AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 59214
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 59214,
(the CONTRACT) which was authorized by M&C 23-0187 on the 28th day of
February, 2023 in the amount of $ 475,000.00; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Gateway Park Phase I Design, CPN 104192; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer, which was authorized by M&C 24-0524 on the 111h day of June,
2024 in the amount of $1,255,000.00. (See Attached Funding Breakdown Sheet,
Page -4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,730,000.00.

Scope of Services
PROJECT DESCRIPTION
Gateway Park is located in east Fort Worth, inside of the 820 loop, north of 1-30 and east of I-35W.
Gateway Park is the only regional park in Fort Worth and is approximately 791 acres. The Trinity River
borders the park to the south and bisects the east portion of the park as it extends northward. In
addition to the river, Gateway Park is home to the City's only competition synthetic field complex, a
baseball/softball complex with concession, disc golf course, Fort Woof Dog Park and mountain bike trails
that connect to Trinity River Trail System. Remediation of an old water treatment facility is ongoing and
a portion of the east side of the park was at one time a landfill site.
The 2022 Bond Program identifies $8M for updating of park Master Plan and initial Phase 1
development, as prioritized through master plan process. Additionally, the Tarrant Regional Water
District will fund $6.6M for the Phase 1 improvements. The aggregate total for design and construction
of Gateway Park Phase 1 Park improvements will be $14,600,000
The Phase 1 project area will include park improvements identified as the Phase 1 improvements in the
approve Gateway Park Master Plan.
The purpose of this project is to prepare final construction plans, specifications and cost opinion
documents for park improvements (listed below), in an effort to align with the approved Gateway Park
Master Plan.
Park improvements include:
■ Monument Signage (Architectural and structural design for monumentation signage located at
the entry drive at N. Beach Street).
■ Entry Drive, Park Access Drive and Vehicular Parking (Design of paved vehicular driveway entry
and access drives, and parking areas)
■ Trail and Sidewalks (Design of soft surface and hard surface trails for pedestrian, bicycle, and/or
equestrian use. Design of concrete sidewalks, stairs, ramps and accessible pedestrian
connections for the proposed site improvements)
■ Restroom Building (Architectural and structural design of a custom restroom building and
attached storage or concession service area)
■ Picnic and Shade Pavilions (Architectural and structural design of a custom pavilion structure
with picnic tables and seating areas, and additional fabricated shade structures)
■ Pedestrian Bridges (Design of pedestrian bridges at the existing Oxbow, to provide a looped trail
connection to the existing Trinity River Trails network).

■ Utility Service Design (Design of Water, Sanitary Sewer and Storm Drainage facilities for the
proposed park improvements)
■ Landscape and Irrigation Design (Design of permanent irrigation system for the proposed
landscape areas and sports fields, and design of landscape planting for the site entry, water
quality areas, sports field turf, and site landscaping)
■ Traffic Study and Driveway Access (Design of new entry drive at North Beach Street and
coordination with City of Fort Worth for preparation of the associated traffic analysis.
■ Playground Area (Design for associated paving and drainage improvements required for
installation of a City of Fort Worth Standard Park Playground prototype)
■ Water Quality Treatment Areas (Design of subsurface drainage, soil media, landscape planting
areas and calculations for the minimum required TRWD Water Quality Improvements)
Basic services consist of the preparation of final design, construction documents, project manual and
cost opinion documents.
Special Services shall be those services necessary to provide appropriate design guidelines for the
design/construction documents. (i.e., geotechnical reporting, topographic survey, drainage design and
coordination with USACE and TRWD. These are described in the detailed Basic and Special Scope of
Services.
Project duration is anticipated to be approximately fourteen (14) months (425 Calendar days), as
described in the detailed project Schedule.
Compensation for the scope of services provided for Gateway Park Phase 1 shall be provided for a total
fee of $1,255,000. The overall fee total shall not be exceeded without written authorization from the
CITY.

