Ordinance No.~~~ ~~...~UOS AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS fN THE CONTRACT STREET MAINTENANCE FUND IN THE AMOUNT OF $185,000 1=ROM AVAILABLE FUNDS FOR THE P~)RPOSE OF FUNDING A CONTRACT WITH AMEG EARTH & ENVIRONMENTAL, [NC. FOR PHASE 2 OF THE COMPREHENSIVE STORM WATER MANAGEMENT STUDY; MAKING THIS ORDINANCE CUMULATIVE OF PR10R ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTIDN 1 That in addition to those amounts allocated to the various City departments far Fiscal Year 2004- 2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Contract Street Maintenance Fund in the amount of $185,000 from available funds for the purpose of funding a contract with AMEC Earth & Environmental, Inc. for Phase 2 of the Comprehensive Storm Water Management Study. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY: Assistant Cit Attorney ADOPTED AND EFFECTIVE: ~ ~ j ~ [ ~~ City of fort VVo--~~, ~'e.~as Mayor and Council Communication S~B~ECT: Adoption of Appropriation Ordinances and Execution of Contract with AMEC Earth & Environmental, inc. for Phase 2 of the Comprehensive Storm Water Management Study RECOMMEN©~4,TION: It is recommended that the City Council authorize the City Manager to: 1. Authorize the City Manager to transfier $185,000 from the Water and Sewer Fund to the Contract Street Maintenance Fund; 2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Gontract Street Maintenance Fund in the amoun# of $185,OD0 from available funds; 3. Adapt the appropriation ordinance increasing appropriations in the Environmental Management Operating Fund in the amount of $374,000 and decreasing unreserved retained earnings by the same amount; 4. Authorize the City Manager to transfer $370,000 from the Environmental Management Operating Fund to the Environmental Management Project Fund; 5. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Enviranrnental Management Project Fund by $37D,04D; and 8. Authorize the City Manager to execute a contract with AMEC Earth & Environmental, Inc. in the amount of $740,000 #or Phase 2 of the Comprehensive Storm Water Management Study. DISCUSSION: On September 21, 2004 (M&C G20292}, the City Council authorized a contract with AMEC Earth & Environmental, inc. for Phase 1 of the Comprehensive Storm Water Management Study. Phase 1 included an update a# the City's drainage policies and design standards, review of the current stormwater program, gap analysis and recommendations far an enhanced stormwater program. Phase 2 is a continuation of the original contract and will develop funding strategies to implement the enhanced stormwater program. Phase 2 is scheduled to be completed by November 2005. The foe for this study is considered reasonable far the work proposed. The fee far this project will be shared 25% by Transportation and Public Works ($185,OD0}, 25% by Water Department ($185,000} and 5D% Environmental Management ($370,DD0). AMEC Earth & Environmental, Inc. is in compliance with the City's MNVBE Ordinance by committing to 1D% MWBE participation on Phase 2 of this project. BISCAL INFORMATIONICERTI!"ICATION: The Finance Director certifies that upon approval and completion of recommendations Nos. 1 and 4, and adoption of the appropriation ordinances, funds will be available in the current capital budgets, as appropriated, of the Environmental Management Protect Fund and the Contract Street Maintenance Fund.
