FIRSTAMENDMENT TO THE PARKINGLOTLEASE
AGREEMENT BETWEEN THE CITY OF FORT WORTH
AND
LANTER DELIVERY SYSTEMS, L L C
This First Amendment to the Lease Agreement (City Secretary Contract No. 57072)
("First Amendment") is made and entered into by and between the City of Fort Worth, a home -rule
municipal corporation of the State of Texas ("City"), acting by and through its duly authorized
Assistant City Manager, Dana Burghdoff, and Lanter Delivery Systems, LLC, a limited liability
company, acting by and through its duly authorized Executive Vice Presider,
Steve Lodewvck ("Tenant").
WHEREAS, the City and Tenant entered into a certain Parking Lot Lease
Agreement ("Lease") dated February 1, 2022 (City Secretary Contract No. 57072) to lease
approximately four (4) acres of the parking lot at the Alliance Fort Worth Maintenance
Facility located at 2000 Eagle Parkway, Fort Worth, Texas, 76177 to be used for trailer
parking, more particularly described in the Lease Agreement ("Lot"); and
WHEREAS, Landlord has requested and the Tenant agrees to relocate the Lot
to the opposite end of the existing parking lot.
NOW THEREFORE, in consideration of the covenants and agreements set forth
in the Lease and herein, Landlord and Tenant agree to amend the Lease as follows:
Exhibit A, titled "Site Plan" is deleted in its entirety and replaced with the new Exhibit A that reflects
the new location of the Lot.

Section 6, titled "Alterations, Additions, Improvements and Signage" of the Lease is deleted in its
entirety and replaced with the following:
6. Alterations, Additions, Improvements, and Signage.
(a) General Guidelines. Tenant shall make no alterations on or additions to the Lot without
the prior written consent of City. Any alterations made to the Lot by the Tenant shall be at Tenant's
sole cost and expense and shall not interfere with the operations of other tenants and/or other
operations at the Alliance Maintenance Facility. If interference occurs Tenant will make changes
and/or remove the alteration to remedy said interference within 5 days of notice from City. All
alterations, additions and improvements made to or fixtures or other improvements placed in or
upon the Lot shall be deemed a part of the Lot and the property of City at the end of the Lease Term.
All such alterations, additions, improvements, and fixtures shall remain upon and be surrendered
with the Lot as a part thereof at the termination of this Lease. Tenant may at its sole option and
expense remove any Tenant alterations at any time during the Lease Term with City approval. At the
termination of this Lease, whether by lapse of time or otherwise, Tenant shall (i) deliver the Lot to

City in as good a condition as the same was as of the date of the taking of possession thereof by
Tenant, subject only to ordinary wear and tear and damage caused by casualty or condemnation and
(ii) upon City request, remove any alterations and make any repairs to the Lot as needed in order to
comply with the provisions of Section 13 below.
(b) Removing the Existing Fence. The Tenant agrees to remove and dispose of the fence
located on the Lot at Tenant's sole cost and expense.
(c) Constructing a Barrier. In addition to removing the existing fence located on the Lot,
the Tenant agrees to construct a demising structure on the East side of the Lot as agreed upon by the
City and at Tenant's sole cost and expense. The new demising structure shall adhere to all local
regulations and existing standards and must be constructed with materials of suitable quality as
assessed by the City.
All other terms and conditions of the Lease shall remain unchanged and in hill force and
effect.

SUBJECT: (CD 10) Authorize the Execution of an Amendment to the Parking Lot Lease Agreement
with Lanter Delivery Systems, LLC to Relocate their Assigned Parking Location from the
East Side to the West Side of Lot A Located at the Alliance Maintenance Base
RECOMMENDATION:
It is recommended that the City Council authorize the execution of an amendment to the Parking Lot
Lease Agreement with Lanter Delivery Systems, LLC to relocate their assigned parking location from
the east side to the west side of Lot A located at the Alliance Maintenance Base.
DISCUSSION:
On February 1, 2022, the City of Fort Worth (City) entered into a Parking Lot Lease Agreement
(Agreement) as City Secretary Contract 57072 (Mayor & Council Communication 22-0074) with Lanter
Delivery Systems, LLC (Lanter), to lease approximately four (4) acres of parking space located at the
Alliance Fort Worth Maintenance Base (Base) for commercial truck trailer parking.
To accommodate the parking location preference of an adjacent tenant at the Base, Lanter was
asked and has agreed to relocate their commercial truck parking from the east side to the west side of
Lot A located at the Base.
Lanter has agreed to remove and dispose of an existing fence and to construct a new demising
structure on the east portion of Lot A at its sole cost and expense.
There are no changes to any of the existing terms of the Agreement other than the location of the
parking area and the replacement of an existing fence with a new demising structure.
This property is located in Council District 10.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that the approval of this recommendation will have no material effect
on City funds.
