MAKING THIS ORDINANCE CUMULATIVE OF OTHER
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A SAVINGS CLAUSE, AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, on May 14, 2002, the City Council adopted City of Fort Worth
Ordinance No. 15095 providing for the adoption of per acre charges when certain criteria
are met; and
WHEREAS, the City of Fort Worth is constructing City initiated sewer mains L-
11968* from station 0 +00 to station 14 +90, L- 11958* from station 0 +00 to station 2 +60,
L- 11956* from station 0 +00 to station 2 +85, L- 11957* from station 0 +00 to station
5 +90, L- 11962* from station 0 +00 to station 3 +20, L- 11960* from station 0 +00 to
station 3 +14, L- 11961* from station 0 +00 to station 4 +60, L- 11966* from station 0 +00
to station 2 +78, L- 11965* from station 0 +00 to station 3 +20, L- 11964* from station
0 +00 to station 3 +60, L- 11967* from station 0 +00 to station 3 +30, L -7416 *EXT from
station 0 +00 to station 2 +40, L- 11953* from station 3 +82.37 to station 7 +41, L-
11950 *EXT from station 0 +00 to station 0 +75, L9734 *EXT from station 0 +00 to station

Sewer Main ") and such City initiated server main is 8 ".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
The City Council finds, in accordance with City of Fort Worth Ordinance No.
15095, the City is constructing a City initiated sewer main (the "Main ") to provide
wastewater service and that such Main is 8 ". Further, the City Council finds that the
Broadmoor Addition Sewer Main will serve a calculated sewer basin area of 66.31 acres,
such sewer basin being more fully described in the attached exhibit "A ", which is
attached hereto and made a part hereof for all purposes. These sewer mains are located in
the Broadmoor Addition in Council District #3.
SECTION 2.
The City Council finds that $1,351,166.00 is the Development Cost for the Main,
and that $20,377.00 is the per acre charge to be assessed within the calculated sewer
basin. The per acre charge will be waived for the existing development that is currently
served by septic systems in the Broadmoor Addition. This will encourage these residents
to tie into the public sewer system when it becomes available. The City will, however,
continue to assess per acre charges to new development. The City Council further finds
that the per acre charge has been calculated in accordance with the requirements of City
of Fort Worth Ordinance No. 15095.
SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
This ordinance shall be effective upon adoption.

Adoption of Ordinance for Sewer Per Acre Charge for Sewer Mains in the Broadmoor Addition
RECOMMENDATION:
It is recommended that the City Council adopt the sewer per acre for sewer mains in the Broadmoor
Addition ordinance and boundary maps to :
1. Establish $20,377.00 as the sewer per acre charge for the Broadmoor Addition Sewer Main; and
2. Establish the basin boundaries for these per acre charges to be assessed with payment of the
assessment to the Fort Worth Water Department.
DISCUSSION:
The Broadmoor Addition sanitary sewer main is being installed by the Fort Worth Water Department under
M &C C- 20520. This 8 -inch, 5,810 linear feet sewer main will serve a calculated sewer basin area of 66.31
acres.
The qualified costs used to establish the Broadmoor Addition per acre charge are engineering and
construction costs as outlined below:
Engineering Design Cost $140,019.00
Sewer Main Construction Cost $1,027,567.00
Roadway Construction Cost (POL) $183,580.00
TOTAL $1,351,166.00
The Broadmoor Addition per acre charge is $20,377.00 per acre.
It is also proposed to waive per acre charges for the existing development that is currently served by septic
systems in the Broadmoor Addition. This will encourage these residents to tie into the public sewer system
when it becomes available. The City will, however, continue to assess per acre charges to new
development.
These mains meet the criteria established under the per acre charge policy. There is no restriction to the
time period in which the per -acre charge will apply. Reimbursement will be to the Fort Worth Water
Department.
The Broadmoor Addition is located in Council District 5.

FISCAL INFORMATIONICERTIFICATION:
The Finance Director certifies that the Water Department is responsible for the collection and deposit of
funds due to the City as a result of this action.
