HomeMy WebLinkAboutIR 7115 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 7115 '0"RT14,0 May 6, 1986 To the Mayor and Members of the City Council 4 Subject: POLICY FOR THE INSTALLATION OF COMMUNITY FACILITIES GRACE PERIOD On January 7, 1986, (M&C G-6539), the City Council adopted changes to the "Policy for the Installation of Community Facilities ." The new policy became effective immediately on all new contracts and "on all projects where commu- nity facilities contracts had not been executed by the Transportation and Public Works Department by the date of policy adoption by the City Council and on any community facilities contract that has not been fully executed and bonded by the developer and the City within ninety (90) days after the date of adoption of this policy by the City Council ." Subsequent to the adoption of the policy changes, letters were sent on January 15, 1986 by the Development Coordinator informing the developers with contracts in process that they must return their contracts, executed and bonded, by April 7, 1986, in order to stay under the policy in effect prior to January 7, 1986. The following contracts were returned to the City fully executed and bonded by the developer prior to April 7, 1986, but for various reasons were not processed and approved by the City Council before that date: 1) Academy Corners 2) *Candleridge West Addition/Sycamore School Road Extension 3) Dabney Addition or 4) E. T. Square 5) Hacienda Mobile Home Park 6) Handley-Ederville Road Assessment Paving 7) River Trails Addition 2A and 2B 8) Summerfields Phase VI, Section IV-A 9) Summerfields Phase VI, Section IV-B, Unit II 10) Western Meadows Addition, Phase I 11) Don White Property Drainage Improvements 12) Richland Gardens Addition, Lot A, Block 3R *Submitted prior to the January 15, 1986 letter. Because City action is beyond the control of the developer, City staff does not believe it would be equitable for the City to penalize the developer for the City's inaction. Therefore, it is recommended that the subject contracts be accepted and finalized under policy provisions in effect prior to January 7, 1986 except that for all contracts which include new street construction, the roadway sections must be upgraded to meet the new standards .
