HomeMy WebLinkAboutContract 56603-A2CSC No. 56603-A2 AMENDMENT No . 2 TO CITY SECRETARY CONTRACT No. 56603 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc., (ENGINEER) made and entered into City Secretary Contract No. 56603, (the CONTRACT) which was authorized M&C 21-0770 on the 28th day of September, 2021, in the amount of $1,291,465.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No.l in the amount of $40,193.00 administratively authorized on May 9, 2022; and WHEREAS, the CONTRACT involves engineering services for the following project: West Fork Collector Parallel, Phase I - Trinity River Siphon to Walker Branch Connection, CPN 102652; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $613,052.00 (Sewer). 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,944,710.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Two separate areas of bank erosion will be protected and are defined as: Area 4 — Levee bank protection and Area 5 — Outfall bank protection. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Task Nos. 1-10 previously defined under the original contract and Amendment No.1 The purpose of this amendment is to amend the original contract by including additional effort for: Plan development of Area 4 (Brank Protection) and Area 5 (Outfall Protection), adjacent to the Village Creek Water Reclamation Facility (VCWRF) as outlined in the WFTR Geomorphic Assessment, dated October 2022 performed by FNI (refer to Exhibits 1-3). WORK TO BE PERFORMED TASK 11. AREA 4 BANK PROTECTION AND AREA 5 OUTFALL PROTECTION PLAN DEVELOPMENT. The purpose of the amendment is to address substantial erosion along right bank (looking downstream) that threaten the Fort Worth Biosolids facility levee and the VCWRF outfall structure. Under current conditions erosion could cause failure of the levee and outfall structure leaving the facility susceptible to flooding or without the opportunity to discharge into the WFTR shutting down the facility. This scope includes development of the recommendation proposed in the WFTR Geomorphic Assessment, dated October 2022 (see attached Exhibits 1-3). The following scope is in addition to the original geomorphic assessment and is included for the plan development for Area 4 and Area 5: 11.1. Project Management • Manage the project including coordination with third parties, up to 8 internal design meetings with design team, 6 meetings with the CITY, and one site visit. Internal and external kick-off meetings included in totals. Meetings shall be in - person or via teleconference. Maintain project schedule and update as needed based on project progress. • Up to 14 monthly communication and reporting of status of project to CITY. Data Collection / Site Visit Data Collection - FNI to review site information and coordinate with the City to obtain the most current and appropriate data for the site as needed. FNI to review all available existing data provided including: • Current regulatory hydrologic and hydraulic models. • Any available utility as -built data. • Any available storm drain data (record drawings) and models. • Previous studies, GIS data. Site Visit - FNI project team will perform a site visit to familiarize the design team with the site, observe and measure the existing conditions of the stream and infrastructure. Site visit will also be used to verify topographic and SUE survey. 11.3. 60% CONSTRUCTION DRAWINGS Creation of design solutions will be based on the conceptual alternatives outlined in the WFTR Geomorphic Assessment, dated October 2022. The 60% Construction Drawings and Specifications shall be submitted to the CITY per the approved Project Schedule. ENGINEER will develop the 60% design for protection of the infrastructure and shall produce drawings to show and describe the bank stabilization design for construction for submittal to the CITY. It is assumed Area 4 and Area 5 will be combined into one plan set and a single submittal. Separation of the plan sets into two packages is not included in this scope and is considered additional services. Engineer shall coordinate with franchise utility owners to identify any conflicts between the project improvements and existing utilities. Design of any franchise utility conflicts not included in this scope. Engineer shall meet with the CITY after City review to discuss comments CITY may have as a result of internal review. 11.4. 90% CONSTRUCTION DRAWINGS AND SPECIFICATIONS The 90% Construction Drawings and Specifications shall be submitted to the CITY per the approved Project Schedule. ENGINEER will develop the 90% design of the infrastructure and shall produce drawings to show and describe the bank stabilization design for construction for submittal to CITY as follows: 90% Construction Drawings shall include further development of construction plans including the sheets identified in the 60% design submittal. 