AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORMWATER REV BONDS 2020 FUND, BY
INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE QUAIL
ROAD HAZARDOUS ROAD OVERTOPPING MITIGATION PROJECT (CITY
PROJECT NO. 103053) IN THE AMOUNT OF $280,000.00 AND DECREASING
ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SW HAZARDOUS
ROADWAY OVERTOPPING PROGRAMMABLE PROJECT (CITY PROJECT
NO. P00120) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09-
2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and
appropriations in the Stormwater Rev Bonds 2020 Fund, by increasing estimated receipts and appropriations
in the Quail Road Hazardous Road Overtopping Mitigation project (City Project No. 103053) in the amount
of $280,000.00 and decreasing estimated receipts and appropriations in the SW Hazardous Roadway
Overtopping programmable project (City Project No. P00120) by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
it is recommended that the City Council:
1. Authorize execution of an engineering agreement with Kimley-Horn and Associates, Inc., in the amount of $700,000.00 for design of the
Quail Road Hazardous Road Overtopping Mitigation project (City Project No. 103053);
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Rev Bonds 2020 Fund by
increasing estimated receipts and appropriations in the Quail Road Hazardous Road Overtopping Mitigation project (City Project No.
103053) in the amount of $280,000.00 and decreasing estimated receipts and appropriations in the SW Hazardous Roadway Overtopping
Programmable project (City Project Number P00120) by the same amount;
3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund by
increasing estimated receipts and appropriations in the Quail Road Hazardous Road Overtopping Mitigation project (City Project No.
103053) in the amount of $919,000.00 and decreasing estimated receipts and appropriations in the SW Hazardous Roadway Overtopping
Programmable project (City Project Number P00120) by the same amount; and
4. Amend the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
The engineering agreement recommended by this Mayor and Council Communication (M&C) with Kimley-Horn and Associates, Inc. (KHA) will
provide for engineering and design services related to the Quail Road Hazardous Road Overtopping Mitigation (HROM) project (City Project No.
103053). To better protect drivers from roadway flooding, the project will mitigate the risk of hazardous road overtopping of Quail Road as it
crosses Lake Arlington, approximately'/ mile east of Loop 820.
The HROM program is an ongoing effort to identify hazardous road flooding locations, prioritize them based on risk and, where feasible,
implement solutions to make them safer. The HROM program was created in response to life -threatening and fatal incidents associated with
flooded roads, usually at stream crossings.
In May 2021, the Transportation and Public Works Department (TPW), Stormwater Management Division (SWMD), published a Request for
Qualifications (RFQ) for various engineering consulting services. Forty-five consultants responded to the RFQ for the project design service area
with Statements of Qualifications (SOQ). An evaluation team of three City staff subject matter experts from the Stormwater Management and
Capital Delivery Divisions of TPW scored the SOQs based on company experience, prior projects, workload, and team experience. The City's
Business Equity team also evaluated and scored the SOQs. A pool of twenty-one consultants was selected based upon these scores to be
matched with specific projects. Based on this scoring, KHA, was selected as the most qualified consultant to perform design services for this
project.
In order to expedite project delivery, in September 2022, KHA was engaged through an administrative jump-start contract (City Secretary Contract
No. 58127) in the amount of $45,000.00 to participate in project development and evaluation of potential improvement altematives to be
implemented in the final design. KHA proposes to perform final design and engineering services for a fee in the amount of $700,000.00. The
engineer will also prepare plans and specifications for construction and provide services during bidding and construction. Staff considers the fee
to be fair and reasonable for the scope of services proposed.
Additional funds in the amount of $499,000.00 are requested for easement acquisition and project management. Funding for this project was not
included in the Fiscal Years (FY) 2024-2028 Stormwater Capital Improvement Program (CIP) as project development for this site had not been
finished. Funding is budgeted in the SW Hazardous Rd Overtopping project within the Stormwater Revenue Bonds 2020 and Stormwater Capital
Projects (PayGo) Funds for the purpose of funding the Quail Road HROM project.

Equity participation on this project. The City's Business Equity goal on this project is 7%.

FISCAL_ INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the SW Hazardous Rd
Overtopping project within the Stormwater Rev Bonds 2020 and Stormwater Capital Projects Funds and upon approval of the above
recommendations and adoption of the attached appropriation ordinances, funds will be available in the Stormwater Rev Bonds 2020 and
Stormwater Capital Projects Funds for the Quail Road HROM project to support the recommendation and award of the contract. Prior to any
expenditure being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds.
