FIRST �MENDMENT TO
AGREEMENT FOR WATER SERVICE BETWEEN THG CITY OF FOR'T" WORTH
AND BENBRQ4K WATER AUTH4RiTY

{"Ctrstomer"} entered into that certain Wa�er Services Agreement, with term of lanuary 1,
2011 ll�ough S�ptember 30, 2031 (Fort Worth City Secxetary Contract Na. 47248) (the
"Contract"); and
WHEREAS, pursuant to the Contraci, Fort Warth tun�ishes Customer with treated,
pot�ble water on a Stand-by basis at agreed-upon delivery points and rates; and
WHEREAS, �'ort Worth and Customer desire to mutually provide standby
emergency water service to the other parry through a bi-directional meter at a new n�eter
location ("Met�r #3"); and
WI-IEREAS, Fort Wort11 will construct Meter #3 at its cost; an�d
WIIEREAS, Fort WaY�th desires to take, and Customer is willing to provide, water
d�ring an einergency for use by Fort Worth.
WI�EREAS, should Customer desire to take, Fort Worth is willing �o provide, water
durir�g ar� einergency thro�gh Meter #3 in addition to the existing meters; and
WHEREAS, duxing an emergency conditian, the available volume of water supply
is not guaranteed by either paz-ty; and
WHERAS, the attached Exhibit "A-1" generally identifies the mut�.iaily agreed
points{s) oP delivery for emergency water transfers; and
WHEREAS, the attached Exhibit "E-1" details the speciFic locations of points of
delivery including for the new Meter #3;
NOW, THEREF'ORE, the contract is �ereby arriended as �ollows:

The abave-stated recitals are incorporated herein.

The above-referenced exhibits to the Agreement are hereby added or anlended as
fallows:

Exhibit A to the Agre�ment is supplemented by E�ibit A-1, and �xhibit � to the
Agi•een�ent is replaced by Exhibit E-1; each are attached hereto and incorporated hei-ein for
all purposes.

cannections to t�1e Westside N Water System as are necessary.

water ancl the water valuine �nay be reduced or �tapped by either party at any time for
any reason.

Any water provided by Customer to Fort Worth will be paid for at the sazne rates
established far Customer to purchase from Fort Worth.

(CD 3) Authorize Execution of Amendment No. 1 to the Wholesale Water Contract with the Benbrook Water Authority Adding an Additional Water
Interconnection Point for Emergencies in the Westside IV Water System
RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 1 to the Wholesale Water Contract with the Benbrook Water
Authority, City Secretary Contract No. 47248, to provide an additional emergency water interconnection point in the City of Fort Worth Westside IV
water system.
DISCUSSION:
The Benbrook Water Authority (BWA), is a wholesale water customer (City Secretary No. 47248) but which only takes water on a stand-by or
emergency basis via finro permanent interconnection (one-way meters) between the City of Fort Worth and BWA's water system in order to provide
increased water system reliability. Due to growth in the Westside IV (WSIV) system area, the City needs to be able to provide water in an
emergency to the WSIV water system. The proposed Meter # 3 will increase WSIV system reliability in the event it is needed. This Amendment No.
1 will interconnect the existing Westside IV water main system to access BWA water on an emergency basis during an emergency event as
defined by the wholesale contract. The project includes design, survey and construction cost for a new wholesale metering station. When the
project is complete, the City of Fort Worth will have access to a not to exceed amount of 1.6 million gallons per day (MGD) at proposed meter # 3.
The City of Fort Worth will publicly procure the construction project in future public bid.
This development is located in or adjacent to COUNCIL DISTRICT 3.