BASIC SERVICES
ENGINEER shall be responsible for providing the following basic services for the project.
1. Coordination/Management/Communication
ENGINEER shall perform the following tasks:
A) Attend one (1) project kick-off meeting with the CITY to review project scope, schedule,
deliverables, status reporting, communications, and expectations for the project.
B) Lead and manage the ENGINEER and sub -consultant design team throughout the project.
C) Communicate regularly by phone and email with CITY staff.
D) Provide to the CITY a one -page project status report on the last business day of each month
throughout the project.
E) Participate in meetings with CITY staff as noted specifically in each task described below.
2. Data Review/Site Visit/Base Map
ENGINEER shall perform the following tasks:
A) Gather and review available relevant project data provided by CITY and other sources.
B) Visit the project site to observe and photographically document existing conditions as necessary
for completion of the project.
C) Prepare a project base map for the project utilizing sheet format provided by CITY, ENGINEER's
special services survey data, relevant project data, and latest available aerial photographic
imagery. The project base map shall be suitable for use in both 22-inch x 34-inch (full-size) and
11-inch x 17-inch (half size) format with black and white line work (and with full -color aerial photo
background which can be turned on or off as requested by CITY).
D) Attend one (1) meeting with the CITY to review project data, site photos, base map, and other
information resulting from special services tasks prior to proceeding with preparation of
schematic design documents.
3. 30% Design (Schematic Design)
ENGINEER shall perform the following tasks:
Prepare preliminary and final schematic design and cost opinion documents as described below for
each of the anticipated park improvements identified in PROJECT DESCRIPTION section. Design for
all improvements shall follow current CITY design standards unless directed otherwise by CITY.
The ENGINEER's preliminary and final schematic design plans will consist of the following sheets:
• Cover sheet
• General notes sheet
• Summary of quantities sheet
• Plan sheets

o monument sign location
o playground location
o pedestrian bridge locations
o tennis/pickleball court locations
o planting/revegetation area locations/limits
The ENGINEER's preliminary and final schematic design plans shall be suitable for use in both 22-inch
x 34-inch (full-size) and 11-inch x 17 inch (half size) format with black and white line work (and with
full -color aerial photo background which can be turned on or off as requested by CITY).
The ENGINEER's preliminary opinion of probable construction cost (OPCC) shall be based on the
quantities indicated on the ENGINEER's plans and on unit prices current at the time of the cost
opinion preparation.
ENGINEER shall, at request of CITY, transmit to CITY electronic copies of ENGINEER work product
components including but not limited to data, photos, images, text, designs, cost opinions, etc. for
project -related use by CITY including but not limited to project budgeting, project
coordination/communication, etc.
A) Prepare preliminary schematic design and cost opinion documents described above. Plan and
other documents shall be submitted in electronic pdf format.
B) Attend one (1) meeting with the CITY to review preliminary schematic design and cost
documents and obtain CITY input and guidance prior to proceeding with preparation of final
schematic design documents.
C) Schematic Design comments received from the City will be incorporated in the 60%
Construction Documents.
4. 60% Construction Documents
ENGINEER shall perform the following tasks:
A) Prepare and submit 60% design/construction documents for all anticipated park improvements
to the CITY for review. These documents shall incorporate CITY comments and input from the
previous review of project data and existing site conditions.
B) The design/construction documents shall plan and instruct the installation of park
improvements, as based on the approved Schematic Design plans. Park improvements will
consist of the following elements.
Site grading
Storm water drainage structures (inlets, piping and bio-filtration areas)
Vehicular pavement
i. concrete parking areas

ii. a geotechnical report will be required to determine appropriate vehicular
pavement construction.
Pedestrian walks/trails
i. concrete connecting walkways
Soccer Fields
f. Sport Courts
g. Tennis/Pickleball Courts
h. Sand Volleyball Courts
i. nument Sign
j. Restroom facility
Note: All improvements will follow applicable CITY standards and details, unless directed otherwise.
Park Facility Standards will be provided by the CITY. All other required standards will need to be
researched, verified, and acquired separately.
C) 60% design/construction documents will include:
a. Design/construction plans
b. Anticipated technical specifications (outline only)
c. OPCC
D) Attend a meeting with the CITY to discuss CITY review comments regarding the 60% submittal
and obtain CITY input prior to ENGINEER's preparation of 90% construction documents.
5. 90% Construction Documents
ENGINEER shall perform the following tasks:
A) Prepare and submit 90% design documents for the park improvements to the CITY for review,
incorporating previous CITY review comments and input.
B) 90% design/construction documents will include:
a. Design/construction plans
b. Anticipated technical specifications (approximated final copies)
c. OPCC
C) Attend a meeting with the CITY to discuss CITY review comments regarding the 90% submittal
and obtain CITY input prior to ENGINEER's preparation of 100% final construction documents.
6. 100% Preliminary -Final Construction Documents
ENGINEER shall perform the following tasks:
A) Prepare and submit 100% preliminary -final design documents for the park improvements to the
CITY for review, incorporating previous CITY review comments and input.
B) 100% preliminary -final design documents required, will consist of:
a. Cover sheet (electronic format —template to be supplied by CITY)
b. Design/construction plans
c. Detailed opinion of probable costs
d. Final technical specifications (considered ready for bidding documents)
C) Comments and input from CITY regarding the 100% preliminary -final submittal will be
incorporated into the ENGINEER's submittal of final sealed and signed construction documents
for bidding advertisement by CITY.

