Purpose. This Mutual Aid Agreement (MAA) between Commander, Navy Region Southeast and the City of Fort Worth, Texas, Fort Worth Fire Department is for fire and emergency services mutually provided between Naval Air Station Joint Reserve Base, Fort Worth Fire and Emergency Services and Fort Worth Fire Department. The Parties enter into this MAA to provide for mutual response to emergencies when requested and within the scope of services provided by each Party's Fire and Emergency Services Department. 2. Backaround. The lands or districts comprising the Parties' respective jurisdictions are adjacent or contiguous to one another. Each Party maintains equipment and personnel for the response and mitigation of emergency incidents occurring within areas under their respective jurisdictions. 3. Scone. This Agreement covers the initial response by a Supporting Party's Fire and Emergency Services Department. The Requesting Party is not required to reimburse the Supporting Party for actions taking place under this Agreement. 4. Aereement/Understanding a. The Senior Officer of one of the Parties' Fire Departments may request assistance under the terms of this Agreement from the other Parties' Fire Department, whenever he or she deems it necessary to make such a request. Rendering assistance is not mandatory under this Agreement. However, the Party receiving the request for assistance shall immediately inform the Requesting Party if assistance cannot be rendered. Neither Party will hold the other Party liable or at fault for failing to respond to any request for assistance or for failing to respond to such a request in a timely manner or with less than the optimum number of personnel. c. The request for and rendering of mutual aid will be provided in accordance with the accompanied MAA Standard Operating Procedure/Guide developed by the Parties. The technical heads of each Party's Fire Department will work together to implement such plans and procedures in a manner compatible with the operational authorities of each. In the absence of more specific procedures, the Parties will generally proceed as follows: (1) The Senior Officer on duty of the Supporting Party will: (a) Immediately determine if the requested apparatus and personnel are available to respond to the call for assistance. (b) Dispatch such apparatus and personnel along with instructions as to their mission, use, and deployment in quantities and amounts in the judgment of the Supporting Party's Senior Officer, without jeopardizing the resources of the Supporting Party's mission. (c) Where local agencies do not assign an incident safety officer, a United States Navy representative will be assigned to act as the incident safety officer for Naval Air Station Joint Reserve Base, Fort Worth Fire and Emergency Services to observe Navy firefighting operations. (2) All plans that deal with fire protection services will adhere as closely as practical to the "nearest available unit" concept. (3) The Requesting Party's Senior Officer will normally assume full charge of the operations at the scene of the fire or other emergency under procedures agreed to by the technical heads of the Parties involved. A Supporting Party's Senior Officer may assume responsibility for the coordination of the overall operations at the scene of the fire or other emergency. (4) The Parties agree to use each entity's radio bandwidths assigned to them by the Federal Communications Commission for interoperability functions during mutual aid assistance and training. d. The Supporting Party will try to immediately inform the Requesting Party if the requested assistance cannot be provided and, if assistance can be provided, the quantity of such resources as may be dispatched to support the request. e. Personnel Protective Equipment (PPE ): Each Party shall provide its personnel with approved PPE suitable for the assignment. All PPE shall meet all Occupational Safety and Health Administration Standards. All personnel must respond with their approved PPE. f. Under reference (a), each Party waives all claims against the other Party for compensation of any loss, damage, personal injury, or death occurring in consequence of the performance of this Agreement. CUI Subj: MUTUAL AID AGREEMENT BETWEEN NAVAL AIR STATION JOINT RESERVE BASE FORT WORTH AND CITY OF FORT WORTH FOR FIREFIGHTING AND EMERGENCY SERVICE MUTUAL AID ASSISTANCE g. Each Party hereby agrees that its intent with respect to the rendering of assistance to the other Party under this Agreement is not to seek reimbursement from the Party requesting such assistance. Not withstanding the above, the Parties hereby recognize that pursuant to the Section 11 of the Federal Fire Prevention and Control Act of 1974 (15 U.S.C. § 2210) and Federal regulations issued there under (44 Code of Federal