HomeMy WebLinkAboutOrdinance 16391-04-2005Ordinance No.~~`n~"a~` AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF $370,000 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING A CONTRACT WITH AMEC EARTH & ENVIRONMENTAL, INC. FOR PHASE 2 OF THE COMPREHENSIVE STORM WATER MANAGEMENT STUDY; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the Gity Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Project Fund in the amount of $370,000 from available funds for the purpose of funding a contract with AMEC Earth & Environmental, Inc. for Phase 2 of the Comprehensive Storm Water Management Study. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competen# jurisdiction, such decision, opinion or judgment shall in no way impair the rema€ning portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and akk other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Autharize the City Manager to transfer $185,000 from the Water and Sewer Fund to the Contract Street Maintenance Fund; 2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Contract Street Maintenance Fund in the amount of $185,D00 from available funds; 3. Adapt the appropriation ordinance increasing appropriations in the Environmental Management Operating Fund in the amount of $370,DD0 and decreasing unreserved retained earnings by the same amount; 4. Authorize the City Manager to transfer $370,000 #rom the Environmental Management Operating Fund to the Environmental Management Project Fund; 5. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $37D,000; and B. Autharize the City Manager to execute a contract with AMEC Earth & Environmental, Inc. in the amount of $740,000 for Phase 2 of the Comprehensive Storm Water Management Study. I]ISClJS510N: On September 21, 2004 (M&C C-20292), the City Council authorized a contract with AMEC Earth & Environmental, Inc. for Phase 1 of the Comprehensive Storm Water Management Study. Phase 1 included an update of the City's drainage policies and design standards, review of the current stormwater program, gap analysis and recommendations for an enhanced stormwater program. Phase 2 is a cantinuatian of the original contract and will develop funding strategies to implement the enhanced stormwater program. Phase 2 is scheduled to be completed by November 2005. The fee far this study is considered reasonable for the work proposed. The fee far this project will be shared 25°1° by Transportation and Public Works ($185,DOD), 25°1o by Water Department ($185,ODD) and 50% Environmental Management ($370,000). AMEC Earth & Environmental, Ina is in compliance with the City's MNVE3E Ordinance by committing to 10% MWBE participation on Phase 2 of this project. The City's goal on this project is 10%.
