HomeMy WebLinkAboutOrdinance 26910-05-2024Ordinance No. 26910-05-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER & SEWER BOND 2020A FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MARY' S CREEK LIFT STATION SITE & FORCE MAIN ALIGNMENT PROJECT (CITY PROJECT NO.103648) IN THE AMOUNT OF $2,159,580.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED -ALL FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2023 2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water & Sewer Bond 2020A Fund, by increasing estimated receipts and appropriations in the Mary's Creek Lift Station Site & Force Main Alignment project (City Project No.103648) in the amount of $2,159,580.00 and decreasing estimated receipts and appropriations in the Unspecified -Ail Funds project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of Amendment No. 2 to City Secretary Contract No. 57712, an engineering agreement with Plummer Associates, Inc. in the amount of $2,159,580.00 for the Mary's Creek Lift Station Site & Force Main Alignment project for a revised contract amount of $4,021,021.00; and 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Bond 2020A Fund by increasing estimated receipts and appropriations in the Mary's Creek Lift Station Site & Force Main Alignment project (City Project No.103648) in the amount of $2,159,580.00 and decreasing estimated receipts and appropriations in the Unspecified -All Funds project (City Project No. UNSPEC) by the same amount, to effect a portion of Water's contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: On June 14, 2022, Mayor and Council Communication (M&C 22-0412), the City Council authorized an engineering agreement with Plummer Associates, Inc. (City Secretary No. 57712) in the amount of $1,761,590.00 for the Mary's Creek Lift Station Site & Force Main Alignment project design and site selection. The original scope of services consisted of an alignment study, the preparation of 60% design plans and specification for the proposed force main, lift stations site selection, design surrey, geotechnical investigations, tide survey, easement document preparation, easement acquisition assistance and coordination with various agencies. To expedite the project, the design of the force main was divided into three sections: Section 1 (Confluence Lift Station to the Mary's Creek Water Reclamation Facility), Section 2 (Walnut Creek Lift Station to Confluence Lift Station) and Section 3 (Upper Clear Fork Lift Station to Walnut Creek Lift Station). The agreement was subsequently revised by Amendment No. 1 in the amount of $99,851.00 authorized administratively February 7, 2024, that provided additional topographic and archaeological survey. Amendment No. 2 provides for the following additional services on the project: final design of Sections 1, 2, and 3, geotechnical investigations, slope stability study, gabion structures design, storm water modeling for lift station sites and environmental permitting. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvement Program. FISCAL IM ORMATION_1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds Project, within the Water & Sewer Bond 2020A Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Water & Sewer Bond 2020A Fund for the MC LS Site & FM Align project to support the above recommendations and execution of the amendment.
