AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2022 BOND
PROGRAM FUND, BY INCREASING APPROPRIATIONS IN THE COOKS LANE
AND BRENTWOOD STAIR ROAD INTERSECTION IMPROVEMENTS
PROJECT (CITY PROJECT NO. 104035) IN THE AMOUNT OF $200,000.00 AND
DECREASING APPROPRIATIONS IN THE TRAFFIC SIGNALS
PROGRAMMABLE PROJECT (CITY PROJECT NO. PB0006) BY THE SAME
AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be adjusted appropriations in the 2022 Bond Program Fund, by
increasing appropriations in the Cooks Lane and Brentwood Stair Road Intersection Improvements project
(City Project No. 104035) in the amount of $200,000.00 and decreasing appropriations in the Traffic Signals
Programmable project (City Project No. P130006) by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

(CD 5) Adopt Appropriation Ordinance in the Amount of $200,000.00 to Provide Additional Funding for the Cooks Lane at Brentwood Stair Road
Highway Safety Improvement Project and Amend the Fiscal Years 2024-2028 Capital Improvement Program (2022 Bond Program)
RECOMMENDATION:
It is recommended that the City Council:
1. Adoptthe attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing appropriations in the
Cooks Lane and Brentwood Stair Road Intersection Improvements project (City Project No. 104035) in the amount of $200,000.00 and
decreasing appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount; and
2. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
The Cooks Lane and Brentwood Stair Road Intersection Improvement project (City Project No. 104035) is part of the Texas Department of
Transportation (CxDOT) Highway Safety Improvement Program (HSIP). The scope of this project includes constructing a new traffic signal,
installing accessible pedestrian signals (APS), Americans with Disabilities Act (ADA) ramps, and median modifications at the intersection of
Cooks Lane and Brentwood Stair Road. The City of Fort Worth is responsible for design, right-of-way, utilities, and project management.
The funding appropriated with this Mayor and Council Communication (M&C) will be used for project management, right-of-way, and utilities.
TxDOT will let this project in August 2024. As part of the Advanced Funding Agreement, the City is also responsible for cost overruns.
Funding forthis project was not included in the FY2024-2028 Capital Improvement Program (CIP) because the project and funding sources were
unknown at the time of its development. The action in this M&C will amend the Fiscal Year (FY) 2024-2028 Capital Improvement Program as
approved in connection with Ordinance 26453-09-2023.
Funding is budgeted in the 2022 Bond Program Fund for the TPW Dept Highway & Streets Department for the purpose of funding the Cooks Ln &
Brentwood Stair project.

FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Traffic Signals programmable project within the 2022 Bond Program Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the 2022 Bond
Program Fund for the Cooks Ln & Brentwood Stair project. Prior to expenditures being incurred, the Transportation & Public Works Department
has the responsibility to validate the availability of funds.
