AN ORDINANCE VACATING AND EXTINGUISHING A PORTION
OF BRYCE AVENUE ADJACENT TO THE SOUTHEAST CORNER
OF L OT 6 -R-1, B LOCK D, C HAMBERLIN A RLiNGTON H EIGHTS
ADDITION AND BETNG APPROXIMATELY 66 FT LONG AND 6 FT
WIDE AND CONTAINING 38S SQUARE FEET, MORE OR LESS;
PROVIDING FOR T1IE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT 1`IEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF FORT WORTH,
TEXAS a
SECTION 1.
That a portion of Bryce Ave adjacent to the southeast corner of Lot 6-R-1, Block D,
Chamberlin Arlington Heights being approximately 6b ft long and G ft wide, and containing 385
square feet, more or less as shown on the plat thereof recorded in Voluame 1.271., Page 283 of the
Tarrant County Plat Records, and as more specifically described in Exhibit "A" attached hereto
and incorporated herein by reference, be and the same is vacated and extinguished.
SECTION 2.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 3.
That the fee to the land in the above-described street and alley rights-of-way is released and
shall revert to the adjacent owner as provided bylaw.
SEC'T'ION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTIOI®i 5.
That this ordinance sha11 take effect upon adoption.

Being a 0.009 acres (385 sq.ft.) tract of land situated in the J. Kinder Survey, Abstract No.
893, Tarrant County, Texas, and being a part of the City of Fart Worth, Right of Way of
Bryce Avenue. Said 0.009 acres tract of land being more particularly described by metes
and bounds as follows:
Beginlning at a 1!2 inch iron rod found on the west right of way line of Merrick Street (a
variable width right of way), same being at the-north right of way line of Bryce Avenue (a
variable width right of way), and also being at the southeast corner of Lat 6-R-1, Block D,
revised plat of Chamberlain Arlington Heights, as shown on. plat recorded in .Cabinet A,
Slide 8826, Plat Records of Tarrant County, Texas;
Thence departing said corner, over and across. said Right of Way of Bryce Avenue, the
following courses and distances:
South 18°00'00" West, a distance of 6.22- feet to a point for carnet;
North 89°58'25" West, a distance of 64.14 feet to an axle found for corner;
Thence slang said north right of way line, same being on the south line of said Lot 6-R-1,
Black D, the following courses and distances:

North 00°39`25" East, a distance of 5.92 feet to a paint for corner;
South 89°58'25" East, a distance of 66.00 feet to the Place of Begir9ning,-and

Adopt Ordinance Vacating a Portion of Bryce Avenue Adjacent to the Southeast Corner of Lot 6-R-
1, Block D, Chamberlin Arlington Heights Addition
RECOMMENDATION:
It is recommended that the City Council adopt ordinance vacating a portion of Bryce Avenue being
approximately fi feet wide and 6E feet long, containing approximately 385 square feet and being adjacent to
the southeast corner of Lot 6-R-1, Block D, Chamberlin Arlington Heights as recorded in the Tarrant County
Deed Records, Volume 1271, Page 283.
DISCUSSION,
Justin Welborn of Teague Nall & Perkins, acting on behalf of Michael Dike for Vipage Homes, has
requested vacation of the above referenced excess right-ofi way in order to replat it with adjacent property to
create an enhanced lot for building.The Engineering Department, -Rea[ Property Services Division, states
that the purchase fee of $1,338.00 has been received. The City Plan Commission recommended approval
of this request at its meeting on June 23, 2004. Reviewing City departments have no objections to this
request. An acceptable replat has been received (see Exhibit B: FP-04-111, attached).This request is
located in Council District 7.
