AMENDMENT No . 4
TO CITY SECRETARY CONTRACT No. 56195
WHEREAS, the City of Fort Worth (CITY) and Burns & McDonnell
Engineering Company, Inc., ENGINEER) made and entered into City Secretary
Contract No. 56195, (the CONTRACT) which was administratively authorized
on the 19 day of August, 2021 in the amount of $98,870.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $2,288,958.00 which was authorized by M&C 22-0530 on
June 28, 2022, Amendment Number 2 in the amount of $210,301.00 which was
authorized by M&C 22-0873 on October 25, 2022; Amendment Number 3 in the
amount of $8,000.00 which was administratively authorized on July 24, 2023;
and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Ray White Road, CPN 103270; and
WHEREAS, it has become necessary to execute Amendment No. 4 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $200,363.00. (See Attached Funding Breakdown Sheet,
Page -4-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $2,806,492.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Burns & McDonnell Engineering Company, Inc. (BMcD) is pleased to submit this proposal in the amount
of $200.363.00 for professional engineering services required for construction of the proposed
improvements on Ray White Road from Mirage Drive to the bridge over Bear Creek. The proposal
includes development of a floodplain study/report for Bear Creek, analysis of the Merwick subdivision
detention pond, CMAR value engineering design workshops, and revised geotechnical design. The
proposal includes additional topographical survey data and development of additional ROW/Easement
documents. The proposal also includes ICE evaluation of CMAR construction estimates, and tree removal
permit application.
Please note the following fee request summary:
1. 14VJ Engineering Fee Request - $21,668
The following summarizes CMAR coordination services, and additional geotechnical services.
a. Tasks 3.2.01 Portland Cement Concrete (PCC) Joint Tvues, Spacing. and Steel
Reinforcement Recommendations: HVJ will provide PCC joint types and spacing; steel
reinforcement steel recommendation, and recommendations for reinforcement details and
PCC pavement joint types and spacing.
b. Task 3.2.02 Temoorary Pavement Desian: HVJ will provide a temporary pavement design to
be used for temporary roadway widening and in removed medians/islands to facilitate
construction of project.
c. Task 3.2.03 Value Enaineerina for CMAR Coordination: HVJ will provide support during
the pre -construction phase. This work includes participating in value engineering meetings
with the CMAR and CoFW Project Management staff and provide revised pavement design
and information/recommendations based on the outcome of the meetings/discussions.
d. Task 3.2.04 Recommendation to Reduce Differential Settlement: HVJ will provide
recommendations to reduce differential settlement at the culvert -soil interface. Due to the
potential of difference in settlements of culvert and soil around the culvert, differential
settlement may occur on pavements at culvert -soil interface.

2. Peloton Land Solutions Fee Request - $87,220
The following summarizes CMAR coordination services, additional drainage design, environmental
permitting services.
a. Task 3.1.18 (60%) Preliminary Value Enaineerin2 ($32,080): Peloton will provide additional
design support during the pre -construction phase by participating in value engineering
meetings, design review meetings, and design revision/constructability meetings with the
CMAR. This work includes storm drainage line design updates in coordination with the
CMAR during the pre -construction Dreliminary design phase.
b. Task 4.1.10 Floodplain Studv/Reaort ($22,420) — Peloton will provide a floodplain study of
the northern end of the project that is affected by the current effective floodplain of Big Bear
Creek. The project ties into the south side of the existing bridge over Bear Creek, with the
proposed roadway to be built on existing grade; therefore, no fill is proposed as part of this
project. However, floodplain permitting may be required since the work will occur in the
current effective regulatory floodplain. Peloton will use existing available Hydrologic and
Hydraulic (H&H) models and other data to prepare and submit a floodplain development
permit for the project. It is anticipated that this permitting can occur using data from available
H&H models for Big Bear Creek, so no modeling or new H&H analysis is expected or
included in this scope.
c. Task 4.1.11 Detention Pond Analvsis ($32,720) — Peloton will update & finalize the drainage
study to include analysis of two (2) existing detention ponds that affect the project, including
recently acquired topo for the Merwick subdivision pond. Previous effort on these ponds was
not included in the scope of work, and observation of the Merwick pond indicated that the
record drawings were no longer accurate due to significant deposits of silt.
The objective of this analysis will be to measure and determine the impacts of increased
impervious areas from the roadway improvements project and identify possible options to
mitigate any unallowable impacts. Detailed design of any mitigation efforts is excluded but
can be provided as an additional service.
d. Revised Environmental Documents. Based on the revised construction plans, Peloton
biologists will modify and update the existing NWT 14 documents for re -submittal to the
USACE. Peloton shall also prepare a revised Preliminary Jurisdictional Determination (PJD)
report to include with the NWP 14 submittal based on the revised construction plans. Peloton
will also coordinate with the project's selected mitigation bank(s) to provide revised
mitigation quotes and updated credit sales agreements as needed.
3. Gorrondona & Associates Fee Request - $29,060
The following summarizes additional topographical survey services and ROW/Easement
document preparation services.