D) Submit plans to a Texas Licensed Registered Accessibility Specialist (RAS) for review.
7. Sealed Construction Documents for Bidding
ENGINEER shall perform the following tasks:
A) Submit sealed and signed design documents for all anticipated Phase I improvements to CITY for
bidding advertisement, incorporating previous CITY review comments and input. These
improvements will consist of the elements from the previous task.
B) Bidding design/construction documents will consist of the following:
a. Sealed design/construction plans
b. Seals Page for final technical specifications
c. OPCC
8. Traffic Analysis and Driveway Access
ENGINEER shall perform the following tasks:
A) Prepare a TIA for the project. Engineer will meet one time, in person or via conference call,
with the reviewing agency to discuss and agree on the TIA scope for the project. Engineer will
arrange to collect turning movement counts at the study intersections (maximum of four
intersections) and 24-hour machine counts on the roadways to be studied. Engineer will
develop a projection of the project's vehicular trip generation and predicted distribution onto
the identified roadways.
B) Analyze the existing conditions and up to two future -year scenarios at the study intersections
and roadway links with and without the trips projected from the project. If the TIA indicates the
need for changes to the roadway or mitigation measures, KH will make recommendations in an
effort to mitigate impacts caused by the project. The results of the TIA will be documented in a
memorandum.
C) Submit the memorandum to the City for review, and then submit it to the reviewing agency.
D) Submit driveway permit for review in conjunction with the on -site civil construction plan review.
E) Prepare and submit one application for a driveway permit.
9. Bid Phase Assistance
ENGINEER shall perform the following tasks:
A) Prepare and submit written responses to bidder requests for information (RFI's), through the
CITY
B) Attend pre -bid conference, in support of the CITY
C) Assist the CITY with bid analysis, bid tabulation, and bid award recommendation
10. Construction Phase Assistance
ENGINEER shall perform the following tasks:
A) Attend the pre -construction conference, in support of the CITY
B) Review product submittals and shop drawings
C) Attend on -site construction coordination/status meetings during construction phase of project —
for a total of 14 status meetings

D) Participate in final walk-through and provide a punch list to the CITY at end of construction
phase of project
E) Observe the Site Inspection of project improvements to be completed the assigned Texas
Licensed RAS.
SPECIAL SERVICES
11. Topographic Survey
ENGINEER shall perform the following tasks:
A) Conduct a topographic survey of the project area as depicted in the project description.
Survey will be completed for the site to be used for site planning and civil engineering design
purposes. The topographic survey is to be used in-house and will not be issued as a stand-alone
survey document. The survey will consist of: Elevations around the immediate perimeter of the
site; Contour lines representing the surface of the existing ground at one foot intervals based on
a survey grid system and tied to existing control points; Observed (only if clearly visible from the
surface) locations of existing water, sewer, storm drain, and franchised utility facility
appurtenances; Dig Tess markings of subsurface utilities that are in place at the time our field
work is being done; and two benchmarks established with the survey. Boundary lines and
easements located within the project area will be shown on the survey, however, a complete
boundary survey of the subject property is not included in this scope.
12. Geotechnical Investigation
ENGINEER shall perform the following tasks through the use of a subconsultant:
A) Provide through the use of a subconsultant, a geotechnical investigation, analysis, up to twelve
(12) site borings, and engineering as required for completion of the parking lot.
B) Provide an official geotechnical report to the CITY, stating all pertinent design requirements
necessary for completion of park improvements.
13. Drainage Design
ENGINEER shall perform the following tasks:
A) Hydraulic Analysis — ENGINEER will study the City and Federal Emergency Management Agency
(FEMA) floodplains as part of this project to determine possible revisions. Consultant will
provide additional plan sheets illustrating the existing and proposed conditions, in an effort to
illustrate no adverse impacts, and will submit the revised plans to the City for review. Additional
studies for enhancement of incomplete hydrologic and hydraulic studies will not be performed.
Any errors in the existing models provided by the City or FEMA will not be revised by the
ENGINEER.
B) No Adverse Impact Analysis
a. ENGINEER will use the effective hydrologic (flows) and hydraulic models/information
from FEMA to show the proposed improvements do not cause adverse impacts to the
adjacent or downstream areas. No new hydrologic or hydraulic analysis will be
performed since the intent of this project is to reestablish the geometry and pre -
construction conditions.

