HomeMy WebLinkAboutContract 43923-A7City of Fort Worth, Texas Little Fossil Creek Interceptor Improvements Prof Services Agreement Amendment Template CPN: 1960 Revision Date: 12/08/2023 Page 1 of 2 AMENDMENT No.7 TO CITY SECRETARY CONTRACT No. 43923 WHEREAS, the City of Fort Worth (CITY) and Parsons Water & Infrastructure, (ENGINEER) made and entered into City Secretary Contract No. 43923, (the CONTRACT) which was authorized by M&C C-25877 on the 25th day of September, 2012 in the amount of $391,453.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $206,797.00 authorized by M&C C-26229 on 7th day of May, 2013, Amendment No. 2 in the amount of $43,929.00 which was administratively authorized on 1st day of May, 2015, Amendment No. 3 in the amount of $52,133.00 which was administratively authorized on the 25th day of March, 2019, Amendment No. 4 in the amount of $145,919.00 which was authorized by M&C 19-0379 on the 10th day of December, 2019, Amendment No. 5 in the amount of $209,281.00 which was authorized by M&C 21-0920 on the 30th day of November, 2021 and Amendment No. 6 in the amount of $35,190.00 which was administratively authorized on the 30th day of August, 2022; and WHEREAS, the CONTRACT involves engineering services for the following project: Little Fossil Creek Interceptor Improvements at Various Locations within the Little Fossil Creek Drainage Basin, CPN 1960; and WHEREAS, it has become necessary to execute Amendment No. 7 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $44,500.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,129,202.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Senior Professional Engineer City of Fort Worth – Water Department 200 Texas Street Fort Worth, Texas 76102 Subject: Revised request for Amendment 7 for Additional Level of Effort (LOE) for Little Fossil Creek Interceptor Rehabilitation Project – Part 2A Locations 1, 3, and 5A – Additional Easements for Location 1 Dear Walter, This letter represents a request from Parsons Water & Infrastructure Group, Inc. (Parsons) to the City of Fort Worth Water Department for Amendment 7 for the increased level of effort (LOE) to add additional temporary construction easements for Location 1. Background The project is well documented in previous letters and proposals by Parsons over the 12 years since project inception, most recently in Amendment 6 documents processed in August 2022. Parsons is currently in the latter stages of Amendment 6, focused on finalizing the construction drawings and specifications for the remaining items of the Little Fossil Creek interceptor, especially the solar- powered meter design for Location 3. This amendment originates from a decision to add temporary construction easements for reaches of Location 1. Location 1 was originally contemplated to be performed as rehabilitation. For Amendment 5, the scope of the pipeline design was changed to completely reconstruct the pipeline, mostly via conventional cut-and-cover trenching. To facilitate Contractor construction activities, we are adding 25 ft-wide temporary construction easements parallel to the existing right-of-way where the pipe will be constructed. Project Approach Most of the work will be performed by our subcontracted surveying firm, Gorrondona, a registered MWBE. Their proposal is attached. They have identified 16 separate TCE documents to be prepared. We are adding two more to remain conservative in case they discover more while performing the work. Additional hours are proposed for Parsons for engineering and administration, for the following tasks: Incorporate depictions of the easements into the design plan & profile drawings Develop the easement scheme Managing the subcontractor, including administrative hours for amended subcontracts Walter Norwood, P.E. City of Fort Worth – Water Department June 30, 2022 2 Bypass pumping scheme meetings and preliminary design Management and MWBE reporting for the extended time for this project. The work products for this amendment are the modification of drawings and production of easement documents to be submitted to the City’s real estate department. The easements include those along the pipeline, as well as others required on private property to route the proposed temporary bypass pumping pipeline generally running down the unnamed water course west of the pipeline. Budget and Schedule The Level of Effort Estimate for this task (Attachment 1) spreadsheet details the level of effort required to perform the complete the design and incorporate it into the existing design package currently under development. We anticipate 4 weeks to produce the temporary construction easement documents. With this amendment, the M/WBE participation of the Contract calculates to 2 4.9%, beyond our project goal of 22%.
