That a 10Q foot portion of a seven foot wide alley adjacent to Lots 33, 34, 51 and 52 of Block 4in the Park Subdivision, Field's Addition and a portion of Dashwood Street right-of--way between Travis Avenue and Hemphill Street Avenue, both as recorded in Volume 33, Page 281, Deed Records, Tarrant County, Texas and as more specifically descn~ed in Exh~`bits "A", "B" and "C", attached hereto and incorporated hereixz by reference be and the same is vacated and extinguished except as to the retention ofutility easements as provided in Section 3 SECTION 2. That the fee to the land in the above-described vacated alley is hereby released and shall revert- to the adjacent owner as provided by law. SECTION 3. Dashwood Street shall be retained as a utility easement as shown on the replat. A seven foot wide alley adjacent to Lots 33, 34, 51 and 52 of Block 4 in the Park Subdivision, Field's Addition shall be retauaed as a utility easement as shown on the replat. 1 SECTION 4. Tuesday, April 26, 2005 LOG NAME: 06VA-04-040 REFERENCE NO.: PZ-26$5 SUBJECT: Adoption of an Ordinance Vacating a 100 Foot Portion of a 7 Foot Wide Alley Located in the Park Subdivision of Block 4, 1='field's Addition and a Portion of Daswood Street Right-of Way between Travis Avenue and Hemphill Street and Waiving the Purchase Fee for Said Right-of--Way (VA-04- 040) RECOMMENDATION: It is recommended that the City Council adopt the ordinance vacating part of a seven foot wide alley in the Park Subdivision adjacent to Lots 33, 34, 51 and 52 of Block 4, Field's Addition as recorded in Volume 33, Page 281, Deed Records, Tarrant County, Texas and a portion of Daswood Street right-af-way between Travis Avenue and Hemphifi Street and waiving the $1©,420.00 purchase fee for said right-of way. DlscusslON: Johri Grant of Grant Engineering, acting on behalf of Melba Rance and Steve Dutton for Hemphill Samaritan, LP, has requested the vacation of the above described right-of-way in order to repiat the property into a lot. Additionally, the applicant is requesting a waiver of the purchase fee of $10,420.00. The City Plan Commission recommended approval of this request at its meeting on October 27th, 2004. Reviewing City departments and public utility companies have raised no objections to this request. The vacated right-of-way wilt be retained as utility easements as shown on the attached replat (FS-04-299). This property is located in COUNCIL DISTRICT 9.