a. Task 7.2 Right-of-Wav/Easement Preparation and Submittal Services ($3,278):
Development of one (1) access easement and two (2) temporary construction easement
documents for construction of driveway at 9813 Ray White Road.
b. Task 8.1 Desisn Survev ($25,782): Topographical land survey of the existing Merwick
subdivision detention pond to facilitate drainage analysis. Work includes topographical
information of curb and pavement marking along Park Vista Boulevard from bridge over
Bear Creek to Walmart Fuel Station driveway (just south of Golden Triangle Boulevard)
to facilitate pavement marking updates. Work also includes land survey at 9813 Ray
White Road to facilitate design of new driveway; aerial (drone) mapping of debris -dump
mound located at the west side of Park Vista Boulevard at Bear Creek bridge approach to
facilitate earth work quantity removal assessment.
4. BMcD Fee Request - $62,415
The following summarizes additional CMAR services, easement document development, and tree
removal permitting services.
Independent Cost Estimate Analysis Fee Request - $57,467
a. Tasks 4.5.1 Baseline Schedule and Cost ($15,199): Develop baseline schedule and
Opinion of Probable Construction Cost (OPCC).
b. Tasks 4.5.2 CMAR Cost Review and Reconciliation ($9,986): Compare costs to baseline
OPCC and develop comparison spreadsheet with prioritized list of items based on highest
cost variance.
c. Tasks 4.5.3 Meetings & Administration ($32,282): Attend up to two reconciliation
meetings with the CITY, CMAR, and design team leads; and conduct internal cost
analysis review team coordination and quality review meetings.
Right-of-Way/Easement Fee Request - $2,448
a. Tasks 7.2 Right-of-Wav/Easement Preparation and Submittal Services ($2,448):

Scope for Enaineerina Desian Related Services for Arterial Improvements
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
Amendment No. 4
OBJECTIVE
Provide conceptual and final level engineering design and analysis and opinion of probable
construction costs and construction phase services associated with roadway improvements
along Ray White Road from Mirage Drive to the bridge north of Camrose Street. This work
includes Independent Cost Estimate (ICE) evaluation of Construction Manager at Risk
(CMAR) construction estimates, CMAR related design workshops and value engineering
meetings. Work includes development of a floodplain study/report for Bear Creek, analysis
of the Merwick subdivision detention pond, additional topographical survey data. Work also
includes development of additional ROW/Easement documents, and tree removal permit
application.

TASK 3. PRELIMINARY DESIGN (60 PERCENT).
Preliminary plans and specifications shall be submitted to CITY per the approved Project
Schedule.
ENGINEER will develop the preliminary design of the infrastructure as follows:
3.1. The Preliminary Design Drawings and Specifications shall include the following:
• 3.1.18 (Includes 90%) — Revised Drainaae Desian plans resulting from Value
Engineering input from the CMAR.
3.2. Geotechnical Investigation/Pavement Design shall include the following:

• 3.2.01, 3.2.02 and 3.2.04:
o ENGINEER will design up to three (3) pavement design alternatives for
the shallow culvert location.

