THIRD RENEWAL OF
CITY SECRETARY CONTRACT NO. 42578
This THIRD RENEWAL OF TRACT 22 LEASE AGREEMENT ("Third Renewal") is made
and entered into by and between the TARRANT REGIONAL WATER DISTRICT ("District"), a
Water Control and improvement District, and the CiTY OF FORT WORTH, a Texas home rule
municipal corporation ("Tenant"), acting by and through Dana Burghdoff, its duly authorized Assistant
City Manager.
RECiTALS
WHEREAS, on or about July 29, 2011 the parties entered into City Secretary Contract ("CSC")
No. 42578, a Tract 22 Lease Agreement for the building located at 1000 Calvert Street, Fort Worth,
Texas 76107 (as amended, the "Agreement");
WHEREAS, the Agreement initially provided for an eight (8) year term with two (2)
one-year options to renew;
WHEREAS, the Tenant and District executed the First Amendment to the Agreement dated
May 6, 2013 (CSC No. 42578-A1) deleting Section 2.0 of the Agreement and renumbering Section
2.D. of the Agreement to Section 2.C;
WHEREAS, a Second Amendment to the Agreement was executed on June 15, 2017 (CSC
No. 42578-A2) to extend the initial term of the Agreement to July 29, 2022 and to add five (5) one-
year consecutive renewals (each a"Renewal") subject to agreement by the District;
WHEREAS, a First Renewal of the Agreement was executed on August 30, 2Q22 (CSC No.
42578-R1);
WHEREAS, a Second Renewal of the Agreement was executed on September 18, 2023 (CSC No.
42578-R2);
WHEREAS, the parties would now like to enter into this Third Renewal of the Agreement for
a one (1) year term.
NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of
which are hereby acknowledged, District and Tenant hereby agree as follows:
1. The Agreement is hereby renewed and extended for the third permitted renewal term of one
(1) year, commencing on July 30, 2024 and expiring on July 29, 2025.
2_ Nothing herein shall be interpreted to waive or limit either parties' sovereign or go:�ernmental
immunity.

3. This Third Renewal may be executed in any number of counterparts and by each of the
undersigned on separate counterparts, and each such counterpart will be deemed to be an original,
but all such counterparts will together constitute but one and the same Third Renewal. The parties
agree that this Third Renewal may be transmitted between them by email. The parties intend by
scanned signatures (such as, without limitation, signatures in .pdf format) constitute original
signatures and that a scanned agreement containing the signatures (original or scanned) of all the
parties is binding on the parties.
4. As modified hereby, all other terms and conditions of the Agreement shall remain in full force
and effect and are incorporated herein as if herein fully recited.
5. The statements set forth in the recitals above are true and correct and form the basis upon which
District and Tenant have entered into this Third Renewal. The Agreement is a public document on file
in Tenant's City Secretary's Office and is incarporated herein by reference for all purposes.

HEARING:
Authorize Execution of a Second Amendment to Tract 22 Lease Agreement with Tarrant
Regional Water District for Leased Premises Located at 1000 Calvert Street, Fort Worth,
Texas, for Use by the Police Department (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of a Second Amendment to Tract 22 Lease Agreement with Tarrant
Regional Water District for property located at 1000 Calvert Street, Fort Worth, Texas, for use by the
Police Department; and
2. Authorize the City Manager or his designee to execute the appropriate documents concerning the
second amendment to the Lease Agreement.
DISCUSSION:
In 2011, the City of Fort Worth entered info an eight-year Lease Agreement with Tarrant Regional
Water District (TRWD) for the property and improvements located at 1000 Calvert Street for use as a
Police and Fire Training Academy (City Secretary Contract No. 42578). With the pending sale of the
City's property located at 350 West Belknap Street to Tarrant County, the City will need to relocate
police personnel currently occupying the property. The use of the former Police and Fire Training
Academy property owned by the Tarrant Regional Water District provides the necessary space to
temporarily relocate the police personnel until a permanent facility solution can be developed.
The TRWD has agreed to extend the lease term through July 29, 2022, with five one-year renewal
options being granted to the City with the consent af TRWD. The rental rate for the property will
remain at $10.00 per year and the City will continue to be responsible for all utility service, repair and
maintenance costs. The lease amendment also allows the City to make the required alterations and
improvements to the facility in order to accommadate the relocated police operations.
This property is located in COUNCIL DISTRICT 2, Mapsco 62Y.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are appropriated in the General Fund, Police Department
Budget sufficient to cover the lease payments outlined under this Agreement. Future year payments
will be subject to appropriation.
