Change Order No. 3 will provide for low pressure digester gas bypass piping that will redirect digester gas to the existing flares while the tie-in
to the new flares is performed. The bypass will eliminate the need for an extended full solids shut down at the Village Creek Water
Reclamation Facility and will minimize the release of digester gas into the atmosphere, improving safety and reducing the risk of a process
upset during the tie-in to the new flares. Staff concurs with the Contractors request to add 35 calendar days to Milestone 1 for the time
needed to develop a bypass plan, procure materials, and install the bypass ahead of the tie-in.
It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment
in full (both time and money) for all costs arising out of, or incidental to, the above Change Order.

The existing isolation valves on the low-pressure digester gas piping system do not allow tie-ins to the
new flares to be performed without releasing large volumes of digester gas into the atmosphere.
Options to reduce the release of digester gas were explored, including temporary partial and full solids
shut downs to reduce gas production. However, it was determined that the combined risks posed by
both the solids shut down (from a process standpoint) and releasing large volumes of digester gas (from
a safety standpoint) were unacceptable. The consultant proposed a plan to utilize temporary bypass
piping to direct digester gas to the existing flares while allowing the tie-in to the new flares to take
place. Installation of the bypass piping can take place with minimal gas release and no solids shut down.
Labor hours, material costs, and quantities in the contractors' proposal were reviewed, and the City
finds them to be fair and reasonable. The approved CMR (CMR-29) is saved in E-builder.
The contractor is asking for 35 days be added to Milestone 1 for the time needed to develop the bypass
plan, procure the materials, and install the bypass piping. The City agrees to the additional time.