o ENGINEER will design up to two (2) temporary design alternatives for
construction phasing assuming HMAC over LSS and HMAC over FLEX

City of Fort Worth Standards.
o ENGINEER will prepare/submit one draft design report and one final
design report incorporating comments. The results of this additional work
will be added to HVJ's original draft report as we respond to the
comments received.
o No travel for site meetings or conferences are included and it is assumed
that all communications can be via telephone conference calls or emails.
o Bid and Award responses to RFIs from contractors is included.
o CMAR Coordination services are included in this estimate.
o No CAD submittals for the joint layout plan are included in this estimate
and HVJ assumed that Burns & McDonnell will complete the plan
drawings.
o No additional field data collection is required or included with this scope.
DELIVERABLES
A. 3.1.18 — Revised Preliminary Drainaae Desian plans resulting from Value
Engineering input from the CMAR including QC/QA documentation.
B. 3.2.01 — Joint type, joint spacing, and steel reinforcement recommendation.
C. 3.2.02 — Temporary pavement design recommendation.
D. 3.2.04 — Recommendation to reduce differential settlement.
TASK 4. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS
(100 PERCENT)
Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as
follows:
4.1. Final draft construction plans (90%):
• 4.1.09 — Revised 90% Drainaae Desian plans resulting from Value
Engineering input from the CMAR.
• 4.1.10 — Floodplain Studv/Report — ENGINEER will provide floodplain
study of the northern end of the project that is affected by the current
effective floodplain of Big Bear Creek.
• 4.1.11 — Detention Pond Analvsis — ENGINEER will provide drainage
study that includes analysis of two (2) existing detention ponds that affect

the USACE, based on the revised construction plans.
o Prepare a revised Preliminary Jurisdictional Determination (PJD)
report to include with the NWP 14 submittal based on the revised
construction plans.
o Coordinate with the project's selected mitigation bank(s) to provide
revised mitigation quotes and updated credit sales agreements as
needed.
4.5. Construction Cost Analysis:
ENGINEER shall assemble an internal team, comprised of individuals outside
the project design team, to perform an independent cost analysis as outlined
below. Team shall include a Project Manager, Construction Project Manager,
Cost Estimator, and Scheduler.
4.5.1 — Baseline Schedule and Cost:
o Develop a Baseline Schedule and Opinion of Probable Construction
Cost (OPCC).
4.5.2 — CMAR Cost Review and Reconciliation:
o Compare CMAR provided costs to baseline OPCC and develop
comparison spreadsheet with prioritized list of items based on highest
cost variance.
4.5.3 — Meetina & Administration:
o The ENGINEER will attend up to two reconciliation meetings with the
CITY, CMAR, and design team leads.

The ENGINEER will use existing available Hydrologic and Hydraulic (H&H)

The ENGINEER anticipates that the permit can occur by using data from
available H&H models for Big Bear Creek. No modeling or new H&H analysis is
expected or included in this scope.
4.1.11 — Detention Pond Analvsis: Previous effort on these ponds was not

Cost analysis, as outlined above, will be performed on the project. Additional
separate cost analyses for individual CMAR proposed alternatives are not
included in this scope. CMAR should submit cost impacts along with all
proposed alternatives for consideration by the design team and CITY. Any
alternatives accepted and incorporated into the final plans will be considered
by the cost analysis team in the development of the reconciled OPCC.
• Meetings involving the CITY and CMAR will be held in -person at or near the
CITY's offices. ENGINEER's lead staff will attend in -person with support staff
virtual.

