ordinance No. ~~03~~-~~~a.Oc~S AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT OPERATING FUND IN THE AMOUNT OF $370,000 AND DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE ENVIRONMENTAL MANAGMENT PROJECT FUND, MAKING THIS ORDINANCE CUMULATIVI OF PRIOR ORDINANCES iN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. 8E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2Qp5 in the Budget of the City Manager, there shall else be increased estimated receipts and appropriations in the Environmental Management Operating Fund in the amount of $370,pDQ and decreasing the unreserved retained earnings by the same amount, for the purpose of transferring said funds to the Environmental Management Project Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdictian, such decision, opinion or judgment shall in na way impair the remaining partions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That Phis ardinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriatians amending the same except in those instances where the provisions of this ardinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the City Manager to transfer $18S,DDD from the Water and Sewer Fund to the .Contract Street Maintenance Fund; 2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Contract Street Maintenance Fund in the amount of $185,DD0 from available funds; 3. Adopt the apprnpriatian ordinance increasing appropriations in the Environmental Management Operating Fund in the amount of $37'D,DDD and decreasing unreserved retained earnings by the same amount; 4. Authorize the City Manager to transfer $37D,DD0 from the Environmental Management Operating Fund to the Environmental Management Project Fund; 5. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project f=und by $37D,DDD; and 6. Authorize the City Manager to execute a contract with AMEC Earth & Environmental, Inc. in the amount of $740,DDD for Phase 2 of the Comprehensive Storm Water Management Study. DISCU55lOhl: On September 21, 2DD4 {M&C C-2D292}, the City Council authorized a contract with AMEC Earth & Environmental, Inc. for Phase 1 of the Comprehensive Storm Water Management Study. Phase 1 included an update of the City's drainage policies and design standards, review of the current stormwater program, gap analysis and recommendations for an enhanced stormwater program. Phase 2 is a continuation of the original contract and will develop funding strategies to implement the enhanced stormwater program. Phase 2 is scheduled to be completed by November 2DD5. The fee fnr this study is considered reasonable for the work proposed. The #ee for this project will be shared 28% by Transportation and Public Works ($185,DDD}, 25% by Water ©epartment t;$185,DD0} and 5D% Environmental Management {$37D,DDD). AMEC Earth i~ Environmental, Inc. is in compliance with the City's MMBE Ordinance by committing to 1 D% MWBE participation on Phase 2 of this project. The City`s goal on this project is 1 D%.
