HomeMy WebLinkAboutOrdinance 16395-04-2005ORDINANCE NO. tl ~ ~ -~Q ' c~ ~~~ AN ORDINANCE AMENDING CITY ORDINANCE NO. 1819, BY DECREASING FROM ONE HUNDRED (100) TO TWENTY (2d) THE NUMBER OF SHUTTLES WHICH SUPERSHUTTLE DFW CORPORATION IS AUTHORIZED TO OPERATE UPON THE PUBLIC STREETS, ALLEYS AND THOROUGHFARES OF THE CITY; PROVIDING THAT THE FINDINGS AND RECITATIONS CONTAINED IN THE PREAMBLE ARE THE FINDINGS OF THE CITY COUNCIL; PROVIDING FOR WRITTEN ACCEPTANCE OF THIS ORDINANCE BY SUPERSHUTTLE DFW CORPORATION; MAKING THIS ORDINANCE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABTLITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 12, 2004, SuperShuttle DFW Corporation was granted the privilege to use the present and future streets, alleys and public tharoughfares of the City of Fart Worth, Texas, in its business of providing public shuttle service within the City's municipal limits Wirth ane hundred (100) shuttles for the period beginning January 23, 2004, and expiring January 22, 2009; and WHEREAS, SuperShuttle DFW Corporation has requested that the City amend its grant of privilege to allow SuperShuttle DFW Corporation to reduce the number of shuttles upon the City streets; and WHEREAS, the City Council finds that the public necessity and convenience require the reduction of shuttles; and WHEREAS, the City Council desires to amend City Ordinance No. 15819, to decrease from one hundred {100) to twenty (20) the number of shuttles which SuperShut#le DFW Corporation is authorized to operate in the City of Fort Worth; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TI-IE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 15819, of the City of Fort Worth, Texas, is hereby amended by decreasing from one hundred (100) to twenty (20) the number of shuttles which SuperShuttle DFW Carparatian is authorized to operate upon the public streets, alleys and thoroughfares of the City of Fort Worth. 1 SECTI®N 2. That the findings and recitations contained in the preamble hereof are expressly incorporated into and made a part of this ordinance as the findings of the City Council. SECTIUN 3. That after adoption of this ordinance, SuperShuttle DFW Corporation shall file with the City Secretary written acceptance of the terms and provisions hereof. Such acceptance of and agreement to the provisions of this ordinance shall be evidenced by the signature of the authorized representative of SuperShuttle DFW Corporation on the final page of this ordinance. SECTI®1`14. That the provisions of this ordinance shall be and are hereby declared to be cumulative of all provisions of the Code of the City of Fart Worth, Texas (1986), as amended, with respect to the regulation and operation of public shuttle service within the City's municipal limits, and, in the event of conflict between the provisions of this ordinance and such Code, the provisions of the City Code shall govern and prevail. DISCUSSION: On January 12, 21304 (M&C G-14219), the City Council adopt City Ordinance No. 15819 authorizing SuperShuttle DFW to operate one hundred shuttles on public streets, alleys and thoroughfares of the City of Fort Worth. On February 9, 2005, a request was received from SuperShuttle DFW to reduce the number of shuttles the Company is authorized to operate from one hundred to twenty shuttles. Mr.. John Stringer, Director of Risk Management of SuperShuttle DFW, requested a reduction in the number of shuttles to reflect twenty, the actual number of vehicles SuperShuttle DFW is currently operating. On February 22, 2005 SuperShuttle DFW submitted an annual payment of $2,300 in street rents[ fees for the twenty shuttles. The reduction request is based on SuperShuttle DFW`s misconception of the provisions of Ordinance 15819 which resulted in misstating the number of shuttles to be authorized in the City of Fort Worth. The reduction in fihe number of shuttles will result in $8,050.00 less in grant of privilege fee revenue.
