HomeMy WebLinkAboutOrdinance 26828-04-2024Ordinance No. 26828-04-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,300,000.00, FROM AVAILABLE PAYGO RESIDUALS, FOR THE PURPOSE OF FUNDING THE SANITARY SEWER MAIN REPLACEMENT CONTRACT 2022 PROJECT (CITY PROJECT NO. 103750); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $1,300,000.00, from available PayGo Residuals, for the purpose of funding the Sanitary Sewer Main Replacement Contract 2022 project (City Project No. 103750). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Schultz, Inc, dba Circle C Construction Company and Effect a Portion of Water's Contribution to the Fiscal Years 2024-2028 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $1,300,000.00, from available PayGo residuals, for the purpose of funding of the Sanitary Sewer Main Replacement Contract 2022 project (City Project No.103750) and to effect a portion of Water's Contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: On September 27, 2022, Mayor & Council Communication (M&C) (22-0733) the City Council authorized execution of a contract (City Secretary Contract No. 58500) in the amount of $1,000,000.00, with the option of three renewals, with William J. Schultz, Inc. dba Circle C Construction Company, for Sanitary Sewer Main Replacement Contract 2022. On October 17, 2023, Mayor & Council Communication (M&C 23=0882) the City Council authorized the appropriation of $1,300,000.00 for the first renewal of CSC 58500 for $1,000,000.00 and an additional $300,000.00 for project management, real property acquisitions, survey, material testing, and inspection. The City and the contractor desire to exercise the second renewal of the contract in the amount of $1,000,000.00. This M&C will appropriate the funding for the second renewal, plus staff costs. The work to be performed under this contract consists of repairing, replacing or relocating sewer mains and services. This project will have no impact on the future Water Department operating budget. In addition to the contract amount $300,000.00 is required for project management, real property acquisitions, survey, material testing, and inspection. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified and to comply with bond covenants. Circle C. Construction Co. agrees to maintain its initial MMIBE commitment of 8% that it made on the original contract and extend and maintain that same MNVBE commitment of 8% to this first change order. Therefore Circle C Construction Co. remains in compliance with the City's MMIBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous MANBE Commitment form executed by an authorized representative of its company. The project is located in ALL COUNCIL DISTRICTS. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified All -Funds project within the W&S Capital Projects Fund and upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for Sewer Main Replacement 2022 project.