Regulations Part 151), Fort Worth is permitted to seek reimbursement for all or any part of its direct expenses and losses (defined as additional firefighting costs over normal operational costs) incurred in fighting fires on property under the jurisdiction of the United States. Furthermore, under the authority of 42 U.S.C. § 1856a, and pursuant to any applicable state or local laws each Party hereby reserves the right to seek reimbursement from the other for all or any part of the costs (defined as additional firefighting costs over normal operational costs) incurred by it in providing fire protection services to the other Party in response to a request for assistance. h. Third -Party Claims: If any claims for injury to person are asserted against a Party that arise or are alleged to arise out of the negligent or wrongful acts or omission of the United States, Department of the Navy or its officers, employees, or agents in connection with the performance of, or failure to perform, the obligations of this Agreement, the liability of the United States shall be determined, processed, and adjudicated in accordance with the provisions of the Federal Tort Claims Act. i. Nothing in this Agreement is intended by the Parties to diminish, waive, or otherwise affect the privileges and immunities conferred upon the Parties by operations of law. j. Each Party to this Agreement shall provide Workers' Compensation coverage as required by state or federal law, as applicable, for its own employees, without cost to the other Party. Neither Party shall be required to pay for salaries, other compensation, nor employment benefits for the employees of the other Party because of any work or services performed pursuant to this Agreement. 5. Emergencv Assistance. Independent of, and in addition to, any provisions of this Agreement, Naval Air Station Joint Reserve Base, Fort Worth is authorized and has the discretion to render disaster relief or emergency assistance to preserve life and property in the vicinity of a Department of Defense installation, when in the opinion of the installation commander, the assistance is in the best interest of the United States 42 U.S.C. §§ 5121-5206; DOD 3025.1-M, Manual for Civil Emergencies. 6. Definitions. Unless the particular provision or context otherwise requires, the definitions contained in this section shall govern the construction, meaning, and application of words used in this Agreement. a. Emergency Medical Service: Basic life support service, including paramedic service. b. Emergency Response: Immediate response and use of red lights and siren by responding units. c. Fire Protection Services: Firefighting capacity to contain, control, and extinguish fires; the mitigation of fire -related hazards; and emergency medical services. d. Incident Commander: The person in overall command at the incident as defined in the National Incident Management System. CUI CUI Subj: MUTUAL AID AGREEMENT BETWEEN NAVAL AIR STATION JOINT RESERVE BASE FORT WORTH AND CITY OF FORT WORTH FOR FIREFIGHTING AND EMERGENCY SERVICE MUTUAL AID ASSISTANCE e. Mutual Aid: The request of resources based on the needs determined by the managers of the incident and subject to authorization by the Supporting Party for each request. f. Nearest Available Fire Unit: The available fire apparatus of the appropriate type closest in dispatch and response time to the scene of the incident. Both parties agree to continuously strive to minimize unnecessary response delays to ensure that the integrity of the nearest available fire unit deployment strategy is achieved and maintained. g. Requesting Party: Any Party to this Agreement that requests support for Fire Protection or Emergency services within its jurisdiction. h. Supporting Party: Any Party to this Agreement that receives a request for Fire Protection or Emergency Services within the jurisdiction of the Requesting Party. 7. Trainine a. Whenever either Party hosts fire protection training it may, to the maximum extent practicable and subject to its sole discretion, offer to provide the same training to members of the other Party. b. The Host Department will not charge the Guest Department for any training provided under the terms of this Agreement, unless it is a cost that cannot be covered by the Host Department such as, cost per student or cost of a certificate. c. The Guest Department will be solely responsible for the payment of any and all costs necessary for their personnel to attend any training provided by the Host Department including lodging, meals, and travel. d. The Guest Department must ensure that its members observe all training rules, regulations, and guidelines provided by the Host Department. Neither Party will hold the other Party liable or at fault for damage or injury incurred during joint training activities. e. The Host Department reserves the right to deny training to any member who does not meet the prerequisites to attend the training. 