Subject: REVISION OF CHAPTER 14, OGARBAGEN rovs BACKGMD Chapter 14 of the City Code is generally referred to as the "Garbage Ordinance. " Except for changes to the fee structure, the Ordinance has not had any major revisions for several years. There have been many revisions to Federal and State laws and definitions, as well as several changes in City policies and practices in recent years. These changes have resulted in the proposed revised ordinance. All appropriate City agencies have reviewed and concur with the revised ordinance. Those participating in the review include the Department of Law, Water and Sewer and Health. In addition, the Fort Worth Clean City, Inc. has given its stamp of approval to the proposed ordinance. DISCUSSION The following indicates what are believed to be the more significant changes included in the proposed revision of Chapter 16 of the City Code dealing with garbage collection and disposal . A complete copy of the proposed revision is attached for your review. 0101k 1 . Sec. 14-1 . Definitions have been added and revised to more closely reflect those used by the Texas Department of Health and the U.S. Environmental Protection 2. Sec. 14-2. The Director of City Services or his authorized representatives are designated responsibility for administration and enforcement of the provisions of the chapter. 3. Sec. 14-21 . Provision has been added requiring storage containers that are sufficient in size and number to hold garbage and trash that normally accumulates between collection days. 4. Sec. 14-22. Section added that details what is required for collection in terms of construction, sizes, and weights of containers when loaded, bundling of brush, and placement of trash for brush and bulky waste collection. 5. Sec. 14-23. (a) Describes the, scope of solid waste collection services as provided by the City as in general "to serve the normal needs of residential dwelling units and their directly related activities. " (c) Indicates that earth, rocks, concrete, materials generated by construction or remodeling by a contractor, and materials from unimproved lots will not be collected during brush and bulky waste collection. Requires that garbage and trash be properly containerized and placed out for regular garbage collection. (c) , (d) Unscheduled or more frequent service or brush and bulky waste collection for multifamily units and commercial enterprises may be provided on a fee basis. Sec. 14-24. (c) No refunds of payments or credits for city collection service will be granted for single-family residences, duplex residences, and garage apartment that have city water service or are occupied. (d) Credits for city service for single-family residences, duplex residences, and garage apartments incorrectly rated may be given, will be the difference between the correct monthly rate and the incorrect monthly rate multiplied by the number of months involved to a maximum of six months. (e) The initial billing for service single-family residences, duplexes, and garage apartments shall be made concurrent with the initial billing for water and sewer service. There shall be no proportion of charges for a portion of a billing period. 7. Sec. 14-26. Service shall be suspended when payment for such service is not made within ten days from the date of the second notification that it is due. The owner, occupant, tenant, or lessee using or occupying any building, house, or structure shall be responsible for the payment of the collection fees. 8. Sec. 14-27. Commercial customers are required to make a minimum deposit of $25. 9. Secs. 16-46 through 14-51 . Places responsibility for inspection of refuse hauling vehicles and issuance of hauling permits with City Services Director. 10. Sec. 14-31 . City waste disposal and transfer sites are operated in compliance with Texas Department of Health rules and regulations under the direction of the Director of City Services Department. Protecting the environment and safeguarding human health are of prime importance in determining methods of operation and what wastes are accepted. Requires waste haulers to cover or secure loads to prevent littering. 11 . Sec. 14-30. (a) (1 ) Fort Worth residents showing a current water bill indicating a sanitation charge and hauling from their residences in autos, pickups, and single axle trailers - nor disposal charge. (a) (2) Fort Worth residents not presenting a current water bill indicating a sanitation charge, commercial haulers from Fort Worth and outside Fort Worth, and private haulers from outside Fort Worth - $12 minimum charge for up to 1500 pounds of waste and an additional $4 per 500 pounds thereafter. (a) (3) Vehicles or trailers with uncovered or unsecured loads $3 surcharge per load in addition to other disposal fees. 12. Sec. 14-29. All public trash receptacles and arrangements for their collection shall be approved by the Director of City Services.