• The ENGINEER shall prepare documents to be used to obtain right of way and
peFFnaReRt and- nr temporary easements required to construct the improvements.
• The ENGINEER shall prepare a RQVVand Easement parcel reference map
showing and designating all land interest for the project. The map shall be
revised as necessary throughout the land acquisition process.
• The documentation shall be provided in conformance with the checklists and
templates available on the City's document management system (BIM 360)
Project Resources folder.
ASSUMPTIONS
• The scope includes effort to prepare one (1) Access Easement and two (2)
Temporary Construction Easement documents for the property located at 9813
Ray White Road.
• ENGINEER will show easements shown on final plats.
• Scope does not include property research or right-of-way research. Documents
will be developed based on research completed under the provisions of contract
Amendment 1.
• No new Right -of -Entry notifications are required. Right -of -Entry notifications
prepared and submitted for work completed under the provisions of contract
Amendment 1 will be used for survey access.
• The following scope of work is not included: chain of title research, parent tract
research, additional research for easements not included in the TAD records,
right-of-way takings, easement vacations & abandonments, right-of-way
vacations, and street closures.

ENGINEER will provide survey support as follows.

Design Survey:
The field survev and survev information and controls described in Section 8.1 of
Contract Amendment-1 apply to this contract amendment and are included by
reference. This includes applicable horizontal controls, vertical controls,

Direct Expenses (non -labor) include, but are not limited to, mileage, travel and

iv. Budgets. ENGINEER will make reasonable efforts to complete the work
within the budget and will keep the City informed of progress toward that end so
that the budget or work effort can be adjusted if found necessary.
ENGINEER is not obligated to incur costs beyond the indicated budgets, as may
be adjusted, nor is the City obligated to pay ENGINEER beyond these limits.
If ENGINEER projects, in the course of providing the necessary services, that the
PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether
by change in scope of the project, increased costs or other conditions, the
ENGINEER shall immediately report such fact to the City and, if so instructed by
the City, shall suspend all work hereunder.
When any budget has been increased, ENGINEER's excess costs expended prior
to such increase will be allowable to the same extent as if such costs had been
incurred after the approved increase.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
II. Method of Payment
A. The ENGINEER shall be paid by the City based upon an invoice created on the
basis of statements prepared from the books and records of account of the
ENGINEER, based on the actual hours and costs expended by the ENGINEER
in performing the work.
B. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
C. ENGINEER shall prepare and submit invoices in the format and including content
as presented in Exhibit B-1.
D. Payment of invoices will be subject to certification by the City that such work has
been performed.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department monthly progress reports and
schedules in the format required by the City.

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment Number 4 to the Professional Engineering Services
Agreement with Burns & McDonnell, Inc., City Secretary Contract No. 56195, in an amount not to exceed $200,363.00 for a total revised
contract amount of $2,806,492.00 for the Ray White Road Improvements project (City Project Number 103270).
DISCUSSION:
In the fall of 2021, funds were allocated to advance delivery of the 2022 Bond Program projects. On August 19, 2021, an Engineering
Service Agreement with Burns & McDonnell Engineering Company, Inc. (City Secretary Number 56195) in the amount of $98,870.00 was
administratively authorized to get early design activities started. The agreement was subsequently amended on June 28, 2022 in the
amount of $2,288,958.00 to provide for the full scope of the required design activities. Amendment Number 2 in the amount of
$210,301.00 for right-of-way services was approved on October 25, 2022. Amendment Number 3 was administratively approved in June
24, 2023 in the amount of $8,000.00 to provide peer review for the modifications of a roundabout.
This Mayor and Council Communication (M&C) will authorize execution of Amendment Number 4 to the Agreement and increase the
contract amount by $200,363.00 for a revised contract amount of $2,806,492.00. Additional scope of work by the consulting engineer has
become necessary, as a result of the need for:
1. Value engineering sessions with the contractor and an independent cost estimate of the contract price for the purpose of
evaluating the proposed cost of the construction and determine any cost savings potential.
2. Specific geotechnical engineering due to the vertical clearance of a storm drain box relative to the final pavement section.
3. Evaluation of a detention pond on the south end of the project which will receive storm water from Ray White
Road.
4. Preparation of a Nationwide Permit 14 from the Corps of Engineers on the north end of the project where storm
water from the
roadway will discharge into Big Bear Creek.
5. Additional right-of-way acquisition documents beyond those anticipated.

The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2022 Bond
Program Fund for the Ray White Road project to support the approval of the above recommendation and execution of the amendment.
Prior to any expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability
of funds.