8. Modification. The parties may amend this Agreement by mutual written consent of both parties, and will be recorded and published as addenda to this agreement. 9. Term. This Agreement will continue for a period of ten years from the effective date and the Parties will review it annually. 10. Termination. This Agreement may be terminated by mutual consent of the parties. This Agreement may also be terminated by any party with 60 days' notice to the other party. 11. Effective Date. This Agreement will become effective on the date of the last signature of the Parties. Date Installation Fire Chief Installation Commanding Office CUI AGREEMENT FOR AUTOMATIC ASSISTANCE This agreement is entered into this 1 I th day of November, 2023 by and between the City of Fort Worth and Naval Air Station (NAS) Joint Reserve Base (JRB), Forth Worth, hereafter referred to as "Fort Worth" and "NAS JRB" respectively. Fort Worth is a TEXAS municipal corporation and NAS JRB is a United States Navy Military Reservation. Each acts herein through their duly authorized officials. WITNESSETH: WHEREAS each of the parties hereto maintains equipment and personnel for the suppression of fires within its own jurisdiction and areas, and WHEREAS the parties hereto desire to augment the fire protection available in their various establishments, properties, districts, agencies, and municipalities in the event of large fires or conflagrations, and WHEREAS the lands or districts of the parties hereto are adjacent or contiguous so that mutual assistance in a fire emergency is deemed feasible, and WHEREAS the governing officials of the governmental entities set forth above, Fort Worth, being a political subdivision of the State of Texas, and NAS JRB, being a military installation of the United States of America, desire to secure for each such entity the benefits of assistance in the protection of life and property from fire and other disasters, and WHEREAS it is the policy of the Department of the Navy and of the municipalities or other districts of their own governing bodies to conclude such agreements whenever practicable. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. In consideration of each party's automatic assistance to the other upon the occurrence of an emergency condition in any portion of the designated area where the Agreement for Automatic Assistance is in effect, a predetermined number of firefighting equipment, emergency medical equipment, or personnel of both parties shall be dispatched to such a point where the emergency condition exist in order to assist in the protection of life and property subject to the conditions herein stated. For the purpose of this agreement, "Emergency Condition" shall include any conditions requiring fire protection, emergency medical services, or both. a. Details as to amounts and types of assistance to be dispatched, methods of dispatching and communications, training program/procedures, and areas to be assisted will be developed via the Fire Chief of Fort Worth and the Fire Chief of NAS JRB. These details will be stipulated in a Memorandum of Understanding (MOU) and signed by both Fire Chiefs. Said MOU may be revised and/or amended at any time by mutual written agreements of both Fire Chiefs. Modifications made to the MOU must subsequently be approved by the City of Fort Worth Fire Chief and the NAS JRB Commanding Officer. Most recent version of the MOU will remain in effect until the modifications are approved by the City of Fort Worth Fire Chief and the NAS JRB Commanding Officer. CUI Enclosure (1) CUI 2. NAS JRB Fire Rescue and Firefighting equipment is authorized to respond automatically and proceed to the location of military aircraft crash/ mishap or emergencies which may occur in outlying areas within the limits of the City of Fort Worth, Texas. The use of emergency lights and sirens on such equipment as necessary to expedite response and enhance overall safety in responding to such aircraft crash/mishap or other emergencies is authorized. 3. Any dispatch of equipment and/or personnel pursuant to this agreement is subject to the following conditions: a. The predetermined amount of aid, type of equipment, and number of personnel shall be sent unless such amount of assistance is unavailable due to other emergency conditions or operational requirements confronting either party's forces at the time of need for assistance under this agreement. b. In fulfilling their respective obligations provided for in this agreement, both parties shall comply with the procedures set forth in the MOU, attached hereto. 