Date Received: 6/18/2024 Time Received: 11:51 a.m. Permit No.: SWFMA-24-0034 City Secretary No.: 60195-A1 AMENDMENT TO CITY SECRETARY CONTRACT NO. 60195 STORMWATER FACILITY MAINTENANCE AGREEMENT This AMENDMENT TO CITY SECRETARY CONTRACT NO. 60195, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City", and Lowe's Home Centers, LLC "Landowner", acting herein by and through its duly authorized representative Richard Goodman as Vice President of Engineering & Construction. RECITALS WHEREAS, the City of Fort Worth ("City") and Hunter Crossroads, LP ("Previous Landowner") made and entered into City Secretary Contract No. 60195 (the "Agreement") to authorize the use of on -site stormwater management facilities (the "Facility") to be constructed and maintained on a portion of Landowner's property; and WHEREAS, the Agreement was recorded with the property records of the Tarrant County as Document No. D223179524 which is one and the same as City Secretary Contract 60195. WHEREAS, the Agreement contains exhibits "A" and `B" that depict the location and design specifications of the Facility; and WHEREAS, the Agreement also contains exhibits "C" and "D" that provide for the Facility's operation and maintenance plan; and WHEREAS, it advisable to execute this Amendment to the Agreement to revise exhibits "A, ""B," "C," and "D" in the Agreement to depict changes in location and design changes being added OFFICIAL RECORD Revised 03/01/2022 BN Page 1 of 8 CITY SECRETARY FT. WORTH, TX to the original agreement and to update the Facility's operation and maintenance plan; and NOW THEREFORE, City and Landowner, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement, consisting of a revised location description of the Facility. 2. Exhibit B is hereby replaced with Exhibit B-1 attached hereto and incorporated herein to the Agreement, consisting of revised design specifications of the Facility. 3. Exhibit C is hereby replaced with Exhibit C-1 attached hereto and incorporated herein to the Agreement, consisting of an updated operation and maintenance plan for the Facility. 4. Exhibit D is hereby replaced with Exhibit D-1 attached hereto and incorporated herein to the Agreement, consisting of an updated maintenance checklist for the Facility. 5. This Amendment shall be filed with the City Secretary as an amendment to the Agreement and also recorded among the land records of Tarrant County, Texas, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs and any other successors in interests, including any property owners association. 4. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. General Maintenance Procedures The structural and functional integrity of the Facility shall be maintained at all times by removing and preventing drainage interference, obstructions, blockages, or other adverse effects into, through, or out of the system. Periodic silt removal shall occur when standing water conditions occur or the facilities storage volume is reduced by more than 10%. Silt shall be removed and the facility returned to original working condition of the lines and grades shown on the approved engineering plans. In addition, corrective measures are required any time a facility does not drain completely within 72 hours of cessation of inflow. NO STANDING WATER IS ALLOWED in the underground facility designed for dry detention purposes. Accumulated litter, sediment, and debris shall be removed every 6 months or as necessary to maintain proper operation of the facility. Disposal shall be in accordance with federal, state and local regulations. To prevent debris from entering and clogging the downstream storm sewer system a wire mesh screen or similar screening device shall be installed over the outlet until final acceptance. 4. PREVENTIVE MAINTENANCE/INSPECTION • Visual inspections of all components will be conducted every 6 months. • A log shall be kept of maintenance actions, and inspections. The log should document the condition of the detention system's primary components, silt, litter and debris removal dates. • Written maintenance and repair records shall be maintained by the party or parties signing the attached Agreement and shall be provided to the City upon request.
