specifications due to WIFIA terms and
conditions.
Special Services:
Task 1: Allowance for unidentified services to be authorized independently by the City.

Additional Services not included in the existing Scope of Services
CITY and ENGINEER agree that the following services are beyond the Scope of Services
described in the tasks above. However, ENGINEER can provide these services, if needed,
upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of
any material change to the Scope of the Project shall be agreed upon in writing by both parties
before the services are performed. These additional services include the following:
• Services related to development of the CITY's project financing and/or budget.
• Specialty testing services not listed in Basic Services.
• Services related to damages caused by fire, flood, earthquake, or other acts of God.
• Services related to platting of two lift station sites.
• Services to support, prepare, document, bring, defend, or assist in litigation
undertaken or defended by the CITY.
• Computational fluid dynamic hydraulic modeling.
• Corrosivity of soils investigation and stray current on metallic pipelines analysis.
• Cathodic protection system design.
• Electrical technical memos.
• Detail design of Aerial creek crossing design and related FEMA permitting.
• Flood plain hydraulic modeling or deliverables other than provided in basic services.
• SCADA integration.
• Security/video surveillance design.
• Communication/fiber optic line routed within new easements.
• Transient surge analysis of the force main.
• Storm drain, roadway, landscaping design.
• Flood impact analysis, Conditional letter of Map Revision, Letter of Map Revision.
• Site development or Building permits.
• Route study and/or design of new gravity mains outside of the lift station sites.
• Landscape Architectural service.
• Architectural service.
• Relocating Z-Boaz Parking Lot to a different location including permitting,
stormwater, lightning, marking and approval by the City.
• Design of a second future force main that is outside (not parallel) of the alignment of
the first force main.
• Detail design of lift stations.
• Alignment changes after approval of 60% design plans.

RECOM NDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 2 to City Secretary Contract No. 57712, an engineering
agreement with Plummer Associates, Inc. in the amount of $2,159,580.00 for the Mary's Creek Lift
Station Site & Force Main Alignment project for a revised contract amount of $4,021,021.00; and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the
Water & Sewer Bond 2020A Fund by increasing estimated receipts and appropriations in the Mary's
Creek Lift Station Site & Force Main Alignment project (City Project No.103648) in the amount of
$2,159,580.00 and decreasing estimated receipts and appropriations in the Unspecified -All Funds
project (City Project No. UNSPEC) by the same amount, to effect a portion of Water's contribution to
the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
On June 14, 2022, Mayor and Council Communication (M&C 22-0412), the City Council authorized an
engineering agreement with Plummer Associates, Inc. (City Secretary No. 57712) in the amount of
$1,761,590.00 for the Mary's Creek Lift Station Site & Force Main Alignment project design and site
selection. The original scope of services consisted of an alignment study, the preparation of 60\% design
plans and specification for the proposed force main, lift stations site selection, design survey, geotechnical
investigations, title survey, easement document preparation, easement acquisition assistance and
coordination with various agencies. To expedite the project, the design of the force main was divided into
three sections: Section 1 (Confluence Lift Station to the Mary's Creek Water Reclamation Facility), Section
2 (Walnut Creek Lift Station to Confluence Lift Station) and Section 3 (Upper Clear Fork Lift Station to
Walnut Creek Lift Station). The agreement was subsequently revised by Amendment No. 1 in the amount
of $99,851.00 authorized administratively February 7, 2024, that provided additional topographic and
archaeological survey.
Amendment No. 2 provides for the following additional services on the project: final design of Sections 1,
2, and 3, geotechnical investigations, slope stability study, gabion structures design, storm water modeling
for lift station sites and environmental permitting.
It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY),
instead of within the annual budget ordinance, as projects commence, additional funding needs are
identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of
the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvement Program.

adoption of the attached appropriation ordinance, funds will be available in the Water & Sewer Bond
2020A Fund for the MC LS Site & FM Align project to support the above recommendations and execution
of the amendment. Prior to any expenditure being incurred, the Water Department has the responsibility of
verifying the availability of funds.