4. Each party to this agreement waives all claims against the other party for compensation for any loss, damage, personal injury, and/or death occurring as a consequence of the performance of this agreement. 5. Neither party shall be reimbursed by the other for cost incurred pursuant to this agreement. Personnel who are assigned, designated, or ordered by their governing body to perform duties pursuant to this agreement shall receive the same wages, salary, pension, and all other compensations and rights for the performance of such duties, including injury or death benefits and worker's compensation benefits, as though the service had been rendered within jurisdictional limits of the entity where he she is regularly employed. Moreover, all medical expenses, wages and disability payments, pension payments, damage to equipment and uniforms, expenses for travel, and food and lodging shall be paid by the entity in which the employee in question is regularly employed. a. All equipment used by each party's fire department in carrying out this agreement will, during the time which response services are being performed, be owned by it, and all personnel acting for the parties' fire department under this agreement will, during the time response services are required, be paid firefighters of the fire department of the party where they are regularly employed. b. At all times while equipment and personnel of either party's fire department are traveling to, from, or within the geographical limits of the other party in accordance with the terms of this agreement, such personnel and equipment shall be deemed to be employed or used, as the cases may be, under full authority of their respective Fire Chief and/or Senior Fire Officer. Furthermore, such equipment and personnel shall be deemed to be engaging in a governmental function of its governmental entity. 7. In the event any individual performing duties subject to this agreement shall be cited as a defendant party to any state of federal civil lawsuit, such individual shall be entitled to the same benefits that he/she would be entitled to receive as a member of his/her respective department and had such occurred within the jurisdiction of the governmental entity where regularly employed. The benefits described in this paragraph shall be supplied by the party by whom the individual is regularly employed. However, in situations where the other party may be liable, in whole or part, for the payment of damages, then the other party may intervene in such cause of action to protect interest. CUI Enclosure (1) 2 CUI 8. It is agreed by and between the parties hereto that either party shall have the right to terminate this agreement upon a sixty-day written notice to the other party. However, NAS JRB may terminate this agreement without prior notice if required by federal law, national emergency, military necessity, or as a result of a departmental or installation closure. All reasonable efforts will be made to inform Fort Worth of impending termination, 9. This agreement shall be governed by and constructed according to the laws of the United States. For any and all legal actions and/orclaims arising out of or under this agreement, exclusive venue shall lie in the appropriate United States District Court. NAS JRB is a federal entity and not a municipality, local government, or political subdivision of the State of Texas as defined or as included in Texas Government Code 791.003. 10. In case one or more of the provisions contained in this agreement shall be for any reason held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision thereof and this agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. 11. Nothing in this agreement is intended to limit the availability of benefits to each party's personnel under Article 6228 of the Revised Civil Statutes of Texas, and Title 5, United States Code, Chapter 83, Subchapter 11[, as amended, and as may be amended in the future. 12. NAS JRB is a federal military installation with primarily exclusive federal legislative jurisdiction. Nothing in this agreement cedes, waives, relinquishes, or abdicates or is intended to cede, waive, relinquish, or abdicate any other federal jurisdiction, weather exclusive, concurrent, or partial, or any other federal control that exist, or exist in the future, within the boundaries of NAS JRB, to the State of Texas, or any of its political subdivisions, offices, and/or agents. 13. This agreement does not grant any license, easement, or property right or entitlement outside of those specified herein, to any party. 