90% Specifications - ENGINEER will produce specifications necessary to build the infrastructure shown in the construction drawings. 90% OPCC - ENGINEER shall produce an Opinion of Probable Construction Cost for the 90% concept drawings. 90% Construction Drawings and OPCC QA/QC - ENGINEER shall perform a quality control, quality assurance, and constructability review of the construction drawings, specifications, and OPCC before submittal to the CITY. Engineer shall meet with the CITY after City review to discuss comments CITY may have as a result of internal review. 11.5. 100% CONSTRUCTION DRAWINGS The 100% Construction Drawings and Specifications shall be submitted to the CITY per the approved Project Schedule. ENGINEER will develop the 100% design of the infrastructure and shall produce drawings to show and describe the bank stabilization design for construction for submittal to CITY as follows: 100% Construction Drawings shall include further development of construction plans including the sheets identified in the 90% design submittal. City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 3 of 14 ATTACHMENT A DESIGN SERVICES FOR WEST FORK PARRALLEL PHASE•1 TRINITY RIVER SIPHON TO WALKER BRANCH CONNECTION 100% Specifications - ENGINEER will produce specifications necessary to build the infrastructure shown in the construction drawings. 100% OPCC - ENGINEER shall produce an Opinion of Probable Construction Cost for the 100% construction drawings. 100% Construction Drawings and OPCC QA/QC - ENGINEER shall perform a quality control, quality assurance, and constructability review of the construction drawings, specifications, and OPCC before submittal to the CITY. Engineer shall meet with the CITY after City review to discuss comments CITY may have as a result of internal review. Engineer shall provide CITY with electronic files for bidding purposes, including hard copies for City -internal purposes. 11.6. FLOODPLAIN PERMIT FNI will complete site -specific hydraulic modeling for the design. Modeling will be performed using the most recent HEC-RAS model of the WFTR provided by the City which will be used as an Effective Model. Discharge values within the hydraulic model will be used for the analysis. One floodplain permit and report will be created which includes Area 4 and Area 5. Water surface profiles will be determined for storm events present in the current hydrologic model. Comparison will be based on 100-year storm event for the corrective effective and proposed condition. • FNI will create post -project conditions models. Roughness values for post -project models will be appropriate for the anticipated channel lining material per the design. • Adequate field survey and cross sections will be added to analyze the existing and proposed project conditions. • FNI will provide a table summarizing the pre -project (corrective effective) and post - project 100-year water surface elevations and velocities for each cross section and the difference in each. • FNI will develop maps that show the extent of the 100-year flood plain for comparison to existing conditions. • Submit a Floodplain Development Permit application as part of the final submittal. • Results within study reach will be documented in the Drainage Analysis Technical Memorandum. • FNI will evaluate the CDC permitting for the site. ASSUMPTIONS • Bank stabilization improvement will result in a no -rise condition. • The City will provide the most recent HEC-RAS model that should be used in the analysis. This model will be used as the effective model. • Floodway modeling not included in this scope. City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 4 of 14 ATTACHMENT A DESIGN SERVICES FOR WEST FORK PARRALLEL PHASE-1 TRINITY RIVER SIPHON TO WALKER BRANCH CONNECTION • FNI assumes that the existing conditions Hydrologic and Hydraulic model results provided by others are correct and accurate. As such, the results of those models will be used as -is. FNI will not independently verify the results of the existing - condition hydrologic or hydraulic models. • The scope does not include revisions to the hydrology model. Flows from Effective model will be used in the post -project conditions. • No CLOMR or LOMR development or submissions are included in this proposal. • FNI assumes a CDC small scale project exemption will be provided for the project. • Additional cross -sections may be added for modeling purposes within the project area. • Two (2) rounds of review by the City floodplain staff are anticipated. A Draft Drainage Analysis Technical Memo will be provided during Preliminary Design (60%) Submittal and Final Design (90%) Submittal. • No meetings anticipated with City floodplain staff. • Final Drainage Analysis will be provided during the Construction Phase (100%) Submittal. 