AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATI=R CAPITAL PROJECT FUND IN THE AMOUNT OF $8,894 AND THE SI=WER
CAPITAL PROJECT FUND IN THE AMOUNT OF $21,144 FROM AVAILABLE FUNDS
FOR THE PURPOSE OF FUNDING AMENDMI=NT NO. 1 TO CITY SECRETARY
CONTRACT NO. 30321 WITH LOPEZGARCIA GROUP, INC. FOR ADDITIONAL DESIGN
AND SURVEY SERVICES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED t3Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That In addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $8,894 and the Sewer Capital Project Fund in the amount of
$21,144 from available funds for the purpose of funding Amendment No. 1 to City Secretary Contract No.
30321 with LopezGarcia Group, Inc. for additional design and survey services
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way
impair the remaining portions, sections, nr parts of sections of this ordinance, which said rerr~aining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations
amending the same except in #hnse instances where the provisions of this ordinance are in direct conflic#
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.

Adapt Appropriation Ordinance and Authorize the Execution of Amendment No. 1 to Engineering
Agreement with LopezGarcia Group, Inc., for Water and Sanitary Sewer Replacement Contract

RECQMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $30,038.00 from the Water and Sewer Operating Fund to the Water Capital
Project l=and in the amount of $8,894.00 and the Sewer Capital Project Fund in the amount of $21,144.00;
2. Adopt appropriation ordinance increasing estimated receipts and appropriations in the Water Capital
Project l=and in the amount of $8,894.00 and the Sewer Capital Project Fund in the amount of $21,144.00
from available funds; and
3. Authorize the City Manager to execute Amendment Na. 1 to City Secretary Contract No. 30321 with
LopezGarcia Group, Inc., in the amount of $30,038.00, to provide far additional design and survey services,
thereby increasing the contract amount to $154,147.00.
DISCUSSION:
On July 20, 2004 (M&C C-2{}168), the City Council authorized the City Manager to execute an engineering
agreement with LopezGarcia Group, Inc., in the amount of $124,109.00 for the design of Water and
Sanitary Sewer Replacement Contract 2004 STM-l3.
In order to increase the level of water service delivery to customers, it is necessary to extend and connect
(loop) two existing dead end water mains located an Angle Avenue and Columbus Avenue to an existing
water main located on Loving Avenue.
The amendment wil[ also allow far the relocation of sanitary sewer lateral L-3489 and sewer main M-111
which currently traverse across private property near 35th S#reet and 36th Street, to be relocated into public
right-of-way on the identified roadways. All connecting sewer service lines will be relocated to the new
sewer mains.
LopezGarcia Group, Inc., proposes to provide the necessary additional engineering services for a lump sum
fee of $30,038.00. Staff considers this amount to be fair and reasanable_
This project is located in COUNCIL DISTRICT 2, Mapsco 48Y, 63A and 77A.

The Finance Director certifies that upon approval and completion of recommendation one and the adoption