14. Nothing in this agreement shall be constructed to obligate NAS JRB or the federal government to expenditure or obligation of funds, property or money, in excess or in advance of appropriations, or contrary to or in violation of federal fiscal law and regulations, including the Anti -Deficiency Act. 15. Amendments and modifications to this agreement may be made in writing by mutual consent and acknowledgment of both parties. Requirements imposed on NAS JRB by the United States Congress, an appropriate federal Executive Branch official, or judicial decree, which requires NAS JRB to act contrary to or in a manner which inherently modifies, the terms or conditions herein will not require prior written consent of Fort Worth. NAS JRB reserves the right to limit its responsibilities under this agreement without prior notice as required by federal law, by the Department of Defense and/or Department of Navy regulations, directives, instructions, or as a result of NAS JRB mission requirements or military operational necessity. In such cases, NAS JRB will notify Fort Worth within a reasonable time not to exceed ten days after the imposition of such a requirement. 16. The following specifies said amounts and types of assistance, methods of dispatching, communications, training programs and procedures and areas to be assisted. The specific terms for this memorandum of understanding are: CUI Enclosure ( 1) CUI a. Upon receipt of a 1 alarm assignment request by NAS JRB, Fort Worth will dispatch two engine companies, one truck company, and a Battalion Chief with a minimum staffing of ten personnel. b. To back up the NAS JRB fire station, Fort Worth will send one engine company with a minimum staffing of three personnel. c. Upon receipt of automatic aid into the City of Fort Worth, NAS JRB will dispatch one engine company or truck company with a minimum staffing of four personnel. d. NAS JRB will purchase alerting and communications equipment, including two portable radios, that will be configured in such a way as to be able to operate in the Fort Worth communications system. One portable radio will be issued to the NAS JRB and the other to the NAS JRB Law Enforcement. Fort Worth will program said communications equipment. Once this is accomplished, NAS JRB will be in the Fort Worth Computer Aided Dispatch system and be dispatched through the Fort Worth Fire Alarm Office. c. NAS JRB will have up to two ARFF vehicles and staffing available for use by Fort Worth. f. NAS JRB will have up to one Heavy Rescue -.-'hazardous materials vehicle and staffing available for use by Fort Worth. g. NAS JRB will have up to one Engine Company vehicle and staffing available for use by Fort Worth for Active Shooter/Hostile Event incidents. h. Training opportunities: Fort Worth will extend training opportunities to NAS JRB personnel on a regular basis so that they become familiar with the Incident Command System; tactics and strategy, and equipment as used by Fort Worth. NAS JRB will make available, their Aircraft Rescue and Fire Fighting apparatus for the training of Fort Worth. CUI Enclosure (1) 4 CUI 17. WORTH, TX CUI Enclosure (1) 5 CUI NAVAL AIR STATION JOINT RESERVE BASE, FORT WORTH FIRE AND EMERGENCY SERVICES Standard Operating Guideline (SOG) 15 April 2023 SOG42 Off Base Response • To establish basic guidelines to be followed in dispatching personnel and equipment for off -base responses regardless of mission i.e. structural, Emergency Medical Service (EMS), etc. These procedures are in accordance with OPNAV I I320.23G and the Naval Air Station Joint Reserve Base Fort Worth (NASJRBFTW) Emergency Management (EM) Plan. • The procedures for off -base response will be followed accurately to ensure adequate resources are maintained on base. The Senior Fire Officer (SFO), i.e. Fire Chief (FC) or Assistant Chief (AC) for Operations (OPS) will determine initial response and/ or additional equipment requests. • Automatic/Mutual Aid Note: The NASJRBFTW Fire and Emergency Services (F&ES) has 2x automatic aid agreements (Lockheed Martin and Fort Worth) plus 5x additional mutual aid agreements (Benbrook, Lake Worth, River Oaks, Sansom Park, and White Settlement) along with a support agreement with MedStar for EMS. • Automatic Aid will be supported upon receipt of the alarm with the SFO providing a follow-on call the Command Duty Officer (CDO) on supporting off -base. • Upon receipt of a request for an off -base mutual aid response, the Regional Dispatch Center (RDC) will tone out the information and direct crews to standby for authorization and immediately request authorization from SFO on duty for vehicles/personnel to respond off base (off base is defined as any area not under control by Master of Arms (MA) and/or within the fence line of NASJRBFTW). • The SFO will determine the base firefighting capability and obtain authorization to respond from the NASJRBFTW Commanding Officer (CO) `Executive Officer (XO). Note: Regardless of staffing Ievels, authorization from the CO/XO must be obtained, and the capability to allow an off base response of vehicles and personnel will continue. if authorization from the