11.7. GEOTECHNICAL INVESTIGATION The geotechnical scope includes geotechnical exploration activities and associated design services for: • Area 4 — Approximately 600 linear feet of proposed bank stabilization improvements along the eastern slope of the Trinity River west (upstream) of VCWRF's outfall. Bank stabilization techniques will include building the toe of slope back to where it was prior to the recent erosion events, laying the slope back at a flatter angle and armoring the slope with rock riprap. • Area 5 — Approximately 500 linear feet of proposed bank stabilization improvements along the southern slope of the Trinity River west of VCWRF's outfall. Due to space constraints, it is likely that bank stabilization techniques will include reinforcing the slope with the use of soil nails or anchors and armoring the slope with rock riprap. The geotechnical exploration will include geotechnical drilling and sampling, laboratory testing, geotechnical engineering analysis, and reporting. The purpose of the exploration will be to determine subsurface conditions and geotechnical design parameters for the bank stabilization. Field Exploration: 1. Exploration activities will include geotechnical drilling and sampling with a truck mounted drilling rig at the following locations: a. Area 4 — Two 75-foot-deep borings at the top of the bank located just outside of the VCWWTP fenced property at the northwest corner of the treatment plant area. Area 5 — One 75-foot-deep boring at the top of the bank located within the VCWWTP fenced property. 2. Select and mark the boring locations as stated above. Notify Texas 811 and VCWWTP personnel to request location and marking of existing underground utilities prior to the field exploration. 3. Samples will be collected intermittently using hollow -stem augers and either split -spoon or tube samplers. Rock and rock -like materials will be cored, as appropriate for the material. At completion, the boreholes will be backfilled with cuttings. 4. Groundwater observations within the borings will be recorded at the time of drilling and at the completion of drilling and sampling. 5. Provide an Engineer or Geologist experienced in logging borings to direct the drilling, log the boring, and handle and transport the samples. Visual classification of the subsurface stratigraphy shall be provided per the Unified Soil Classification System (USCS). Laboratory Testing: 1. Testing shall be performed by a geotechnical testing subcontractor on samples obtained from the boring to determine soil classification of the subsurface materials. 2. The Engineer will select samples for laboratory testing, assign tests, and review the test results. 3. Laboratory tests will be appropriately assigned for the specific subsurface materials encountered during exploration, but are expected to include: a. Atterberg Limits (liquid and plastic) b. Moisture Content and Unit Dry Weight c. Percent Passing the No. 200 Sieve d. Sieve Analysis e. Unconfined Compression Testing f. UU Triaxial Testing g. CU Triaxial Testing Geotechnical Engineering Analysis and Reporting: 1. Geotechnical results from Area 4 and Area 5 will be combined into one report. Prepared Geotechnical Memorandum to include: a. Appendix with the sample locations, sample/boring log, laboratory test results, and a key to the symbols used. Develop shear strength characterizations and geotechnical design parameters based on the boring and laboratory test data. c. Evaluate and analyze representative channel cross section for the proposed bank stabilization design. The analyses will include slope stability, soil nail/anchor design and expansive soil movement potential. d. Summarize the analyses and conceptual design. The memorandum will include a summary of the soil properties and shear strength parameters, geotechnical design parameters, results and summaries of the analyses performed, and other general recommendations related to the design and analysis of the bank stabilization. 2. Develop up to six (6) detail sheets, including section views, details, and general notes for the bank stabilization for the 60%, 90%, and 100% design submittals. 3. Prepare technical specifications, as necessary, for the bank stabilization design for the 60%, 90%, and 100% design submittals. Additional Services: 1. Additional services not included in this scope, requiring additional fees, may include: a. Mobilization of a track -mounted drill rig, related equipment, clearing, or exploration activities for additional structures. 