Ordinance No. 8557 Article V Section 34-176.196 of the Code of the City of Fort Worth, Texas (1964) regulates wrecker service. The last revision to the Ordinance was in April of 1982 with changes being made to Section 34-187(e)(6), which establishes uniform fee for each service rendered standard passenger automobiles and trucks. The previous change was in September of 1977. Last June, State Representative Erwin Barton, Chairman of the Human Services Committee requested a ruling from the State Attorney General regarding whether the Railroad Commission or a municipality may set rates for emergency wrecker permit holders, and related questions. Staff received information last month from the Attorney General's Office stating that an opinion had been written in response to State Representative Erwin Barton's request. The Attorney General ruled that municipalities could set rates. 00011, Based upon the ruling of the Attorney General, a survey was conducted on wrecker fees in six major cities in the State of Texas (see attachment). Staff has reviewed the information gathered from the survey, along with the recommendations of the Greater Fort Worth/Tarrant County Wrecker Association and recommends that Wrecker Fee Ordinance Section 34-187 be amended to recognize the following increase in charges: 1. (e)(6)(a) Towage Fee - From $35 to S40 2. (e)(6)(b) Extra Labor - From S30 to S35 3. (e)(6)(e) Use of a Dolly - From S20 to S25 4. (e)(6)(f) Use of a Car Carrier From S50 to S65 5. (e)(6)(g) Use of Air Cushions From 5100 to 5115 Staff believes that the aforementioned changes will bring wrecker fees authorized by the City in line with those currently charged in other major cities. Unless directed otherwise by the City Council, staff will bring forward an M&C next week for Council's consideration. Should additional information be desired, it will be furnished upon request.