NASJRBFTW COXO has not been received or capability does not allow for adequate coverage of base assets, the SFO will advise crews to stand down and notify requesting agency of non -availability of NASJRBFTW vehicles/personnel. • The FC will be notified immediately of any off -base dispatch of equipment and personnel by dispatch. • For mutual aid vehicle accidents when approval has been granted by the NASJRBFTW CO. F&ES vehicles will respond to the rally point to be established by NASJRBFTW MA, vehicles will then convey to the incident under direction of the Senior MA member on duty. • At no time will the base be depleted of adequate vehicles or personnel. The SFO on base has the responsibility to hold response of NASJRBFTW F&ES assets until it is verified that remaining assets can fully support mission requirements. The NASJRBFTW CO/XO has the authority to amend this requirement if he/she deems appropriate but only after being fully briefed by SFO on current capabilities and limitations. CUI Enclosure (2) CUI • The SFO will try to determine the validity of the call, distance off base, number of people requested and how long personnel will be off base: Initiate recall if necessary to provide coverage for the base. • Company Officers are directly responsible for their assigned equipment and personnel. A Safety Officer (SO) will be designated for every emergency (normally SFO on scene). • Equipment and personnel will not leave the scene until relieved by the Incident Commander, unless an emergency on base dictates their immediate return. As a minimum, the SFO from the base shall coordinate with the senior civilian firefighter on scene before base units depart the incident. • Upon notification of an off base Department of the Navy (DoN) emergency i.e., aerospace vehicle crash, convoy vehicle fire, etc.; the RDC operator will notify the SFO. • The SFO along with the FC will determine if response of base fire crews is advisablefwarranted. The SFO will ensure the NASJRBFTW CO.,'XO has authorized the response before proceeding past any gate. • F&ES vehiclesfpersonnel will respond in convoy as part of an initial response element to include MA and Medic Unit. • The SFO on -duty is responsible for ensuring the safety of DoN F&ES members when responding to off -base incidents. For all fire or hazardous material responses the SFO will dispatch a qualified individual to serve as Incident Safety Officer (ISO). This individual will be at a minimum Fire Officer I qualified. Individuals who have received National Fire Protection Association (NFPA) ISO Certification are preferred. If necessary recall key personnel to provide coverage for the base, do not delay the initial response. The Healthcare Support Office (HSO) will normally respond to all off -base incidents as the SO. The SO is tasked solely with observation duties and has the authority to stop an operation should the safety of personnel be in jeopardy. The SO will not become involved with the incident management, (i.e. issuing tactical orders). The HSO is responsible for establishing an annual survey of the area surrounding the base to identify and fully understand potential hazards or target areas that we could be called on to provide mutual aid or assistance to civil incidents. DISCUSSION: The City of Fort Worth and the Naval Air Station Joint Reserve Base, Fort Worth Fire Departments have agreed in principle to Mutual and Automatic Aid Agreements for fire services. The Texas Government Code, Chapter 791, authorizes local government entities to enter into Interlocal Agreements for fire services. Neighboring fire departments often enter into Mutual and Automatic Aid Agreements to augment emergency response resources at major incidents or to gain emergency response efficiencies in areas where adjacent jurisdiction resources are located in close proximity. Under the terms of the Agreement, automatic aid will be provided in specified geographic areas where the other jurisdiction's resources are in closer proximity than the jurisdiction in which the call originates. For automatic aid, the partnering agency will be dispatched directly to the emergency. Mutual aid will be provided in specified geographic areas upon request of the jurisdiction in which the call originates. The incidents specified in the Agreement for response include structure fires and emergency medical incidents. When either party responds to an incident in the other's jurisdiction, the responding party will remain at the incident until the other party, or any other appropriate first responder entity, arrives and relieves the responding party of its duties. This Agreement is consistent with the numerous other Agreements between the City of Fort Worth and adjoining jurisdictions for fire services. This agreement will serve ALL COUNCIL DISTRICTS.