11.8. ENVIROMENTAL AND ARCHAEOLOGICAL PERMITTING AND SUPPORT FNI assumes that the proposed project can be designed to meet the terms and conditions of Nationwide Permit (NWP) 13, Bank Stabilization. Based on our preliminary desktop review and discussions with the design team, it is assumed that the project will require the submittal of a pre -construction notification (PCN) for Clean Water Act Section 404 authorization by the U.S. Army Corps of Engineers (USACE) Fort Worth District. Gather and Review Existing Information: FNI will review existing project information and compile information of the proposed project area in preparation for the site visit. The types of information that will be gathered will include, U.S. Geological Survey (USGS) 7.5-minute topographic maps and National Hydrography Data (NHD), U.S. Fish and Wildlife Service (USFWS) National Wetlands Inventory (NWI), Natural Resources Conservation Service (NRCS) soils, as well as recent and historical aerial imagery of the site. • Conduct Site Visit/Delineation: FNI environmental scientists will walk the project area to identify the types and boundaries of potential waters of the U.S. including wetlands. FNI will delineate the ordinary high water mark along City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 7 of 14 ATTACHMENT A DESIGN SERVICES FOR WEST FORK PARRALLEL PHASE-1 TRINITY RIVER SIPHON TO WALKER BRANCH CONNECTION the proposed treated bank with pin flags for a Registered Professional Land Surveyor (RPLS) to tie in. FNI environmental scientists will also evaluate the site regarding potential federally listed threatened and endangered species habitat. Pre -Application Meeting with USACE: FNI will prepare a letter to the USACE Fort Worth District Regulatory Division requesting a pre -application meeting. The letter will include a brief description of the project, its purpose and need, maps and conceptual design drawings. FNI will coordinate and attend the pre - application meeting with the USACE Regulatory Division. This scope assumes that the pre -application meeting will be held using the USACE's preferred virtual platform. • Delineation Report: FNI will prepare a Delineation Report in accordance with U.S. Army Corps of Engineers (USACE) guidance to document potential waters of the U.S., including wetlands. The Delineation Report will include the required data forms and maps. • Prepare PCN: FNI will prepare a Pre -Construction Notification (PCN) in accordance with requirements of NWP General Condition 32. A draft PCN will be prepared for the City's review and comment. The PCN will include the Delineation Report, USACE Fort Worth District's NWP 13 application form, and required supporting documentation and engineering drawings depicting the proposed impacts to waters of the U.S. The final PCN will be prepared by incorporating the City's comments and will be submitted to the USACE Fort Worth District. This task will be completed after the 60% design submittal. FNI will address up to two rounds of USACE comments/requests for additional information or clarification. This scope assumes that any required mitigation will be covered by the purchase of mitigation bank credits; therefore, development of a mitigation plan is not included in this scope of services. Additional requests by the USACE for site visits, preparation of a compensatory mitigation plan, consultation with other resource agencies, or excessive request for additional information resulting in expenditures beyond FNI's project budget will be considered additional services. THC Coordination: Projects sponsored by public entities that affect a cumulative area greater than five acres or that disturb more than 5,000 cubic yards require advance consultation with the Texas Historical Commission (THC) according to Section 191.0525 (d) of the Antiquities Code of Texas. Once the Area of Potential Effect (APE) has been defined, FNI will review the restricted THC atlas with FNI's archeologist and prepare a letter describing the project, including maps, requesting review by the THC to determine if a cultural resources survey will be required. This task does not include a cultural resources survey but it can be provided as an additional service. City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 8 of 14 ATTACHMENT A DESIGN SERVICES FOR WEST FORK PARRALLEL PHASE-1 TRINITY RIVER SIPHON TO WALKER BRANCH CONNECTION • Project Team Coordination: FNI scientists will coordinate with the project team (design team and City) on the findings of the delineation, assist with fill calculations, and provide permitting input into the design. • Deliverables: a. Request for Pre -Application Meeting b. Delineation Report c. NWP PCN 11.9. BID PHASE SERVICES Upon completion of the design services and approval of the Final drawings and specifications by the OWNER, the ENGINEER will proceed with the performance of services in the bid phase. ENGINEER will support the bid phase of the project as follows. • The ENGINEER will provide technical assistance with contractor's questions. • Then ENGINEER will prepare up to two (2) addendum as needed for any plan revisions. • Utilize BIM360 for electronic bid document distribution, bidder's questions, and electronic bid submittal. Printed bid documents will be available at City Hall. City Hall shall receive all printed bids. • Attend the prebid conference in support of the CITY. • ENGINEER