b. ENGINEER will prepare plans illustrating the existing hydraulic model by updating the
City Effective hydraulic models for the project areas with topographic survey performed
under a separate task and/or available LIDAR topography. Consultant will prepare plans
illustrating the proposed condition model for each of the project areas defined above.
c. ENGINEER will extend the existing hydraulic model to the limits of the project site. All
models provided by FEMA or the City will be relied upon.
d. Separate drainage reports and memoranda will not be provided.
e. The fee for this task does not include potential review fees required by the City. Those
fees are assumed to be waived by the City.
f. This task excludes preparation of flood studies and any efforts related to FEMA
coordination or preparation of a Conditional Letter of Map Revision (CLOMR) or Letter
of Map Revision (LOMR).
g. ENGINEER will coordinate with the City, TRWD and USACE for review of the existing and
proposed modeling provided for the site, which will be prepared in an effort to illustrate
no adverse impacts.
14. Additional Services
ENGINEER will provide services not specifically provided for in the above scope as an additional
service and will be performed at the hourly rates included in Attachment B, not to exceed $25,000.
The City will submit written authorization prior to performing services under this task. For services
exceeding the budgeted amount, an additional approval and amendment will be required.
CLARIFICATIONS AND EXCLUSIONS
1. Services and work products by ENGINEER beyond those specifically described above are not included
in the project unless mutually agreed to by CITY and ENGINEER in writing priorto performance of such
services.
2. Site revisions that include deviations from the CITY approved Gateway Park Master Plan, or additional
scope in excess of $12,000,000 estimated construction value.
3. This scope excludes additional drainage design, flood modeling, environmental services, FEMA and
USACE permitting, Cultural Resource Surveys, and any additional items related to floodplain and
environmental permitting, not specifically included in the project scope.
4. CITY shall provide review, coordination, and submittals related to tree preservation ordinance
requirements.

Compensation
The services described in Attachment A Scope of Services shall be provided for a total fee of
$1,255,000. The overall fee total shown shall not be exceeded without prior written
authorization from the CITY.
Payment for the services described in Attachment A Scope of Services shall be invoiced to the
CITY on a monthly basis, based upon percentage completed for each task. Below is a fee

RECOMMENDATION:
It is recommended that City Council authorize execution of Amendment No. 1 to City Secretary Contract No. 59214, an Engineering Services
Agreement with Kimley-Horn and Associates, Inc., in the amount of $1,255,000.00, for additional engineering services for design and
development of Phase I Improvements at Gateway Park (City Project No. 104192) for a revised contract amount of $1,730,000.00.

The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 1 to City Secretary Contract No. 59214
with Kimley-Horn and Associates, Inc., in the amount of $1,255,000.00, for additional engineering services for design and development of Phase I
Improvements at Gateway Park for a revised design contract amount of $1,730,000.00.
Gateway Park is a 791-acre park located in east Fort Worth, inside the 1-820 loop, north of Interstate-30 and east of Interstate-35. Gateway Park is
the City's only Metropolitan Park, and is bordered to the south by the Trinity River, which also bisects the east portion of the park and extends
northward. Gateway Park is home to the City's only synthetic turf field complex, a softball complex with concession, a disc golf course, rowing club
boathouse, mountain bike trails, a connection to the Trinity River Trail System and the Fort Woof Dog Park. It is important to note that only 55 acres
are outside of the floodplain protected by levees and the area on East First Street (approximately 120 acres) is a former landfill which has
received clearance for the addition of soil from upriver valley storage from the Texas Commission on Environmental Quality. Due to floodplain and
landfill limitations, opportunities for facility development that include utilities and habitable structures are limited to spaces out of the floodplain and
not directly over the landfill area.
The 2022 Bond Program included $8,000,000.00 to update the Gateway Park Master Plan and Phase I development that was prioritized through
the master plan process. On February 28, 2023, an Engineering Services Agreement in the amount of $475,000.00 (City Secretary No. 59214,
M&C 23-0187) was executed for the design and development of the Gateway Park Master Plan. The master plan update was determined to be
necessary due to mitigation requirements for the Central City project, limitations to development in areas of the old wastewater treatment plant and
landfill areas, incorporation of additional park land, and consideration of new recreational and entertainment facilities since the adoption of the
2009 Master Plan. Multiple public meetings with the public and stakeholders were held in 2023 that resulted in the final park master plan and
Phase I priority improvements.
Proposed Phase I development will be predominantly focused west of Beach Street (all but 0.75 acres in floodplain) in the area of the park known
as the Oxbow Area. It will primarily include infrastructure improvements including an entry off Beach Street, new roads and parking, a restroom and
concessions building, sports courts, athletic fields, monument signage, pedestrian trails, and a bridge to provide a looped trail connection to the
existing Trinity River Trails network.
Business Equity - Kimley-Horn and Associates, Inc., is in compliance with the City's Business Equity Ordinance by committing to 6% Business
Equity participation on this project. The City's Business Equity goal on this project is 5%.
Funding is budgeted in the 2022 Bond Program Fund for the Park & Recreation Department for the purpose of funding the 2022 Bond Gateway
Park project, as appropriated.
Gateway Park is located in Council District 11.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2022 Bond Program Fund
for the 2022 Bond Gateway Park project to support the approval of the above recommendation and execution of the engineering agreement. Prior
to an expenditure being incurred, the Park & Recreation Department has the responsibility to validate the availability of funds.
