HomeMy WebLinkAboutOrdinance 27017-06-2024Ordinance No. 27017-06-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER IMPACT FEE FUND, FROM AVAILABLE SEWER IMPACT FEES, IN THE AMOUNT OF $15,697,815.00 FOR THE PURPOSE OF TRANSFERRING FUNDS FROM THE WATER/WASTEWATER WHOLESALE IMPACT FEES AND WATER/WASTEWATER RETAIL IMPACT FEE PROJECTS (CITY PROJECT NOS. 820004 AND B20005) TO THE WATER AND SEWER OPERATING FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water Impact Fee Fund, from available Sewer Impact Fees, in the amount of $15,697,815.00 for the purpose of transferring funds from the Water/Wastewater Wholesale Impact Fees and Water/Wastewater Retail Impact Fee projects (City Project Nos. B20004 and B20005) to the Water and Sewer Operating Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Impact Fee Fund in the amount of $14,584,082.00, from available Water Impact Fees, for the purpose of transferring funds from the WaterlWastewater Wholesale Impact Fees and Water/Wastewater Retail Impact Fees projects (City Project Nos. B20004 and 820005) to the Water and Sewer Operating Fund; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Impact Fee Fund in the amount of $15,697,815.00, from available Sewer Impact Fees, for the purpose of transferring funds from the Water/Wastewater Wholesale Impact Fees and Water/Wastewater Retail Impact Fees projects (City Project Nos. B20004 and B20005) to the Water and Sewer Operating Fund. DISCUSSION: During the retail cost of service studies for Fiscal Year 2024, it was determined that the use of impact fee revenues could lower the amount of water and sewer service revenue required to balance Fiscal Year 2024 budgeted revenues and expenditures. While state law and City Code prohibit the use of impact fees for operating expenses, impact fees can be used to pay principal and interest on debt associated with projects eligible to be funded by impact fees. This transfer of the total amount of $30,281,897.00, broken out as $14,584,082.00 from Water Impact Fee revenue and $15,697,815.00 from Sewer Impact Fee revenue, to the Water and Sewer Operating Fund, Wit be used to pay principal and interest on existing revenue bonds used to fund impact fee -eligible projects. Funding is budgeted in the WWN Wholesale Impact Fees and WIWVV Retail Impact Fees projects within the Water Impact Fee and the Sewer Impact Fee Funds. This project is located in ALL COUNCIL DISTRICTS. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the WNVW Wholesale Impact Fees and WNUW Retail Impact Fees projects within the Water Impact Fee and the Sewer Impact Fee Funds and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds Wit be available in the Water & Sewer Fund. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