will prepare itemized discrepancies, check contractor recommendation of award. ASSUMPTIONS bid tabulation, evaluated bids for references, and prepare letter of • Area 4 and Area 5 will be bid together but separately from the West Fork Collector Parallel, Phase I project. • The project will bid only once and be awarded to one contractor. • 10 RFIs • 2 Addenda DELIVERABLES • Plan Revisions (if required) • Letter of Recommendation • Bid Tabulation City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 9 of 14 ATTACHMENT A DESIGN SERVICES FOR WEST FORK PARRALLEL PHASE-1 TRINITY RIVER SIPHON TO WALKER BRANCH CONNECTION 11.10. TOPOGRAPHICAL SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES (LEVEL B) ENGINEER will provide survey support as follows: 11.10.1. Design Survey • ENGINEER will perform field surveys (Area 4 - approximately 1,000' wide by 1,000, Area 5 - approximately 2,000' wide by 2,000') to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, elevations of all sanitary and adjacent storm sewers, manhole rim/invert elevations, location of buried utilities where visible, structures, trees (measure caliper, identify overall canopy, and identify species of trees), and other features relevant to the final plan sheets. • The minimum survey information to be provided on the plans shall include the following: — A Project Control Sheet, showing ALL Control Points, used, or set while gathering data. OUTFALL STRUCTURE STRUCTURAL EVALUATION Engineer will provide a structural condition assessment as follows: A visual condition assessment of the VCWRF's outfall discharge structure will be made by a team including a senior structural engineer and surveyors to assess the general condition of the discharge structure. It is the understanding of FNI that the VCWRF's outfall discharge structure can be shut down for a period of one hour for entry and observation. 11.11.1. Site Visit • FNI and surveyor will perform visual observations, measurements, and photo documentation of the outfall structure. • Observations within the area of the structure not accessible during discharge will be made in the dewatered condition within a 1-hour time frame. 11.11.2. Technical Memorandum • FNI will create a technical memorandum report documenting results of the structural condition evaluation. The report will make recommendations for further investigation or special testing as appropriate. If needed, conceptual repair recommendations will be provided. • Survey data during assessment will be combined with survey collection as outlined in Task 11.10 ASSUMPTIONS • Flow within the WFTR will be at or near baseflow so that backwater is not within the outfall structure and inspection of any voids under the structure can be conducted. • City will turn off the outfall and provide lock -out -tag -out or a safety protocol to ensure that the outfall remains dewatered during the time of inspection. Adopt the attached appropriation ordinance adjusting appropriations in the Water and Sewer Bond 2017A Fund by increasing estimated receipts and appropriations for the West Fork Collector Parallel, Phase I Trinity River Siphon to Walker Branch Connection project (City Project No. 103291) in the amount of $663,052.00 and decreasing estimated receipts and appropriations in the Unspecified -All Funds project (City Project No. UNSPEC) by the same amount to effect a portion of Water's contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: On September 28, 2021,, Mayor and Council Communication (M&C 21-0770), the City Council authorized an engineering agreement in the amount of $1,291,465.00 with Freese and Nichols, Inc. (City Secretary Contract No. 56603) for the construction of West Fork Collector Parallel, Phase I Trinity River Siphon to Walker Branch Connection project. In addition, the agreement provided for erosion analysis at three locations along large sanitary sewer mains parallel to Village Creek to identify what needed to be done to protect these assets from being undermined. The agreement was subsequently revised by Amendment No.1 in the amount of $40,193.00 administratively authorized May 9, 2022, that provided for an alignment study of future collector phases to facilitate easement acquisition. Amendment No. 2 provides for the preparation of plans and specifications to protect two levee banks that are adjacent to the Village Creek Water Reclamation Facility (VCWRF). Failure to conduct the necessary bank protection improvements could result in a collapse of the levee at the two locations, leaving VCWRF susceptible to flooding from the Trinity River. Freese and Nichols, Inc., proposes to provide all the necessary services under this amendment for a fee of $613,052.00. Staff considers the proposed fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $50,000.00 is required for additional project management. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.
