HomeMy WebLinkAboutContract 52922-A4 (2)CSC No. 52922-A4 AMENDMENT No.4 TO CITY SECRETARY CONTRACT No. 52922 WHEREAS, the City of Fort Worth (CITY) and The Landscape Alliance, (ENGINEER) made and entered into City Secretary Contract No. 52922,(the CONTRACT) which was administratively authorized on the 11th day of October, 2019 in the amount of $81,827.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $250,664.00 which was authorized by M&C #20-0775 on October 20, 2020.; Amendment No. 2 in the amount of $26,560.00 which was administratively authorized on February 20, 2022; Amendment No. 3 in the amount of $20,838.00 which was administratively authorized on April 6, 2022.; and WHEREAS, the CONTRACT involves engineering services for the following project: Marine Creek Ranch Park Project, CPN 102225; and WHEREAS, it has become necessary to execute Amendment Number 4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $19,818.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $$399,707.00. 1911 All other provisions of the Contract, which are not expressly OFFICIAL RECORD CITY SECRETARY amended herein, shall remain in full force and effect. Detention Pond Rating Tables: Preparation of rating tables for the detention pond at 1' depth intervals (elevation vs area vs volume and elevation vs release rate at each elevation) ■ Civil Project Engineer (PL6) — 2 hours (review). ■ Civil Project Engineer (PL4) — 6 hours. Detention Pond Cross Sections: Preparation of two cross sections of the detention pond ■ Civil Project Engineer (PL4) — 2 hours. ■ Civil EIT (PL2) — 10 hours. Lump sum fee of $19,818.00 (Nineteen Thousand Eight Hundred and Eighteen REIMBURSABLE EXPENSES: N/A SCHEDULE: N/A Except as expressly modified herein, no other provisions of the Agreement between the Architect and Client are affected or modified by this Amendment, and all such provisions in the Agreement shall apply to this Amendment. The Agreement, as amended by this Amendment, shall remain in full force and effect. This Amendment, together with the Agreement and any other amendments duly executed by the parties, constitutes the entire agreement and understanding between the Architect and Client, concerning the subject matter thereof. This Amendment may be executed and delivered (including by facsimile or Portable Document Format (.pdf) transmission) in several counterparts, each of which shall be fully effective as an original and all of which together shall constitute one and the same instrument. Facsimile and other electronic copies of manually or electronically signed originals shall have the same effect as manually -signed originals and shall be binding on the undersigned parties. You may indicate your acceptance of this Amendment by returning one signed copy to our office. Unless another date is specified, we will consider receipt of this Amendment as authorization to proceed.
