AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE TRANSPORTATION IMPACT FEE CAPITAL
LEGACY FUND, IN THE AMOUNT OF $22,866.00, FROM AVAILABLE
INTEREST EARNINGS WITHIN THE REVENUE — SERVICE AREA L —
TRANSPORTATION IMPACT FEES PROTECT (CITY PROJECT NO. UN9918),
FOR THE PURPOSE OF FUNDING THE E. FIRST STREET (BEACH TO
OAKLAND) PROJECT (CITY PROJECT NO. C00145); PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fee Capital Legacy Fund in the amount of $22,866.00, from available Interest Earnings
within the Revenue — Service Area L — Transportation Impact Fees project (City Project No. UN9918), for
the purpose of funding the E. First Street (Beach to Oakland) project (City Project No. COO] 45).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Service Area L and Fund the E. First Street Project, Authorize the Clean -Up and Close -Out of City's Legacy Capital Project Funds and Amend the
Fiscal Years 2024-2028 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Capital Fund
in the amount of $103,450.26 from available Transportation Impact Fees and Interest Earnings within the Revenue — Service Area L —
Transportation Impact Fees project (City Project No. U N9918) for the purpose of funding the E. First Street (Beach to Oakland) project (City
Project No. C00145);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Trans Impact Fee Cap Legacy Fund in
the amount of $22,866.00 from available Interest Earnings within the Revenue — Service Area L — Transportation Impact Fees project (City
Project No. UN9918) for the purpose of funding the E. First Street (Beach to Oakland) project (City Project No. C00145);
3. Authorize the move of financial transactions from legacy capital project funds within the Street Improvements Fund to the corresponding new
capital project fund, General Capital Projects Fund to facilitate the clean-up and close-out of the City's legacy capital project funds; and
4. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to appropriate Transportation Impact Fee funds allowing for reclassification of
previous eligible expenditures in the E. First Street (Beach to Oakland) project (City Project No. C00145) thus eliminating the revenue balance in
Service Area L which has been a no fee service area since the adoption of the latest Transportation Impact Fee study in October, 2022 via M&C
22-0876. The E. First Street (Beach to Oakland) project was the last capital project completed in this service area that performed Transportation
Impact Fee eligible work, thus staff recommends appropriating these funds into this project. Staff will reclassify expenditures in the Street
Improvements fund creating residuals in the cumulative amount of $126,316.26.
Finally, the resulting residual balance will come from an unrestricted funding source of Contributions from Others allowing it to be moved into the
Unspecified - All Funds project (City Project No. UNSPEC) to provide additional resources for the delivery of future work.

Funding for this project was not included in the Fiscal Years 2024-2028 Capital Improvement Program (CIP) because the need to expend
Transportation Impact Fees in Revenue — Service Area L — Transportation Impact Fees project was not identified when the C I P was adopted. The
action in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-
2023.
Funding is budgeted in the Transportation Impact Fee Cap, Trans Impact Fee Cap Legacy and Street Improvements Funds for the purpose of
funding the E. First Street (Beach to Oakland) project.
The E. First Street (Beach to Oakland) project is located in COUNCIL DISTRICT 11.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that funds are currently available in the REVENUE - SA L - Transp Imp Fees project within the Transportation
Impact Fee Cap Fund and Trans Impact Fee Cap Legacy Fund and upon adoption of the attached appropriation ordinances, funds will be
available in the Transportation Impact Fee Cap Fund and Trans Impact Fee Cap Legacy Fund for the E. First Street (Beach to Oakland) and the
General Capital Projects Fund for the Unspecified - All Funds project. Prior to an expenditure being incurred, the Transportation & Public Works
Department has the responsibility of verifying the availability of funds.
